President Kertz announced that incoming Student Board member Karen Cifuentes was not able to be present at this meeting so she will receive the Oath of Office at the next meeting.
VII. STUDENT BOARD REPORTS
Minutes:
Ryan Corr, Terra Linda HS reported:
- The first TLHS PIQE meeting of the year was held. There were 71 Spanish speaking parents in two cohorts and 29 English speaking parents in a third cohort. The meetings are designed to inform parents about curriculum, understanding the school system, identifying classes, the importance of GPA and options for higher education
- Congratulations to TLHS's student India Blaisdell who has received National Merit Scholar recognition
- Mom's Night Out fundraising event is scheduled for October 6
- The PSAT will be offered on October 11 and is free to all 10th and 11th graders
- A meeting for 8th grade parents will be held on October 23
- Financial Aid informational meetings will be held the week of October 9; the site will once again be partnering with 10,000 Degrees to offer financial awareness and enhance parent involvement
- On Monday Oct 9 an informational rally will be held for all seniors, followed by financial aid nights all week
- He reported this year's girls golf team is having the best season in school history; also reported on girls tennis, water polo, golf, volleyball and football
- Homecoming was a huge success with 600 students participating; the theme was Neverland

Yessenia Hernandez:
- SRHS held Back to School night with Link Crew taking on a greater role to help guide parents and provide interpreting for Spanish speakers
- She attended the first student panel retreat with the Assistant Principal, held at MCOE, with participation from TL, SR and Novato students; a full day retreat to talk about common issues such as homework
- ASB held its first Student Senate. It was Open Mic night with Advisory and ASB classes coming together to talk about issues on campus
- She reported on fundraisers: Off the Leash Day and the Seniors Car Wash and Bake Sale combo this past Saturday
- Homecoming week had a Broadway theme for all classes. Student body is planning a tailgate party after the Homecoming parade on October 27. The theme is a "Wicked Good Time," with the parade down 4th Street and the Homecoming game on Saturday

X.1. CAPITAL FACILITIES PROGRAM: (HSD) Consideration of Proposed Modification to Independent Consultant Agreement with A3GEO for Supplemental Geotechnical Services at Terra Linda High School
Quick Summary / Abstract:

Staff seeks review and approval from the Board for a Modification to A3GEO’s Geotechnical Engineering contract to add supplemental geotechnical services needed for new building approvals, required by the Division of State Architect (DSA) and California Geological Survey (CGS), at Terra Linda High School.



Rationale:

Background:
School building construction utilizes geotechnical engineering to evaluate soil and subsurface conditions and risks and to assist with foundation design.  These services were anticipated and broadly budgeted in the program budgets presented to and adopted by the Board. 

As projects move forward, services are defined and priced according to current scope, site plans, building designs and parameters.  The scope and pricing of each proposed increment of geotechnical services is reviewed for cost, value, necessity, schedule, budget allocation and other concerns.

Staff anticipates, plans and budgets for these essential services.  The Board may expect future similar to this one for each site or capital program building project.

On December 12, 2016, San Rafael City Schools’ (SRCS) Board of Education (“Board”) approved three firms as a qualified pool to provide Geotechnical services for the Capital Facilities Program:  Miller Pacific Engineering, A3GEO, and Ninyo and Moore.  A3GEO was approved as the Geotechnical Engineer for Terra Linda High School and pursuant to their Independent Consultant Agreement prepared a preliminary Geotechnical Report and Geologic Hazards Study for the Terra Linda High School Campus.

Current Consideration:

Now that the proposed new building locations for the Terra Linda High School master plan have been confirmed, supplemental geotechnical services are needed to further evaluate subsurface conditions and geologic hazards in order to satisfy Division of State Architect (DSA) and California Geological Survey (CGS) requirements and to develop design-level geotechnical conclusions and recommendations for the planned projects.  Supplemental Geotechnical services will include: 

  • Review of existing data
  • Site Reconnaissance
  • Subsurface Exploration
  • Geotechnical Laboratory Testing
  • Site Evaluation and Analyses
  • Geotechnical Investigation and Geologic Hazards Report

All documents have been reviewed by legal counsel.


