SB 98 (Chapter 82/89) and AB 198 (Chapter 93/89) require K-12 school districts and county offices of education to calculate their appropriation Gann Limits and the State aid subject to those limits. The methodology involves a calculation of the preceding year’s Gann Limit, followed by the calculation of the budget year’s Gann Limit. Any increase to the appropriations limit is permanent and is reported to the State Department of Finance. Adoption of the attached resolution establishes the actual Gann Appropriations Limit at $153,321,759.88 for 2019-2020 and establishes the estimated appropriations limit at $161,044,573.86 for 2020-2021. Also, include an increase of $621,731.63 to the 2019-2020 Gann Limit pursuant to the provisions of Government Code Section 7902.1. Board Policy 6200, Authorization to Transfer, allows students, ages 16-18, enrolled in a continuation school or a comprehensive high school and not making satisfactory progress toward a high school diploma, to be transferred to the Adult School program. Written permission from the student's parent or guardian is required as well as a review and approval by a hearing panel that includes representatives from a comprehensive high school, a continuation school program, the Adult education program, the Student Services Department and the student's school Assistant Principal. All student transfers under this policy must be approved by the Board of Trustees. Board approval is required for five (5) students to transfer to the Adult School based upon Board Policy 6200. |

The Administrative Appeals Committee reviewed one (1) inter-district transfer student appeal identified as number IDT 20/21 - 127. The Committee is recommending denial of the one (1) inter-district transfer appeal. The Committee reviewed that request and found no compelling reason to grant the transfer. |

We are seeking Board approval for the appointment of Claire Gagas to be the SMUHSD representative on the SELPA Community Advisory Committee-Resource Parent Council (CAC-RPC). The CAC-RPC is a team of parents representing school districts, along with school district and community personnel, that provides input to the SELPA on the development and implementation of the Local Plan for Special Education and other important topics. Additionally, the group provides information, guidance, training and general support for families whose students receive special education services. We are excited that Ms. Gagas is interested in serving in this role, as it has been many years since SMUHSD has had a parent representative on the CAC-RPC. |

San Mateo Union High School District aims to provide high quality instructional services and support to incoming/current high school students to improve the use and analysis of analytics with the ultimate goal of improving the educational and career/trade outcomes of all students in, and particularly for traditionally underserved students. To achieve this goal, SMUHSD shall coordinate with its Partner School Districts regarding data exchanges, integrations, governance, reporting, and analysis of staff and pupil records, which include any information related to staff or students maintained by Partner School District or by an authorized third party on behalf of Partner School District, hereafter referred to as "Data". Services rendered under this MOU shall be referred to as “Incoming 9th Grade Articulation Data” or “Data”. On January 17. 2019, the Board approved a contract with Fagen Friedman & Fulfrost LLP to provide legal services as requested by the San Mateo Union High School District for the Special Education services. The attached agreement renews that contract with some increases in hourly rates. The per hour cost increases are:
Associate from $215-$245 to $230-$260 Partner from $275-$310 to $290- $325 Of-Counsel from $310 to $325 Paralegal/Law Clerk from $135-$165 to $150 - $210 Paralegal/Law Clerk (Bar Admitted Outside CA from $205 to $230 Education Consultant$185 to $240 Communication Services Consultant-$245 to $260 These new rates are in line with legal services contracts with other private law firms with which the district is engaged.

In place of the LCAP, the district must develop a Learning Continuity and Attendance Plan to articulate our response to the COVID pandemic. The plan is a streamlined version of the LCAP and is intended to provide an opportunity for stakeholder engagement. The plan includes the following main components that the district must prepare a narrative on: stakeholder engagement, in-Person instructional offerings, access to devices & connectivity, student (“pupil”) participation & progress, distance learning professional development, continuity of learning, addressing learning loss, mental health & social emotional well-being, and school nutrition. Through the return to school presentations and planning, the district has responded to each of these areas and the Learning Continuity and Attendance Plan template will memorize this work. The presentation tonight will be the first of two presentations to the Board of Trustees. District Staff will seek input through a public hearing on September 10th and then approval of the plan on September 24th Board meetings. |

Education Code 44263 allows credentialed teachers to teach in a subject area in which they have completed nine (9) units of upper division or graduate courses or eighteen (18) total units. this authorization is granted with the approval of the Board of Trustees. Attached is a resolution listing staff member(s) who are in the above situation and who can legally teach in the designated subject area for the 2020-21 school year. |

