5.1.1. Tobacco-Use Prevention Education Grant
Rationale:

Through numerous discussions with families and school administration, the San Mateo-Foster City School District identified several needs that were not being addressed by our current Tobacco Use Education Program (TUPE) grant. This grant application targets two areas of need: 1) parent support, and 2) safe, on-site disposal of confiscated tobacco based electronic devices. 

During the 2019-20 school year-August through March, there were over 60 incidents of students vaping on campuses across our four comprehensive middle schools. As part of our intervention program, District staff offered students an alternative to suspension program. At this time, parents also expressed a need for both English and Spanish resources to help them with their child's use of tobacco products. From this data, the grant proposes to start a weekly, parent/student helpline (in English and Spanish) where parents can seek help. Students can also call in to speak to our Teacher on Special Assignment (translation for Spanish speaking students and families will be available) for help with prevention and intervention options. 

Our second area of need is to provide schools a safe and consistent method for storage and disposal of confiscated tobacco devices that students bring to school. Currently we do not have such a process nor storage containers, and rely on police department support to dispose of these items.

 
Recommended Motion:

IT IS RECOMMENDED THAT THE BOARD OF TRUSTEES RATIFY THE SUBMISSION OF THE TOBACCO GRANT APPLICATION  IN THE AMOUNT OF $ 4,565.00.

5.1.2. Non-Public School Placements
Rationale:

The District provides services for individual Special Education students according to commitments made in the student's Individual Education Plan (IEP).  When appropriate services are not able to be provided through District Programs, the District contracts with a Non-Public School (NPS) or Non-Public Agency (NPA) for those services.  Listed contracts are for the 2020-2021 school year (see attached) for 21 students.

 
Recommended Motion:

IT IS RECOMMENDED THAT THE BOARD OF TRUSTEES APPROVE THE NON-PUBLIC SCHOOL (NPS) CONTRACTS IN THE AMOUNT OF $2,224,767.00.

5.1.3. Elementary Music Program TK-4th Grade
Rationale:

The San Mateo-Foster City School District has obtained the services of Music for Minors, Inc. (MFM) to provide music education to TK-4th grade students.  The Music for Minors Program is offered at all District elementary schools except Meadow Heights, which provides a different music program.

For the 2020-2021 school year, MFM will deliver music classes synchronously and asynchronously via an online video meeting platform to students until in-person instruction can resume.

Rationale:
The District is entering into a contract with CDW to provide Zoom video-conferencing licenses for teachers, site and central leaders.  Staff seeks Board ratification of that contract in the amount of $40,650.00

5.2. BUSINESS/FINANCE
5.2.1. Baywood Elementary School - Artifical Turf Installation - Bay Area Scores
Rationale:

As one of only three school sites that does not have any green lawn or turf on their play yard for kids to play on, the school community at Baywood has raised funds to have a small area of the play yard, approximately 1200 SF, have artificial turf.  

Three bids were solicited for the artificial turf installation and the contractor that submitted the lowest bid is Bay Area Scores.   

 
Recommended Motion:
IT IS RECOMMENDED THAT THE BOARD OF TRUSTEES RATIFY THE CONTRACT WITH BAY AREA SCORES FOR THE ARTIFICIAL TURF INSTALLATION AT BAYWOOD ELEMENTARY SCHOOL.

5.2.2. Bayside Middle School New Gymnasium Project – Rodan Builders Change Order No. 006
Rationale:

On September 25, 2019, the San Mateo Foster City School District issued a contract to Rodan Builders for the New Gymnasium Project at Bayside Middle School. The approved original contract amount was for $9,896,000.00.

The cost of this Change Order No.006 is in the amount of $76,049.00 which is 0.77% of the original contract amount. To date, the cost of Change Orders 1-6 is $280,817.00, which is 2.84% of the original contract amount.

The new contract amount for Rodan Builders, Inc. is for $10,176,817.00, which is within the Measure X Original Budget.

5.2.3. Bayside Academy New Gym - Notice of Completion- Rodan Builders, Inc.
Rationale:
Pursuant to the contracts awarded by the Board of Trustees on April 18, 2019, Rodan Builders Inc. has furnished all materials and finished all labor for the completion of the work related to the Bayside New Gymnasium Project #16-121. With approval of the Board of Trustees, the attached Notice of Completion will be filed with the San Mateo County Recorder's Office as required by law.
 
Recommended Motion:
THE ADMINISTRATION RECOMMENDS THAT THE BOARD OF TRUSTEES APPROVE THE NOTICE OF COMPLETION FOR THE BAYSIDE NEW GYMNASIUM PROJECT.

5.2.4. District Wide Shade Structures Project- Aedis Architects- Amendment #3
Rationale:

On June 20, 2019, the Board of Trustees approved the Aedis Architects Amendment #2, which consisted of Add Service Agreement #2 for increased scope of work for additional structures at other sites beyond those initially proposed.

The District, working with Aedis Architects, requested additional architectural services for the shade structure at Abbott Middle School to bring it up to the 2019 building code. This comprises Add Service Agreement #3, which is included in Amendment #3.

The cost of Add Services #1 and #2 was $132,844.00 which was approved by the Board. The cost of Add Services #3 is $15,728.00, which is included in Amendment #3 to Aedis contract. the new contract amount for Aedis with Amendment #3 is $297,477.00.

 
Recommended Motion:
IT IS RECOMMENDED THE BOARD OF TRUSTEES APPROVE AMENDMENT NO.3 FOR AEDIS ARCHITECTS REGARDING THE ADDED SCOPE TO THE DISTRICT WIDE SHADE STRUCTURES PROJECT.

