1. NOTICE - COVID-19 PUBLIC HEALTH ORDER: MEETING TO BE HELD VIRTUALLY
Quick Summary / Abstract:
Pursuant to orders given by San Joaquin County Public Health Department and the State of California Public Health Department, all members of the Board of Education as well as the Superintendent and District Staff, will join the meeting via phone/video conference and no teleconference locations need be posted. The district will be using a webinar format (using Zoom) for the Board Members to participate remotely, and to allow for orderly public comment.  There will not be a physical location for this meeting.

Participants who would like to make comments can join the meeting from their computer, tablet or phone. We ask that participants to type their full name when joining the meeting, as prompted.  The board president, will announce the opportunity for public comment on non-agenda items  and for each agenda item. We ask that all participants who wish to make public comments for that item use the “Raise your Hand” functionality. The attendees will be called upon, their microphone unmuted, and then allowed to make their statement for up to three minutes. At the end of three minutes the attendee’s microphone will be muted and the next participant will be called upon.

Quick Summary / Abstract:

Members of the public may address the Board on items not on the agenda. The Board will allow comments by members of the public on an agenda item during consideration of the item. Speakers will be allowed up to three (3) minutes. The Board shall limit the total time for public input on each item to 15 minutes. With Board consent, the Board President may increase or decrease the time allowed for public presentation, depending on the topic and the number of persons wishing to be heard.  It is requested that persons wishing to speak please come forward to the podium and begin by stating their full name. Please be advised that the Brown Act prohibits discussion or action on non-agenda items, and imposes limitations on board members’ responses to public comments. (Government Code section 54954.2(a).) Complaints against specific District employees should be resolved through the District’s Personnel Complaint Procedure. The right to address the Board does not exempt the speaker from any potential liability for defamation. The proceedings of the Board are public record.

15.3. Consider Approval of the 2019-20 CSEA Chapter #345 Public Disclosure

Rationale:

LEAs are required by Government Code Section 3547.5 to publicly disclose the provisions of all collective bargaining agreements before they enter into a written agreement. This provision ensures that the public is aware of the costs associated with a tentative collective bargaining agreement before it becomes binding on the school district or county office of education.

 
Recommended Motion:
Administration recommends the Escalon Unified School District Board of Trustees approve the State mandated "Public Disclosure Statement" of the costs of the 2019-20 agreement reached between Escalon Unified School District and the California School Employees' Association (CSEA) Chapter #345.

15.4. Consider Ratification of the Negotiated Tentative Agreement Between California School Employees Association (CSEA) Chapter #345 and Escalon Unified School District (EUSD) for 2019-2020 Negotiations
Rationale:

Presented is the tentative agreement as negotiated and agreed upon between CSEA Chapter #345 negotiating representatives and the Escalon Unified School District negotiating representatives for 2019-2020 negotiations.

Negotiated changes to contract:

  1. Article II - Organizational Security.    Changes to bring the contract in line with the Janus Decision
  2. Article VI - Hours and Overtime.     Allows employees who work more than five hours per day to request to work through their lunch period.
  3. Article VII - Pay and Allowances.  A 4.5% increase to the salary schedule retroactive to July 1, 2019.
  4. Article XII - Leaves.  Extended illness leave changed from differential pay to 50% of the employee's regular salary.
  5. Article XVI - Layoff and Reemployment.  Change to a 60 day layoff notice period to come in line with state law. 
  6. Article XXI - Negotiations.  Both parties agree to schedule and hold 4 negotiation sessions before the end of January.
  7. Article XXII - Evaluation Process. To come into line with AB 1353, probationary period should be a period of six months or 130 days of paid service, whichever is longer. 
  8. Article IXXX - Duration.  Term of the contract is July 1, 2019 through June 30, 2022. For 20-21, Pay and Allowances, Health and Welfare Benefits and 1 additional article may be opened. For 21-22, Pay and Allowances, Health and Welfare Benefits and 2 additional articles may be opened.

15.5. Consider Approval of a Specially Designated Academic Instruction Delivered in English (SDAIE) Emergency Permit for CTE Teachers

Rationale:
The California Commision on Teaching Credentialing requires that all CTE teachers have the SDAIE requirement met while clearing their preliminary credential. Seth Davis will clear his credential the 2020-2021 school year while Susan Davis will clear her credential the 2021-2022 school year. Once their credentials are cleared, they will meet the SDAIE requirement. In the meantime, EUSD must apply for a SDAIE emergency waiver for Seth Davis and Susan Davis' behalf so that EUSD remains compliant with the CTC requirement for the 2020-2021 school year.

 
Recommended Motion:

15.6. Consider Approval to Enter Into a Contract with Cal Coating Asphalt, Inc. to Replace 43,811 Square Feet of Asphalt Courts at El Portal.

Project includes removing and replacing approximately 43,000 square feet of asphalt play courts. Price includes restriping basketball and volleyball courts. 

EUSD received 3 estimates ranging from $98,974.00 to $132,304.00. Cal Coating Inc. was the low bidder at $98,974.00.

The Administration Recommends the Escalon Unified School District Board of Trustees Approve Entering Into a Contract With Cal Coating Asphalt, Inc. to Replace  Asphalt Courts at El Portal.

15.7. Consider Approval to Enter Into a Contract with Advanced Roofing to Replace the Gym Roof at El Portal.

Project includes: 

Prepare existing roof system for re-cover:  Remove and dispose of existing parapet, mechanical platform, skylight, drain and pipe flashings.  

Furnish and install 1 layer ½” high Density polyiso cover board and mechanically attach to Manufacturer published details.

Furnish and install a new 80 mil PVC KEE roof system. 

Furnish and install new fully adhered parapet, mechanical platform and skylight flashings in same membrane.

Furnish and install 360 linear feet of Manufacturer walking surface. 

Using PVC and PVC accessories flash all roof top penetration to Manufacturer details.

Reinstall/Reseal existing cap metal for a weather tight application.

Manufacturer 30 year NDL warranty. 

EUSD received 3 estimates ranging from $117,229.00 to $121,405.00. Advanced Roofing was the lowest estimate at $117,229.00.

15.8. Consider Approval of Escalon Unified School District's Facilities Assessment and Implementation Plan
Rationale:
The district has been working with CFW since last summer to develop a comprehensive Facilities Assessment and Implementation Plan.  The plan is finalized and being brought before the board for their approval.  This plan seeks to integrate the district's vision for its educational program and provide a funding and facilities sequencing plan to guide facility improvements throughout the district.  
 
Recommended Motion:
The Administration Recommends the Escalon Unified School District Board of Trustees Approve the Escalon Unified School District's Facilities Assessment and Implementation Plan.