 
Financial Impact:

The proposed cost of this work is a not to exceed amount of $40,000.

The proposed cost of this Modification to the A3GEO contract is within planned budgeting for this type of work and will be funded from the Districts Measure B bond funds.

Current Consideration:

At this time, geotechnical services are required for the first phase of new buildings on San Rafael High School Campus. The purpose of these services is to provide geotechnical services for the design and approval phases of new Madrone, Kitchen, Commons, Administration, Library Building on the SRHS campus in order to meet Division of State Architect (DSA) and California Geological Society (CGS) requirements. 

Miller Pacific Engineering Group will provide a Supplemental Geotechnical Investigation, Site Specific Seismic Response Analysis, with Supplemental Consultation and Coordination with the design team and a full report for submission to the CGS as required for DSA approval of the project.

All documents have been reviewed by legal counsel.



 
Financial Impact:

The proposed cost of this work is a not to exceed amount of $17,700.

Quick Summary / Abstract:

Staff seeks review and approval from the Board for a Modification to the Independent Consultant Agreement with Millennium Consulting Associates (“MECA”) for a limited Phase II Environmental Site Assessment at San Rafael High School.

The purpose of this modification is to provide additional survey services required as a result of a Phase 1 Environmental Site Assessment and in order to prepare a remediation plan. 



Rationale:

Background:
MECA has completed a Hazardous Materials survey of the buildings at San Rafael High School.   Those results will be incorporated into abatement and demolition plans for anticipated modernization and new construction.  They have also prepared a Phase I Environmental Site Assessment (“ESA”) for the campus which indicates potential contamination beneath the Auto Shop and the Metal Shop.  Additional survey work including sub-slab borings is required in order fully characterize the potential contamination and prepare for remediation prior to demolition and new construction planned in that area.

Staff anticipates, plans and budgets for these essential services. The Board may expect future items similar to this one for additional scope/phase work.  The scope and pricing of each proposed Modification of hazmat services is reviewed for cost, value, necessity, schedule, budget allocation and other concerns.

On January 9, 2017, the San Rafael City Schools (SRCS) Board of Education (“Board”) approved three firms as a qualified pool to provide Hazmat Consultant Services for the Capital Facilities Program: Millennium Consulting Associates, Sensible Environmental Solutions, and Terracon. Millennium Consulting Associates was assigned as the Hazmat Consultant for San Rafael High School, the San Rafael High School Stadium, and Davidson Middle School.

On April 18, 2017, Millennium Consulting Associates completed the Phase I Environmental Site Assessment (“ESA”) for the San Rafael High School campus.

Current Consideration:

Prior to demolition and soils disturbance in the areas of the existing Auto Shop and Metal Shop it is necessary to fully understand the extent of contamination in order to include remediation in the project scope.

Background:
Since 1938, The American Association of School Personnel Administrators has provided leadership in promoting effective human resource practices and is the only organization that specifically targets and represents school human resource professionals.

Current Considerations:
The 79th annual Conference will focus on services, resources, and information vital to successful school human resource practices in the interest of students.  Workshops will be presented by education experts and industry leaders and will include innovative ideas, ready to use solutions and research based strategies relevant to human resources professionals.

 
Financial Impact:

Travel and conference expenses will be paid for from the Human Resources travel budget and will be shared equally between each district.

XI.5. FINANCE: (HSD) Approval of AB 1200 Disclosure of Proposed Collective Bargaining Agreement Between the San Rafael High School District (SRHSD) and the San Rafael Federation of Teachers (SRFT) for 2016-17 and 2017-18
Quick Summary / Abstract:

The Board will review the  AB 1200 Disclosure Documents for a Tentative Agreement between SRHSD and SRFT for 2016-17 and 2017-18 for recommended approval. 




Rationale:

BACKGROUND: The District negotiations team, acting on authority from the Board of Education, met with the SRFT for nine full days of negotiations beginning in September 2016. The District filed for impasse in late June 2017.

