11.a. *Resolution 3-16-17: Supporting Proposition 51. the Kindergarten Through Community College Public Education Facilities Bond Act of 2016

Background

Proposition 51 will generate $7 billion in bond revenue for K-12 education, with $3 billion allocated to new construction and $3 billion for modernization, and another $1 billion split between charter schools and Career Technical Education facilities needs.  Most of these funds are matched with local money which expands the benefit to communities and to the state.

Current Considerations

Adequate and modern facilities are essential to student achievement - California's students cannot reach their full academic potential if clean, safe and secure school sites are not provided.  California's current system for funding facilities construction and modernization is out of money and faces a substantial backlog of unfunded needs.

As La Cañada Unified School District engages in its Facilities Master Planning process it has an interest in State dollars being available for projects and ideally there will be funding the district can access if Proposition 51 is successful.

Background

Proposition 55, the California Children's Education and Health Care Protection Act of 2016 is critical for California to retain billions of dollars in funding for education.  During the recent "great recession," billions of dollars were cut from California's education budget, resulting in devastating reductions or outright elimination of programs and supports upon which California's students and families rely.

Current Considerations

Proposition 30, which was approved by voters in 2012, was an important step toward restoring some of the aforementioned lost revenues.  However, the revenues generated by Proposition 30 will disappear fully in 2018.  The California Children's Education and Health Care Protection Act of 2016 will extend the income tax provisions of Proposition 30 (affecting the top 2 percent of wage earners in California) through 2030, ensuring that several billion dollars of critical funding for education are preserved.

The 2016-17 state budget indicates that state revenues may stall in the coming years, and that another economic downturn is likely.  Coupled with the loss of existing Proposition 30 revenues in 2018, California's schools face the danger of falling back into recession level funding in the next three to five years.  If Proposition 30 revenues are not extended, the effects on California's schools, children and families could be a major setback.

California Education Code requires that “a Governing Board of a school district shall employ for positions requiring certification qualifications only persons who possess the qualifications therefore prescribed by law.”  When fully qualified persons are not available, the Education Code allows for the issuance of emergency permits under Section 80023.  The California Commission on Teacher Credentialing (CCTC) requires that, prior to application for emergency permits, a Declaration of Need for Fully Qualified Educators form from the school district must be on file in Sacramento.

Background

The Los Angeles County Office of Education (LACOE) is developing new financial and human resources software to replace the existing systems known as BEST (Business Enhancement System Transformation). La Cañada Unified currently contracts with LACOE to use these systems for the processing of our payroll, benefits, payments to vendors, and reporting of financial and human resources data. Both systems are over 15 years old; LACOE is initiating bids to develop these new programs.

 Current Considerations

Over the upcoming five years districts in Los Angeles County will transition from the existing software to the updated versions developed by the BEST project. During that time LCUSD will pay for the existing system along with the newly developing system. There will be a direct increase in our operating costs for personnel and financial information systems. Some districts interface with LACOE via separate software. However, this also has additional costs.

 Financial Implications

Currently contracts with LACOE for existing software run approximately $20,000 per year. The new costs will be in addition to the existing software. The estimate is $11.56 per ADA, so additional costs of about $48,000 per year would be incurred beginning in 2017-18.

Background

The district has been working with Kerrie McNally of Fagen, Friedman & Fulfrost on several issues needing legal services.  In early October, Ms. McNally moved to Adams Silva & McNally LLP.

Current Considerations

The District would like to continue with Kerrie McNally through the completion of several issues requiring legal services.

Financial Implications

The rate structure for Adams Silva & McNally is competitive with other firms the district currently uses and is the cost of services with Kerrie McNally is currently in the budget for 2016-17.

Background

The Williams legislature and the Valenzuela lawsuit settlement require a school district to use its uniform complaint process to help identify and resolve any deficiencies related to: instructional materials, teacher vacancy or misassignment, facilities and CAHSEE intensive instructional and services.

Current Considerations

Los Angeles County school districts are required to report on a quarterly basis to LACOE whether or not complaints have been received. The district received no Williams Uniform Complaints.

Financial Impact

There is no financial impact for the district.
