Rationale:

Public Contract Code Section 20118 allows school districts to, "authorize by contract, lease, requisition, or purchase order, any public corporation or agency, including any county, city, town, or district to lease data-processing equipment, purchase materials, supplies, equipment, automotive vehicles, tractors and other personal property for the District in the manner in which the public corporation is authorized by law to make the leases or purchases" if the board of that school district "has determined it to be in the best interests of the district" to acquire the items through piggyback provision.

The District has used and is a member of NJPA (now renamed Source Well) in the past to purchase classroom furniture.

The District recommends approving the contract in the amount of $116,315.02 with Palace Business Solutions for the furniture for 5 new classrooms at Foster City New School.

 
Recommended Motion:

IT IS RECOMMENDED THAT THE BOARD OF TRUSTEES APPROVE THE FURNITURE CONTRACT FROM PALACE BUSINESS SOLUTIONS REGARDING FURNITURE PURCHASE FOR THE NEW ELEMENTARY SCHOOL IN FOSTER CITY  INTERIM HOUSING LOCATED AT FOSTER CITY ELEMENTARY SCHOOL.

Rationale:

Per Board Policy 3312, the Board may, by a majority vote, delegate to the Superintendent or designee the authority to enter into contracts on behalf of the District.  To be valid or to constitute an enforceable obligation against the District, all such contracts must be approved and/or ratified by the Board.  Contracts are available for review upon request in the Business Services department.

 
Recommended Motion:

Rationale:

Board Policy 3314 states the following: It shall be the practice of the administration to present the Board of Trustees with copies of all warrant registers for information and review at each regularly scheduled meeting of the Board of Trustees. As Policies 3100 (budget) and 3110 (transfer of funds) provide criteria for Board authorization of all expenditures, both personnel and non-personnel items, prior to the actual payment of the obligation, warrants will be distributed to the vendors and employees after audit by the County Superintendent of Schools.

Education Code Sections 42631-36 requires the Board of Trustees approve all expenditures made by the District.


 
Recommended Motion:

IT IS RECOMMENDED THAT THE BOARD OF TRUSTEES APPROVE THE ATTACHED DISTRICT EXPENDITURES.

Financial Impact:
Funds have been provided for the goods and services paid by these warrants through the budgetary process. There is no impact on the various funds of the District beyond what has been budgeted.

6.2.3. Crossing Guard Agreement - City of Foster City Was edited within 72 hours of the Meeting
Rationale:

Through a joint effort, the City of Foster City and the District wish to continue to allow safe travel to school for students in Foster City by placing crossing guards at specific locations in Foster City.  The Foster City Council recently passed a resolution that allows the District to hire crossing guards as well as substitute crossing guards, as needed.  The crossing guards will be employed during the hours the students are walking to and from school during the school year.  The City of Foster City will reimburse the district up to a maximum of $21,600 for wages, benefits and administrative costs.   

 
Recommended Motion:

Rationale:

Recommended Motion:

7. SUPERINTENDENT SERVICES/BOARD
7.1. Name for the New School in Foster City (v)
Rationale:

After reviewing with the Board of Trustees the process for naming the new
elementary school in Foster City, the administration initiated the process in late January
with an invitation to the San Mateo-Foster City School District community—staff,
parents and students—and members of the Foster City community at large to submit
suggested names for the new school. Included in the invitation was the District’s policy
for naming schools which states generally that elementary schools are to be named for
geographical areas and middle schools for prominent deceased persons.  Seventy-eight nominations supported in many instances by rationales were submitted by the late February deadline.

Due to COVID-19, the Committee to recommend 2-3 names for the school was not formed until May and met virtually on May 20. Prior to the meeting, all Committee members were invited to choose five of the names which were submitted which each member felt were the best names for the school. Their submissions reduced the list of names to be considered by the Committee in its virtual meeting to 23 unduplicated names. The Committee worked through a process facilitated by Tish Busselle to reach its recommendation of two names for the new school. The process included large and small group discussions and recommendations and concluded with a weighted choice system for determining which two or three names would be recommended to the Board of Trustees for consideration.

The Committee has chosen two names to recommend to the Board of Trustees—Beach
Park Elementary School and Shell Elementary School. These names were the clear
favorites of the Committee as a whole and individual members. Both names conform to
the District policy—they are the names of the two streets which are adjacent to the new
school property.

The administration would like to thank all those who submitted names for consideration
as well as the Committee members who worked together virtually to determine the
names to recommend to the Board of Trustees. The Committee members were:

7.2. San Mateo-Foster City School District Response to COVID-19 Shelter-in-Place, Distance Learning Phase II, Summer School and Fall Reopening
Rationale:

Staff will provide an update on District on Distance Learning Phase II, Summer School, and Fall Reopening.  



 
Recommended Motion:

IT IS RECOMMENDED THAT THE BOARD OF TRUSTEES RECEIVE INFORMATION ON DISTRICT LEARNING RELATED TO COVID-19, SUMMER SCHOOL, AND FALL PLANNING.