On Friday September 8, 2017, the parties met for the first scheduled day of Impasse Mediation. By the end of the day, the parties reached agreement on the Mediator's proposed Tentative Agreement Between SRHSD and the SRFT. The Tentative Agreement was signed by both parties that evening.

On the afternoon of September 15, 2017, the District was notified the SRFT membership ratified the Tentative Agreement.

The attachments are to provide the required “Public Disclosure” of the proposed Collective Bargaining Agreement between San Rafael City High School District and the San Rafael Federation of Teachers in order to be in compliance with AB 1200, Government Code 35547.5, CCR, Title V, Section 15449 for the 2016-17 and 2017-18 fiscal year.

In addition, the disclosure document must be signed by the District Superintendent and Assistant Superintendent of Business Services at the time of public disclosure, who must certify that the District can meet the costs incurred under the Collective Bargaining Agreement for the current year and two (2) subsequent years.

CURRENT CONSIDERATIONS:  The information provided in the “Disclosure of Collective Bargaining Agreement” document summarizes the financial implications of the proposed agreement and is submitted to the Board of Education for “Public Disclosure” of the major provisions of the agreement.  This is in accordance with the requirements of AB 1200 (Statutes of 1991, Chapter 1213, Government Code 3547.5, and CCR, Title V, Section 15449.

The attached salary schedules have been revised based on this Tentative Agreement and being presented for approval.     

Although the Marin County Office of Education (MCOE) requests all AB1200 Public Disclosures to be submitted for review and comment 10 days prior to Board approval, District staff were not notified of the ratification in time to meet this deadline. Staff have prepared and submitted the AB1200 to MCOE on 09/18/17 and request approval by the Board of Education.

 
Financial Impact:

COST/FUNDING SOURCE:

The total annual (ongoing) cost of the 2016-17 and 2017-18 Proposed Collective Bargaining Agreement between the San Rafael City High School District and the San Rafael Federation of Teachers is included in the attached AB 1200-Disclosure Documentss based on the following:

ARTICLE III Compensation

  • A 3.0% ongoing increase retroactive to 7/1/2016 on the base salary of the San Rafael High School District Certificated Salary Schedule. The retroactive increase will apply only to base salary and will not apply to hourly, stipend, extra duty or overtime work.
  • A 3.5% ongoing increase retroactive to 7/1/2017 on the base salary of the San Rafael High School District Certificated Salary Schedule. The retroactive increase will apply only to base salary and will not apply to hourly, stipend, extra duty or overtime work.

ARTICLE IV Professional Development

  • 4.1.1.1. Effective July 1. 2017-June 30, 2020, the district will continue one (1) mandatory Professional Development day which will continue the .54% salary increase agreed upon on 7/1/14. This additional day is currently budgeted and will be specifically for professional development and cannot be used for any other purpose.

This agreement concludes negotiations for the 2016-2017 and 2017-2018 school years. This extends the term of the collective bargaining agreement from July 1, 2017-June 30, 2019. 

The annual cost of the Tentative Agreement not including step & column for 2016-17 and 2017-18 is $1,054,224.

These costs will be primarily covered by the General Fund 01

The Board is presented with a Joint Powers Agreement (JPA) application with SEAC for recommended approval. 



Rationale:

BACKGROUND:
School Employers Association of California (SEAC) is a California Joint Powers Authority.  JPA’s are authorized by the State of California to provide public agencies (Cities, Counties, School Districts, and Special Districts) with the opportunity to join together for a common service that is more cost effective than if the entities provided those services individually.  There are over 150 public school districts (K-14) that belong to SEAC in order to receive Employer-Employee Services (Go to www.seacal.org)for a complete list of those services), and also those enumerated in the JPA Agreement.  SEAC was founded in 1976 by the Los Angeles County Office of Education, and has been an Independent JPA since 2002.  As a public entity, SEAC is not-for-profit.  The JPA Agreement is an ongoing contract among all the member districts and continues in force unless the member district informs SEAC on or before April 1 of any year.  The JPA Fee Schedule can be found on Page 6 of the JPA Agreement and is based on current year ADA.

