The Office of Administrative Law approved emergency regulations on November 1, 2012 that impacted how the Office of Public School Construction (OPSC) processed applications received when existing bond authority is no longer available for New Construction and Modernization applications. These regulations established a State Allocation Board (SAB) acknowledged list for projects that are received by OPSC after bond authority is exhausted. The list is called the “Applications Received Beyond Bond Authority List." Applications placed on this list only undergo an intake review to ensure all of the required documents have been submitted, but are not be fully processed by OPSC nor presented to SAB for approval. San Mateo-Foster City School District is ready to submit three schools (College Park Elementary School, Fiesta Gardens Elementary School and Foster City Elementary School) that have state funding eligibility that will be placed on the Applications Received Beyond Bond Authority List. This resolution is for the Board of Trustees of the San Mateo-Foster City School District to accept and acknowledge that funding applications submitted under the School Facility Program that State Funding applications are not guaranteed funding once they are approved by the SAB.

The District currently utilizes Key Analytics software, which is in the process of being terminated. Colbi's Account-Ability was chosen because of the project management components that they offer. This contract is for a three year subscription to Account-Ability, a web-delivered software that provides multi-year, multi-fund capital program management in alignment with the District’s financial system. The District is authorized by Section 53060 of the California Government Code to contract with and employ any persons for the furnishing of special services and advice in financial, economic, accounting, engineering, legal or administrative matters, if those persons are specially trained and experienced and competent to perform the special services required. |

Board Policy 3314 states the following: It shall be the practice of the administration to present the Board of Trustees with copies of all warrant registers for information and review at each regularly scheduled meeting of the Board of Trustees. As Policies 3100 (budget) and 3110 (transfer of funds) provide criteria for Board authorization of all expenditures, both personnel and non-personnel items, prior to the actual payment of the obligation, warrants will be distributed to the vendors and employees after audit by the County Superintendent of Schools. Education Code Sections 42631-36 requires the Board of Trustees approve all expenditures made by the District.

This is the third public hearing to consider draft map options of trustee areas prepared by the District's demographer, National Demographics, Inc. There is a total of twelve (12) draft maps for consideration: they are Maps 201, 202, 203, 204, 205, 206, 207, 208, 209, 701, 702; 703. The purpose of this public hearing is to receive further public testimony and input regarding the contents of the draft maps before the Board takes action on selecting a map and proceeding to the next agenda item, Resolution No. 04/21-22: Establishing and Implementing Trustee Area District Elections for Board Members Pursuant to Elections Code Section 10010. |

On June 10, 2021, the San Mateo-Foster City School District's Governing Board voted to adopt a resolution to initiate the process for the District to transition from an at-large election system to a By Trustee Area election system commencing with the November 2022 Board elections. In adopting the resolution, the Board was concerned about exposure to litigation under the California Voting Rights Act, particularly taking into consideration the broad language of the CVRA and the fact that the CVRA grants a prevailing plaintiff the right to recover reasonable attorneys; fees and expert witness fees. The process included compiling information and data to develop draft map options and presentation of the draft map options to the Governing Board and the public in three separate public hearings. As part of the process to transition to a By-Trustee Area election system, the Board will need to adopt a final trustee area map for implementing the new trustee areas. In advance of adopting a final map, the District was required to, and did, seek public input on the content of the proposed trustee area maps. The presentation and consideration of the proposed trustee area maps during a public hearing is an important part of the transition to a By-Trustee Area election system so that comments and input can be received from the public.
Prior to the release of draft map options, the District held public hearings on June 22, 2021, and June 29, 2021, to solicit feedback in advance of map preparation by the District's demographer. Following the release of draft map options, the District previously held public hearings at Special and Regular Governing Board meetings on August 6, 2021, August 16, 2021, and today, August 26, 2021. The Board of Education must authorize District staff to transmit this resolution, the final trustee area map adopted, and any additional required documentation to the County Committee on School District Organization and take any other necessary action to effectuate the purposes of this resolution to complete the District's transition to a By-Trustee Area election system for the November 2022 Governing Board elections.

Due to the COVID pandemic, the state of California now requires that all CA school districts offer a long-term independent studies option for 2021-22 school year. After this year, offering independent study again becomes optional for CA school districts. Following these directives, the San Mateo Foster City School District will offer a long-term independent studies option for this 2021-22 school year only. Assembly Bill 130, signed by Governor Newsom on July 9, 2021, and requires all districts, for the 2021-22 school year, to offer independent study to meet the educational needs of students unless a waiver is obtained and to adopt policy with specified components in order to generate apportionment for independent study. This revised policy updates the minimum period of time permitted for independent study to be three consecutive school days, requires an evaluation to determine if the student should continue in independent study if the student fails to make satisfactory educational progress, and requires that content be aligned to grade level standards. The updated policy also includes the requirement for live interaction and/or synchronous instruction based on grade level, tiered reengagement strategies for students not generating attendance for a specified period of time, expeditious transition for students whose families wish to return to in-person instruction, notice to parents/guardians for specific information, the provision of a student-parent-educator conference, upon request, prior to enrollment and/or disenrollment, and the keeping of additional records, including documentation of each student’s participation in live interaction and synchronous instruction on each school day, as applicable. The policy includes the requirement of a written agreement that must include a detailed statement of academic and other supports that will be provided to address the needs of particular students, that the agreement may be signed electronically as specified, and that, for the 2021-22 school year, the written agreement must be signed not later than 30 days after the first day of instruction. Policy is also updated to include material formerly in the AR regarding course-based independent study and to generally align the requirements of course-based independent study with the requirements for general independent study. |

In order to provide pooled COVID-19 testing for our students and staff, the District is recommending the Board approve the attached participation agreement with the California Department of Public Health. The California Department of Public Health is contracting with approved pooled testing companies that will provide operational support. The CDPH has conveyed to the District that the contracted company assigned to SMFCSD is Concentric, Labs by Ginko. |
