President Mecak stated that this Bylaw gives the ACOE Board the authority to fill the vacancy of Superintendent.

Quick Summary / Abstract:
Education Code 1042(e) states: “the county board of education may fill by appointment any vacancy that occurs during the term of office of the county superintendent of schools.  In a county in which the county superintendent of schools is elected, the appointee shall hold office until the office is filled by election at the next gubernatorial election.”  This appointment would be effective August 21, 2019, through 2022, with the primary election in March, 2022, and if needed, the general election in November, 2022.

Minutes:
Making the appointment pursuant to ed code 1042(e) stating "(e) (1) Notwithstanding Section 25304 of the Government Code, fill by appointment any vacancy that occurs during the term of office of the county superintendent of schools. In a county in which the county superintendent of schools is elected, the appointee shall hold office until the office is filled by election at the next gubernatorial election."

President Mecak stated that is appointment will be in place through the next gubernatorial election of Tuesday, November 8, 2022.

President Mecak also stated that the board has waived
the residency requirement for Superintendent Strahl and given him the next year to secure Alpine County residency.

Mr Strahl's oath will be administered by President Mecak in the District Office on August 21, 2019.
