Quick Summary / Abstract:

Members of the public may address the Board on items not on the agenda. The Board will allow comments by members of the public on an agenda item during consideration of the item. Speakers will be allowed up to three (3) minutes. The Board shall limit the total time for public input on each item to 15 minutes. With Board consent, the Board President may increase or decrease the time allowed for public presentation, depending on the topic and the number of persons wishing to be heard.  It is requested that persons wishing to speak please come forward to the podium and begin by stating their full name. Please be advised that the Brown Act prohibits discussion or action on non-agenda items, and imposes limitations on board members’ responses to public comments. (Government Code section 54954.2(a).) Complaints against specific District employees should be resolved through the District’s Personnel Complaint Procedure. The right to address the Board does not exempt the speaker from any potential liability for defamation. The proceedings of the Board are public record.

15.1. Consider Approval of Resolution 19-20-22 for Certificated Employees to Teach Out of Credential Authorization Allowed Through Education Code 44258.3

Rationale:

Annually, teachers may be brought to the board for approval to teach outside of their Credential authorization.  Education Code 44258.3 allows the governing board of a school district to assign the holder of a credential, other than an emergency permit, the ability to teach any subjects in departmentalized classes in kindergarten or any of grades 1 to 12        

Two teachers are being brought forward this evening for approval:

Martin Louro holds a single subject History Credential and approval of this resolution would allow him to teach Civics.

Joshua Cohen holds single subject Biologiacal Sciences and Chemistry Credentials and approval of this resolution would allow him to teach Earth Science.

15.2. Consider Approval of Resolution 19-20-23 for a Certificated Employee to Teach Out of Credential Authorization Allowed Through Education Code 44263.

Rationale:

Annually, teachers may be brought to the board for approval to teach outside of their Credential authorization.  Education Code 44263 allows a teacher to be assigned, with his or her consent, to teach a single subject class in which he or she has 18 semester hours of coursework.
       

One Teacher is being brought forward this evening for approval:

Andrew Beam holds a single subject Social Science Credential and has completed the required 18 semester units in the area of Physical Education. Approval of this resolution would allow him to teach a Physical Education class.

15.4. Consider Approval of Resolution 19-20-25 Regarding the Education Protection Act

Rationale:
Within the provisions of the voter approved Proposition 30 on November 6, 2012, Chief Business Official’s are required before June 30th of each year to estimate the total amount of additional revenues, less refunds that will be derived from the incremental increases in tax rates made pursuant to Article XIII, Section 36(f) that will be available for transfer into the Education Protection Account during the next fiscal year. 
 
Recommended Motion:

15.5. Consider Approval of the Written Operations Report for EUSD and ECA

Rationale:
 Executive Order (EO) N-56-20 was established on April 22, 2020, to address the impact of continued school closures in response to the COVID-19 pandemic and the local educational agencies’ ability to conduct meaningful annual planning, and the ability to meaningfully engage stakeholders in these processes. EO N-56-20 issued timeline and approval waivers for the Local Control and Accountability Plan and Budget Overview for Parents as well as waving certain budgetary requirements. The Executive Order also established the requirement that a local educational agency (LEA) adopt a written report (COVID-19 Operations Written Report) explaining to its community the changes to program offerings the LEA has made in response to school closures to address the COVID-19 emergency and the major impacts of such closures on students and families.
Two Written Operation Reports, (one for Escalon Unified and one Escalon Charter Academy)  are being brought forward for approval.  Approval of the Written Operations Reports would allow EUSD and ECA to extend the deadline for LCAP adoption to December 15, 2020.
 
Recommended Motion:
The Administration recommends the Escalon Unified School District Board of Trustees Approval of the Written Operations Report for Escalon Unified School District and Escalon Charter Academy.

15.7. Consider Approval to Increase Lunch Prices

Rationale:
The federal government has a lunch price calculator to determine the district's weighted average price requirement each school year.  Escalon Unified School District's paid lunch prices are below the weighted average and cost of production.  We must either gradually adjust prices or pay the difference out of non-federal funding.  The district is requesting a $0.10 increase for paid lunch prices at all district school sites for the 2020-21 school year.  This would bring student paid lunch prices to $2.50 for Elementary, $2.65 for Middle School and $2.90 for High School.
 
Recommended Motion:
The Administration Recommends the Escalon Unified School District Board of Trustees approve the price increase of $0.10 in paid lunch prices effective July 1, 2020 for the 2020-2021 school year.

15.8. Consider Approval of Entering into a Contract with CSM Consulting, Inc. for E-Rate Consulting Services.
Rationale:

CSM Consulting, Inc will provide services to prepare documentation, forms and applications and processes regarding the Federal Communications Commission (FCC) E-Rate program.  The annual contract is $10,100 for base services within the contract.