The Weekly E-blast gives information on all aspects of Employer-Employee Relations, including, but not limited to PERB Decisions, Court Decisions, Statutory Information, etc.  Your membership also entitles management personnel in your district to attend trainings and workshops at a member rate.  In addition, your district will be represented by SEAC through Capitol Advisors in Sacramento for legislative actions. 

The District is looking to partner with SEAC for health benefits advisory services and must be a member in order to receive discounts for these services.


SERVICES TO BE PROVIDED
The Association will provide the following services and member agencies agree to contribute information available to them as requested by the Association: 

1. LIBRARY - CLEARING HOUSE: Compile a central-file library of resources for the use of all member agencies. 

2. REPORTING: Prepare and distribute regular newsletters and special bulletins to member agencies .

3. SURVEYS: Compile and publish, in cooperation with member agencies, survey data covering wages, benefits, contract terms, etc. 

4. WORKSHOPS: Sponsor conferences and workshops as determined by the Board of Directors on the full range of labor-management relations.

5. LEGISLATION: Develop and coordinate legislative efforts, when directed by the Board of Directors.

6. GENERAL COORDINATION: Coordinate the efforts of member agencies that have pending PERB matters and furnish "amicus curiae" support in cases of general employer interest. Provide information to individual member agencies regarding resolution of common problems. Coordinate efforts and develop appropriate general management positions.

7. HEALTH BENEFITS ADVISORY SERVICES: SEAC contracts with an Independent Contractor to provide Health Benefit Advisory Services.  Those services are provided to SEAC Member Districts at a discounted rate from non-SEAC Member Districts. This contract includes a full range of services from data analysis, meeting with employer-employee groups, comparisons of all health insurance providers, recommendations for the best and most cost-effective plans as well as assisting with implementation, enrollment and beyond.

Rationale:

BACKGROUND:
Short School had two portables installed within the last four years. These portables were stored for a considerable period of time before going to Short. The roofs are standing seam, metal roofs, fairly standard for portables. These particular generation of portable building roofs are failing due to original design problems and age. Allied Roofing has been selected to provide a sprayed on coating that will preserve and seal the seams and prolong the life of the roofs.

Additionally, the edges of the roof need to be re-flashed and sealed, again because of the age of the structures and original design issues.  The interior of the portables are in fair to good condition with functional HVAC systems, lighting, Ethernet, etc.

CURRENT CONSIDERATION:
District staff obtained multiple quotes for the replacement of these two roofs at Short School. The contract is being recommended for award to the lowest responsive responsible bidder, Allied Construction Services. 

Allied will be directed to conduct the work after hours and or on a weekend to not disturb students. Should there be students in an afterschool program the area will be cordoned off and monitored to ensure no students are affected by the work. The scope of work includes power washing existing roof, sealing, silicone coating over metal roof panels, labor at prevailing rate, pedestrian safety, permits, materials and labor and 2-year labor and materials warranty.

Current Consideration:
San Rafael City Schools is currently in year four of Sobrato Early Academic Language (SEAL) implementation. We have all eight elementary schools participating in SEAL. Integrated, thematic units of instruction are being collaboratively developed as our teachers are trained in each of the six SEAL modules.   In June 2016 Houghten Mifflin Harcourt - Journeys curriculum was adopted to support our ELA/ELD instruction.  The Journeys program includes a scope and sequence detailing the progression of skills as standards are taught through the year.  While ELA/ELD standards are embedded in the SEAL units of instruction, they are not aligned to any scope and sequence.  Aligning the SEAL units of instruction, which began to be developed two years ago, to the Journeys scope and sequence will support effective instruction by providing a planning structure that sequences the critical steps in mastery of standards.

Kelli Leavell will be delivering eight days of professional development to continue the work in the areas of K-5 Scope and Sequence project and Newcomer Scope and Sequence project. This work will build on the work done by newcomer teachers last year and increase alignment between newcomer classes throughout the district and within schools to better support newcomer students as they transition from newcomer classes.