Rationale:

Staff will present to the Board an update on the District English Learner Advisory Council (DELAC), the District Advisory Council (DAC), and the Sanctuary Task Force.

8.2. COVID-19 Written Operations Report
Rationale:

Executive Order N-56-20 requires that all LEAs complete a written report to explain the changes to program offerings that the LEA has made in response to school closures to address the COVID-19 emergency, the major impacts of such closures on students and families, and a description of how the LEA is meeting the needs of its unduplicated students. 

Staff will present information on the COVID-19 Operations Written Report and the Board will take action to approve this report on June 18, 2020 at the regular Board Meeting.

9.4. 2020-2021 Budget Adoption - Draft
Rationale:

Pursuant to Education Codes 33219 and 42127, the governing board of each school district shall adopt a budget on or before July 1 of each year, using the State-adopted Criteria and Standards and in the format prescribed by the State Superintendent of Public Instruction.

The District is required to conduct a public hearing for the Budget at the first regularly scheduled board meeting in June, and to present the LCAP and the Budget to the Board of Trustees for adoption at a subsequent regularly scheduled board meeting.  The budget must be adopted prior to June 30 and will be brought to the Board for approval on June 18, 2020. This year, in response to Covid-19, the district is required to submit a report that explains the changes to program offerings that have been made in response to school closures to address the COVID-19 emergency and the major impacts of the closures on students and families. The Board must adopt the report at the same meeting the annual budget is adopted. 

This action is consistent with the Budget Calendar previously adopted by the Board.  Following board adoption of the budget, the budget is filed with the County Superintendent of Schools for review prior to being submitted to the state.

The proposed budget is available for inspection at the District Office.

10. HUMAN RESOURCES
10.1. Variable Term Waiver (v)
Rationale:

All requests for a variable term waiver must be presented for approval to the governing board of a public school district.  The following teacher meets the criteria and is authorized to apply for a subsequent Variable Term Waiver to complete his assignment for the 2020-2021 school year in the San Mateo-Foster City School District.

Ed Code §44252(b) allows Maurice Stewart to complete the Basic Skills requirement that is needed in order to be recommended for a Preliminary Single Subject, Physical Education credential by San Francisco State University. Mr. Stewart meets the requirements of applying for a subsequent waiver for the Basic Skills requirement. 

Ed Code §44065 allows Maurice Stewart to perform his duties as a 1.0 FTE Physical Education teacher for the 2020-2021 school year while he completes requirements for the Single Subject, Physical Education credential.  Once Mr. Stewart completes the requirements by June 2020, he will be recommended for a Preliminary Single Subject, Physical Education credential by San Francisco State University.

 
Recommended Motion:

IT IS RECOMMENDED THAT THE BOARD OF TRUSTEES APPROVE AUTHORIZATION USING DEFINED EDUCATION CODE FOR MAURICE STEWART.

10.2. AB 1200 Public Disclosure of Collective Bargaining Unit Agreement (CSEA)
Rationale:

On April 30, 2020 the San Mateo-Foster City School District (SMFCSD) and California School Employees Association (CSEA) Chapter 411 reached tentative agreement and completed reopener negotiations for 2020-2021.

Assembly Bill (AB) 1200 requires local education agencies to publicly disclose costs related to provisions of all collective bargaining agreements prior to entering into a written agreement. Attached for information to the Board are copies of the disclosure forms for employees in the CSEA unit which summarizes the financial implications of the major provisions of the agreement.

 
Recommended Motion:

IT IS RECOMMENDED THAT THE BOARD OF TRUSTEES RECEIVE THE AB 1200 PUBLIC DISCLOSURE DOCUMENTS FOR INFORMATION AS PRESENTED.

Financial Impact:

The agreement has a financial impact on SMFCSD as there is an ongoing cost beginning with the 2020-2021 year.  The costs include $517,650 for 2020-2021; $526,011 for 2021-2022 and $530,227 for 2022-2023.

Rationale:

On April 30, 2020 the California School Employees Association (CSEA) Chapter 411 and the San Mateo-Foster City School District (SMFCSD) reached a tentative agreement and completed reopener negotiations for 2020-2021. The modifications are summarized as follows and includes:

  •  Article 21- Pay and Allowances
  • 3% increase to the 2019-2020 salary schedule effective July 1, 2020 


 
Recommended Motion:

IT IS RECOMMENDED THAT THE BOARD OF TRUSTEES APPROVE THE TENTATIVE AGREEMENT AND ASSOCIATED SALARY SCHEDULES BETWEEN THE SAN MATEO-FOSTER CITY SCHOOL DISTRICT (SMFCSD) AND CHAPTER 411 OF THE CALIFORNIA SCHOOL EMPLOYEES ASSOCIATION (CSEA) AS NEGOTIATED.