 
Recommended Motion:
Administration Recommends Escalon Unified School District Board of Trustees approve the contract with CSM Consulting, Inc for E-Rate consulting services.

15.9. Consider Approval of the Declaration of Need for Fully Qualified Educators

Rationale:
The Declaration of Need is a required filing with the State of California on Teacher Credentialing when an individual is teaching in an area without the appropriate credential but is in individual is teaching in an area without the appropriate credential but is in the process of either completing the coursework or passage of examinations to acquire the appropriate credential. 

 
Recommended Motion:
The Administration Recommends the Escalon Unified School District Board of Trustees Approval of the Declaration of Need for Fully Qualified Educators.

15.10. Consider Approval of RGA, WLC and TPH to be Placed on a Pre-Qualified List of Architects from which the District may select an Architect for projects pursuant to the the Request for Qualifications.

Rationale:
In April and May 2020, 4 District Committee members individually reviewed the 8 submittal packages received from architectural firms responding to the District February 25, 2020 Request for Qualifications (RFQ) for architectural services. On June 5, 2020, five of the architectural firms were interviewed.  The interview committee is recommending three firms, RGA, WLC and TPH, to be placed on a pre-qualification list of architects from which the District may then select an architect, on an as-needed basis, to provide architectural services for identified projects.

The Administration Recommends the Escalon Unified School District Board of Trustees Approve RGA, WLC and TPH to be Placed on a Pre-qualification List of Architects from which the District may select as an Architect for an identified project. 




15.11. Consider Approval of Classified Job Description "Speech Language Pathology Assistant" and Authorization for Implementation of the Position as Presented

Rationale:

Speech Language Pathology Assistants (SLPA) are graduates of a Community College program that allows the graduates to to provide Speech Language instruction to students under the direction of a Speech Language Pathologist.  EUSD currently has an SLP who requested to reduce her contract to 50% for the upcoming school year.  This position will work under the direction of the 50% SLP and provide instruction to students on her caseload. The reduction of SLP time will cover the cost of the addition of the SLPA.

CSEA has approved the job description but the position has not yet been ratified by the local bargaining unit due to COVID-19 time constraints.The district is anticipating ratification. With that ratification and board approval tonight. EUSD will fill the position for the 2020-2021 school year. 

 
Recommended Motion:
The Administration Recommends the Board of Trustees approve the classified job description "Speech Language Pathology Assistant" and authorize implementation of the position as presented.

15.12. Consider Approval of the 2020-2021 Ag Incentive Grant Application

Rationale:

The Agricultural Career Technical Education Incentive Grant provides local educational agencies (LEAs) with funds to improve the quality of their agricultural career technical education programs. The goal is to maintain a high-quality, comprehensive agricultural career technical program in California's public school system to ensure a constant source of employable, trained, and skilled individuals.

Additional resources will help EHS to continue offering a quality Agriculture program to students.

15.13. Consider Approval of Title III, Part A as reauthorized by the Every Student Succeeds Act (ESSA)

Rationale:

Title III, Part A of the Elementary and Secondary Education Act (ESEA), as reauthorized under the Every Student Succeeds Act (ESSA), aims to ensure that English learners (ELs) and immigrant students attain English proficiency and develop high levels of academic achievement in English.  Title III will also assist all English learners meet the same challenging State academic standards that all children are expected to meet.

As part of the LCAP Federal Addendum Title III documentation was submitted and approved by the California Department of Education (CDE).  Local Education Agencies (LEAs) are advised to update Title III plans as appropriate and necessary in order to continue meeting the needs of ELs and immigrant students. 

 
Recommended Motion:

The Administration Recommends the Escalon Unified School District Board of Trustees Approve the 2020-2021 Title III Part A Plan of the Elementary and Secondary Education Act (ESEA) reauthorized under the Every Student Succeeds Act (ESSA).

16.1. Review List of Teachers for the 2020-21 school year: Title 5 Ed. Code 80005b

Rationale:

Education Code (EC) and Title 5 (T5) Regulations provide local employing agencies (LEAs) with teacher assignment options that can be used when an LEA is unable to assign a certificated employee with the appropirate credential.  These options, known as Local Assignment Options (LAO) allow flexibility at the local level and are used at the discretion of the LEA. 

Title 5 Section 80005 (b) may be used to assign staff to a departmentalized setting, in grades K-12, in an elective content area, limited to the grade level authorized by the staff member's teaching credential. EUSD has verified that the staff member on the current list have knowledge and skills in content being taught.  This information is brought forth to the board as an information item only.
