3.1. Approve Resolution of the Governing Board of the Vista Del Mar Union School District Declaring Futility of Public Bidding Additional Construction Work for the Vista De Las Cruces School Seepage Pits System Installation Project and Approving Change Order No. 1 for the Work in Accordance with Public Contract Code Section 20118.4

Quick Summary / Abstract:

The District entered into a construction contract with County Sanitation Company for the construction of the Vista De Las Cruces School Seepage Pit System Installation Project to replace the School's failed Wastewater Treatment Plant.  The Contract was entered into on September 9, 2021. 

During construction of the Seepage Pits, it was determined that the absortion rate of the seepage pits was higher than originally projected.  The District consulted with the State Water Board and the County Department of Environmental Services and determined that the system would require an additional layer of treatment prior to being discharged into the seepage pits.  The proposed treatment is a filter system called Orenco Axmax 125-21 treatment system.   Ashley & Vance has redesigned the treatement system to include the new filter and treatment system prior to discharge into the seepage pits.  The proposed change order includes the additional cost for constructing the changes proposed by Ashley & Vance.  

As noted in the change order, the cost includes replacement of 4" sewer pipeing from exit point of school at existing 2 way clean outs to proposed tank so that the piping can be raised in elevation.  Approximately 20' of 4" pipe from the existing house is to be replaced from pump basin upstream.  The pipe is being rerouted so that the tank can be set at a shallower depth.

The total cost of the Change Order No. 1 is $152,724.00 resulting in a new contract price of $371,724.  Because the change order exceeds 10%, the Board must approve the attached resolution declaring the futility of bidding the Additional Work as a separate public works project and approving the Change Order No. 1.

Recommended Motion:
Approve Change Order No. 1 to the Contract between  Vista Del Mar UNion School District and County Sanitation Company for the Construction of Vista De Las Cruces School Seepage Pits in the amount of $152,724.00.
Financial Impact:

The Change Order will increase the cost of the Project by $152,724.00.  This will be funded 60% from the State's Facilities Hardship Program and 40% from District reserves.