They partner with beach agencies and communities to install Beach Clean Up Stations (B'CUS), small boxes permanently mounted at beaches which contain sturdy, re-purposed bags for collecting beach debris and decorated with educational signage as well as kids' ocean-themed art. Essentially, the Stations are a way to make every day, on every beach, a clean up day. Coleman teachers are part of an outreach program bring the All One Ocean curriculum to San Rafael City Schools to be better stewards of the earth. The All One Ocean curriculum aligns with Next Generation Science Standards (NGSS).

Rationale:

BACKGROUND:
MCOE has received a grant from the Marin Community Foundation (MCF) to provide support services to students and families. The goal is to ensure that underrepresented students are college and career ready at the conclusion of their senior year. This project is a collaboration of MCOE, MCF, Canal Alliance and the District. The College Access and Success Dreamers Pilot Project works with 60 students from Davidson Middle School and 50 students from San Rafael High School. A summer kickoff was held to describe the purpose of the project and to define expectations for participants. 

Students participated in afterschool tutoring/acceleration and ongoing teacher/family collaboration which is embedded throughout the program. Davidson students in the College Access and Success –Dreamers Pilot Project had the opportunity to participate in a before school /AVID section at DMS. Site family coordinators met with the San Rafael community liaisons to provide support for families. Students are assigned to an advocate and their progress is being monitored using electronic portfolios. 

Current Consideration:
Venetia Valley will be joining with Davidson Middle School and San Rafael High School in the College Access and Success Dreamers Project. MCOE will be providing funds for the 15 week family engagement Madres Con Poder program. The Board is asked to ratify the Memorandum of Understanding between the District and MCOE. Exhibit A

 Board Policy 6153: Instruction: The Board of Education recognizes that school-sponsored trips are an important component of a student's development and supplement and enrich the classroom learning experience.  School-sponsored trips may be conducted in connection with the district's course of study or school-related social, educational, cultural, athletic, school band activities, or other extracurricular or co-curricular activities. 

Requests for school-sponsored trips involving out-of-state, out-of-country, or overnight travel shall be submitted to the Superintendent or designee.  The Superintendent or designee shall review the request and make a recommendation to the Board as to whether the request should be approved by the Board. All other school-sponsored trips shall be approved in advance first by the principal and then by the Deputy Superintendent or designee. 

No field trip shall be authorized if any student would be excluded from participation because of lack of sufficient funds.

CURRENT CONSIDERATION
This item presents for Board approval of overnight field trip for San Rafael High School Varsity Boys Basketball Team to participate in a basketball tournament in Anderson, California on December 14-16, 2017. This will be the 4th year San Rafael High School Varsity Boys Basketball Team will be attending this great tournament.

There will be approximately 14 student athletes, three teachers and four parents traveling by private cars on December 14, 2017, to Anderson, California to participate in the Anderson High School winter basketball tournament. The student athletes, teachers and parents will return to San Rafael High School the evening of December 16, 2017. Student athletes and teachers will be staying in the family home of Mr. Springhorn in Redding, CA. Most meals will be prepared at home with parent drivers joining the team. No water activities will be allowed. Each student will have their own bed. 

Adult Chaperones will be Scott Springhorn, Lee Chretien, and Tony Butler along with three parents. 

 
Financial Impact:

Cost of this trip is to be paid from team fund and parent donations. There is no cost to the district.

No student will be excluded from participation because of lack of sufficient funds.

The Board is asked to ratify a memorandum of understanding between the District and MCOE regarding the College Access and Student Success Pilot Project for Davidson MS and San Rafael HS.







Rationale:

BACKGROUND:
MCOE has received a grant from the Marin Community Foundation (MCF) to provide support services to students and families. The goal is to ensure that underrepresented students are college and career ready at the conclusion of their senior year. This project is a collaboration of MCOE, MCF, Canal Alliance and the District. The College Access and Student Success Pilot Project works with approximately 60 students from Davidson Middle School and 50 students from San Rafael High School. 

Students will participate in afterschool tutoring/acceleration and ongoing teacher/family collaboration which is embedded throughout the program. Davidson students in the College Access and Student Success Pilot Project have the opportunity to participate in a before school /AVID section at DMS. Site family coordinators meet with the San Rafael community liaisons to provide support for families. Students are assigned to an advocate and their progress is being monitored using electronic portfolios. 

MCOE will provide funds to compensate extra-hire certificated and classified staff for activities related to family engagement and student support collaboration, after/before school tutoring/acceleration and family education events.

Rationale:

Background:
Based on current law, the District is required to update Board Policy and Exhibit 6161.1 Selection and Evaluation of Instructional Materials. Elementary and Secondary Curriculum Advisory Council meetings encourages site and community involvement in the evaluation and selection of instructional materials. The Policy and Exhibit are being updated to delete material defining the "sufficiency" of instructional materials as meaning that students enrolled in the same course have identical materials from the same adoption cycle, and to delete optional material reflecting the authorization to purchase the newest adopted materials for schools in deciles 1-3 of the Academic Performance Index, as those laws have repealed on their own terms.  The updated policy also reflects the requirement to address the sufficiency of instructional materials in the district's LCAP and reflects NEW LAW (AB 575, 2016) which provides that the State Board of Education may adopt instructional materials for grades K-8 at least once, but not more than twice, every eight years.

The Administrative Regulation was also updated to align with the revised Board Policy.

Current Consideration:

In response to Trustee Jackson's question at the first reading about the stike-through of the Instructional Materials Selection Committee, the Elementary and Secondary Curriculum Advisory Council meetings encourage site and community involvement in the evaluation and selection of instructional materials. Based on current law, the District is required to update Board Policy and Exhibit 6161.1 Selection and Evaluation of Instructional Materials. Staff recommends approval of the revisions.

BACKGROUND:
The YMCA will provide truancy prevention/intervention services for the Venetia Valley students and their families.  A bilingual lead person will lead this program.  Key functions of this position include: monitoring school attendance data, attending attendance review meetings as needed, forming partnerships with families and parent groups to promote regular attendance, and making attendance presentations to various stakeholder groups as necessary.  



To support the district's goals of promoting positive student attendance and reducing chronic absenteeism.

This position is completely grant funded by county probation.

Maika Llorens Gulati:
- She attended the SRHS Back to School night, also noting the enthusiasm of teachers; Link Crew was very helpful for parents
- She also attended Back to School nights at SV and SP. San Pedro's was all bilingual and was very well attended. She enjoyed hearing about how well the no homework policy, full day K and mindfulness practice was doing at SV. She wished all schools could experience the mindfulness program
- She joined the City/Schools Liaison Committee meeting with Trustee Knell
- She attended the Marin Forum meeting
- She attended a Latino Leaders Luncheon and heard a presentation about XQ super schools which was very interesting. She noted it was probably time to provide a District update to this group

Linda M. Jackson:
- She provided the welcome for a San Pedro parent meeting where there was a presentation by the Canal Alliance
- She joined a meeting with Mary Jane Burke and Novato Superintendent Jim Hogeboom regarding the Efficiency and Effectiveness Committee. She will be Co-chair this year with Superintendent Hogeboom. This year's topics will be housing and collaborations
- On September 14 she attended SRHS Back to School night
- She attended the September 18 First 5 meeting about un-affordable housing. It was enlightening and informative. It was good to see the PreK community stepping up to get involved in the cause
- She attended SP Back to School night where the California PTA President was present with other CA PTA officers to show their support for the special work that the SP PTA does
- On Saturday she volunteered at Canal Alliance' DACA renewal event. MCF has donated funds to cover renewal fees
- She also attended the United Marin Rising Race Matters workshop

Rachel Kertz:
- She attended the Coleman Back to School night
- She also was in attendance at the First 5 meeting on un-affordable housing
- She also attended the Marin Forum meeting