The District requests the Board of Trustees to approve a waiver for Dominic Bigue, new Assistant Principal I at Burlingame High School for the 2020-2021 school year. Due to a missed application, Dominic Bigue was unable to obtain his preliminary administrative services credential by 7/1/2020. This waiver is requested to allow Mr. Bigue to remain as an administrator through the end of the school year. He is currently enrolled in a program to obtain his credential and is on track to have it issued by November of 2021. |

The San Mateo Union High School District's Non-Represented Administrators and Classified Management 2020-2021 Salary Schedule will be presented at the Board Meeting of September 10, 2020. This hearing is provided for the public to express itself regarding the salary schedule. Education agencies are required to publicly disclose the provisions of all salary schedules. This requirement ensures that the public is aware of the costs associated with the salary schedule before it becomes binding on the District or County Office of Education. The legislation also requires that the State Superintendent of Public Instruction (SSPI) establish a format for the purpose of satisfying this public disclosure requirement. Government Code §3547.5 states: "Before a public employer enters into written agreement with an exclusive representative covering matters within the scope of representation, the major provisions of the agreement, including, but not limited to, the costs that would be incurred by the public school employer under the agreement for the current and subsequent fiscal years, shall be disclosed at a public meeting of the public school employer in a format established for this purpose by the State Superintendent of Public Instruction." The District's Board of Trustees shall hold a public hearing and shall make a determination, through a resolution, as to whether each pupil in each school in the District has or will have sufficient instructional materials in each subject that aligned to the academic content standards and are consistent with the content and cycles of curriculum frameworks adopted by the State Board of Education.
If the District's Board of Trustees determines that there are insufficient instructional materials, the Board of Trustees shall provide information to classroom teachers and the public, as to the reasons and shall take any action to ensure that the situation is remedied when two (2) years from the date of the determination. The Board of Trustees shall certify that, as of this date, each pupil in the District, in grades 9 through 12, has been provided with a standards-aligned textbook or basic instructional materials in each of the following areas: History/Social Science, Mathematics, Reading/Language Arts, and Science and that the instructional materials were adopted by the Board of Trustees following the District's review of the materials and their alignment with state content standards as required by CCR, Title 5, Section 9531. The District's Board of Trustees shall ensure that funds received from the Instructional Materials Funding Realignment Program shall be used to comply with the preceding provisions and shall augment any state and local funds expended on instructional materials. Accept the Unaudited Actuals for the 2019-2020 fiscal year and budget component designations for the 2020-2021 fiscal year, as contained in the attachment. |
California Education Code 42100 requires that the governing board of each school district approve the annual unaudited financial statement of all receipts and expenditures of the district for the preceding fiscal year. Furthermore, the annual financial statements must be filed with the County Superintendent of Schools and the State Department of Education. The unaudited financial statements are prepared after the close of the fiscal year that ends on June 30. All goods and services received as of that date are considered business of that fiscal year. All revenues earned as of that date are considered business of that fiscal year. Various payables and receivables are posted in the closing process as well. The ending balance of the preceding year becomes the beginning balance for the current fiscal year. School districts are required to have a Reserve for Economic Uncertainty. Best practices recommended to basic aid school districts is to have a Reserve for Economic Uncertainty equal to the amount above the State Revenue Limit apportionment the District receives from property taxes, or by 12 percent. Being a Basic Aid District, it is critical the administration continue to manage the educational budget in a prudent, responsible manner as the State’s financial situation remains unstable. The District’s independent auditors are scheduled to finalize their audit of the unaudited financial statements. The audit of the District’s financial statement will be completed by December 10, 2020. Presentation materials will be added to the full report when they are available. |

These Board policies and administrative regulations will, upon the direction of the Board, be considered for approval at the Board's September 24th meeting: -BP 5141.5 - Mental Health - New policy address strategies and service to promote students' emotional well-being and mental health, including student instruction, staff training, crisis intervention, counseling services and referrals, Section 504 evaluation, and collaboration with mental health professionals, agencies, and organizations.
-BP 5145.3 - Nondiscrimination/Harassment - Updated to prohibit discrimination based on medical condition and to reflect NEW LAW (AB 34, 2019) which requires the District, starting in the 2020-21 school year, to post its nondiscrimination policies, and specified state and federal laws regarding discrimination, bullying, and harassment, in a prominent location on the District's web site in a manner that is easily accessible to parents/guardians and students.