5.2.5. Purchase of Additional Chromebooks to Support Distance Learning/Hybrid Instruction
Rationale:
The District is recommending the purchase of additional Chromebooks to add to the District's fleet of devices in order to support Distance Learning and Hybrid instruction. 
 
Recommended Motion:
IT IS RECOMMENDED THAT THE BOARD OF TRUSTEES APPROVE THE PURCHASE OF ADDITIONAL CHROMEBOOK DEVICES TO SUPPORT DISTANCE LEARNING/HYBRID INSTRUCTION.

Rationale:

Per Board Policy 3312, the Board may, by a majority vote, delegate to the Superintendent or designee the authority to enter into contracts on behalf of the District.  To be valid or to constitute an enforceable obligation against the District, all such contracts must be approved and/or ratified by the Board.  Contracts are available for review upon request in the Business Services department.

5.2.7. Listing of Payments to Meet District Expenditures
Rationale:

Board Policy 3314 states the following: It shall be the practice of the administration to present the Board of Trustees with copies of all warrant registers for information and review at each regularly scheduled meeting of the Board of Trustees. As Policies 3100 (budget) and 3110 (transfer of funds) provide criteria for Board authorization of all expenditures, both personnel and non-personnel items, prior to the actual payment of the obligation, warrants will be distributed to the vendors and employees after audit by the County Superintendent of Schools.

Education Code Sections 42631-36 requires the Board of Trustees approve all expenditures made by the District.


 
Recommended Motion:

IT IS RECOMMENDED THAT THE BOARD OF TRUSTEES APPROVE THE ATTACHED DISTRICT EXPENDITURES.

Financial Impact:
Funds have been provided for the goods and services paid by these warrants through the budgetary process. There is no impact on the various funds of the District beyond what has been budgeted.

Rationale:
The Superintendent has been granted authority by the Board to accept the resignation, release and/or retirement requests from District employment. The Human Resources Department has received and processed all necessary documents for personnel actions according to the California Education Code.

6.1. Public Hearing: Proposed Increase to Developer Fees as Authorized by Education Code 17620
Rationale:

Background

In September, 1986, the Governor signed into law Assembly Bill 2926, which granted school district governing boards the authority to impose developer fees.  This authority is codified in Ed Code 17620, which states in part, “…the governing board of any school district is authorized to levy a fee, charge, dedication or other form of requirement against any development project for the construction or modernization of school facilities provided the District can show justification for levying of fees.”

Discussion

Level I Developer Fees are adjusted for inflation by the State Allocation Board every two years (even years).  In January 2020, the State Allocation Board’s biennial inflation adjustment changed the fee to $4.08 per square foot for residential construction and $0.66 per square foot for commercial/industrial construction.  The District’s current developer fee rate is $2.27/square foot for residential construction and $0.37/square foot for commercial/industrial construction.  The San Mateo-Foster City School District shares fees with the San Mateo Union High School District.  The High School District may receive 40% of the fee while the San Mateo-Foster City School District may receive 60% of the fee.  If one of the participating districts does not collect their full percentage, the other District may collect up to their justifiable amount, not to exceed $4.08 for residential construction and $0.66 for commercial/industrial construction. 

Based on the District’s August 6, 2020 Developer Fee Justification Study, the District is justified to increase fees.  If approved, the fee increase will take effect 60 days after the adoption date.

6.3. Measure X Update
Rationale:
At the Board of Trustees' meeting on August 20, there will be a presentation on Measure X.  The presentation will include the status of the Phase I projects which have been under construction since last year and the Phase II projects which are in the planning phase now.  Budget information will be included as part of the presentation.
 
Recommended Motion:
 IT IS RECOMMENDED THAT THE BOARD OF TRUSTEES RECEIVE FOR INFORMATION THE MEASURE X UPDATE.

7. HUMAN RESOURCES
7.1. Variable Term Waiver (v)
Rationale:
The Variable Term Waiver request is made when a fully credentialed teacher is unavailable for a teaching position.  The Commission on Teacher Credentialing authorizes the issuance of a Variable Term Waiver to an employee who meets the minimum requirements and needs additional time to complete all necessary requirements for the appropriate credential or certification which authorizes service in an assigned position.  

All requests for a variable term waiver must be presented for approval to the governing board of a public school district.  The following teachers meet the criteria and are authorized to apply for a Variable Term Waiver to complete their assignments for the 2020-2021 school year in the San Mateo-Foster City School District.

Ed Code §44253.3 allows Chiu Chien to perform her duties as a 1 FTE Mandarin Immersion teacher for the 2020-2021 school year while she completes requirements for the Bilingual, Crosscultural, Language & Academic Development- Mandarin authorization. Once Ms. Chiu completes the requirements by June 2021, she will add the authorization to her existing Multiple Subject credential.  

 
Recommended Motion:

IT IS RECOMMENDED THAT THE BOARD OF TRUSTEES APPROVE AUTHORIZATION USING DEFINED EDUCATION CODE FOR CHIU CHIEN.

7.2. Informed K-12 Contract for 2020-2021 (v)
Rationale:

The District seeks to contract with Informed K-12, an outside vendor, to digitize forms and implement electronic work flows.  Electronic processes will create efficiencies and allow for a more environmentally friendly way to provide services throughout the District.  This is an essential service that the District requires especially now that staff are working remotely during the COVID-19 pandemic. The contract is from July 1, 2020 through June 20, 2021. 

 
Recommended Motion:

 IT IS RECOMMENDED THAT THE BOARD OF TRUSTEES APPROVE THE CONTRACT WITH INFORMED K-12 TO DIGITIZE FORMS AND IMPLEMENT WORK FLOWS FOR THE DISTRICT. 

Financial Impact:
