3.A. Consideration to approve an Agreement for Consulting Services with School Facility Consultants to prepare a School Facility Fee Justification Report
Quick Summary / Abstract:
In order for a school district to receive the maximum amount for developer fees provided for under California law, it needs a justification for this rate through an up-to-date developer fee study.  It has been at least five years since a study was conducted in this district and as such it is not receiving the current allowable rate.  Most school districts conduct justification studies for developer fees in conjunction with the latest State of California maximum adopted allowable rate, which will be updated again in January 2020.  Given the many new residential and commercial projects that will be coming to this community and the fact that developer fees are assessed to mitigate the impact of development on a school district, there is a strong rationale to move ahead with a new study.  Once the study is complete and the Board adopts a supporting resolution,  the new rate will be forwarded to the Sequoia Union High School District, which collects developer fees on behalf of itself and its eight elementary feeder districts.  Currently the combined maximum allowable rate (K-12) is $3.79 per square foot.  Since elementary districts serve nine grade levels and high school districts serve four, the elementary district is entitled to 60% of this fee.  Since Ravenswood does not have a current justification study on record, it is collecting less than 60% of this fee.
Rationale:

SFC will prepare, in accordance with all pertinent provisions of the Education and Government Codes, a School Facility Fee Justification.  Report that will document the impact of residential and commercial/industrial development on school facility needs and will enable the District to levy developer fees up to the maximum amount authorized by Government Code Section 65995 (Level I fees).  The maximum amounts are anticipated to be increased by the SAB in January 2020.

 
Recommended Motion:
To approve the Proposed Agreement with School Facility Consultants. 
Financial Impact:
The fee for this service is $6,500 plus expenses. 

It will be paid out of Fund 25, where developer fee proceeds will be placed.
