Subject to Board policy, the President of the Board will allow any individual or group representative to address the Board on any subject not covered by an item on the agenda under Public Comments/Staff Comments.

In order to efficiently manage the business of the Board, The Board President may limit the amount of time allocated for public testimony for each individual speaker to three minutes, and to limit the total time allocated on a particular issue to twenty minutes, pursuant to Board Bylaw 9323. Any materials required by law to be made available to the public prior to the meeting of the Board of Trustees can be inspected at the following address during normal business hours. 9467 San Julian Road, Gaviota.

3.1. Recognize Administrative Professionals' Day (April 27, 2022)
Quick Summary / Abstract:

Recognize Maria Valdez for her outstanding contributions to the Vista Del Mar Union School District and to honor her for National Administrative Assistant Day, Wednesday, April 27, 2022. 

The day recognizes the work of administrative assistants, central to any operations of an organization or business.  Ms. Valdez professionalism keeps Vista de Las Cruces office organized and efficient. 

The day in the life of Ms. Valdez varies from moment to moment.  Above and beyond for organization and attention to detail is her flexibility and ability to handle the unexpected that comes with the job.  She is totally student-centered, and she has picked up many challenges as opportunities to solve in her role. She truly is the the center of why the school is running efficiently. Her warm, pleasant and welcome greeting models the core of Vista Del Mar Union School District.

3.2. Celebrating School Nutrition Professionals
Quick Summary / Abstract:

The teamwork of Karina Ruelas and Maria Valdez provide a moment to join the California Department of Education celebration of School Lunch Hero Day, which was held on Friday, May 6.   Health and nutrition is a most basic safety need for children each and everyday and this team works together each day to plan and prepare meals for the students.  Their professionalism and concern for student nutrition and access to fresh, healthy and culturally diverse quality meals is genuine.   This effort they put forth supports a student's academic success and their social-emotional-and physical well being.    These tireless professionals embody the essence of the word "hero".

5.1. Kitchen Infrastructure and Training (KIT) Funds
Quick Summary / Abstract:
Yuri Calderon, Chief Business Officer, applied for a state grant titled Kitchen Infrastructure and Training (KIT) and the district has been awarded $ 27,102.00.  The purpose of the KIT funds is to increase pupil access to, or improve the quality of fresh and nutritious school meals.  These funds will be used to support the implementation of the Universal Meals Program beginning in 2022-23.  Funds are distributed in training apportionments ($2,102) and equipment apportionments ($25,000) and must be used only for the purposes for which they are awarded.

7. ACTION ITEMS
7.1. Reconsider Circumstances of the State of Emergency and Adopt Findings Related Thereto
Quick Summary / Abstract:

In response to the COVID-19 pandemic, Governor Gavin Newsom declared a statewide emergency and issued Executive Orders N-29-20 and N-35-20 authorizing legislative bodies subject to the Brown Act to conduct public meetings—and to make them accessible to the public—entirely via telephonic or other electronic means without board members or the public physically present. On June 11, 2021, the Governor issued Executive Order N-08-21 to address the expiration of executive orders issued during the pandemic. Executive Order N-08-21 allowed legislative bodies subject to the Brown Act to continue meeting by telephonic or other electronic means until September 30, 2021, at which time the legislative bodies would again be subject to pre-pandemic requirements of the Brown Act.  Governor Newsom signed Assembly Bill 361 (Rivas). AB 361, which sunsets on January 1, 2024, provides that during a declared State of Emergency, legislative bodies may continue to hold public meetings—and to make them accessible to the public—via telephonic or other electronic means without board members or the public physically present, subject to certain conditions outlined below. 

The AB 361 teleconferencing flexibility requires renewals and is contingent upon the continuation of a proclaimed state of emergency and the additional findings noted in the bulletin, one of which is a state or local recommendation for social distancing.  While California no longer requires social distancing, a State recommendation to socially distance is still in place as evidenced by the following California Department of Public Health document, which in turn references a CDC document calling for social distancing.  The CDPH document can be accessed via website https://covid19.ca.gov/safely-reopening/#dos-and-donts-for-daily-life  There is a link to the CDC’s How to Protect Yourself and Others that clearly recommends staying 6 feet away from others as a safety measure in that linked resource,

The requirement that each teleconference location is accessible to the public and that members of the public are able to address the legislative body at each teleconference location is suspended for public meetings held pursuant to AB 361. AB 361 also outlines notice and participation requirements by which the District currently adheres.

Recommended Motion:
Reconsider the circumstances of the State of Emergency and adopt a finding that the State of Emergency continues to directly impact the Vista Del Mar Union School District and the ability of its Trustees to meet safely in person and the Santa Barbara County Department of Public Health continues to impose and recommend measures to promote social distancing.  These findings are adopted in accordance with AB 361.
7.2. Adoption of Fiscal AB1200 and Ratification of the Tentative Agreement between Vista Del Mar Union School District and the Vista Del Mar Education Association for the 2021-22 through 2023-24 Academic Calendar YearsWas edited within 72 hours of the Meeting
Quick Summary / Abstract:

On March 21, 2022, the Vista Del Mar Union School District and the Vista Del Mar Education Association reached a tentative collective bargaining agreement for the 2021-2022, 2022-2023 and 2023-2024 academic and fiscal years.  The Tentative Agreement calls for a 5.0% increase to salaries for both classified and certificated employees for the 2022-2023 fiscal year.  Additionally, the District will implement a new revised salary schedule in the 2023-2024 fiscal year that provides for consistent increases for both vertical and horizontal movement across salary cells.  The new salary schedule also encourages certificated staff to continue with professional development and learning to move horizontally across the salary schedule.  

The Agreement also includes a one-time early retirement incentive for certificated staff members that provides two years of health and welfare benefits after retirement.  The retirements will allow the District to hire additional staff in the coming years.

Recommended Motion:
Adopt the AB1200 and ratify the Tentative Agreement between the Vista Del Mar Union School District and the Vista Del Mar Education Association for the 2021-22 through 2023-2024 school years
Financial Impact:
The fiscal impact of the tentative agreement is noted in the AB1200.  Retirements and reorganization of classified staffing will result in no net cost to the District for the proposed increases.

7.3. Ratification of the Maintenance On-Site Wastewater Service Agreement Between County Sanitation and Vista Del Mar Union School District
Quick Summary / Abstract:

The Vista Del Mar Union School District is in the final stages of completing the new waste water treatment and seepage pit system to handle the Vista Del Las Cruces' waste water.  Shortly before commencing construction of the Project, the State Water Board notified the District that the plans were inadequate to treat the waste water before releasing the waste into the Seepage Pits.   The District quickly redesigned the project to include a more robust waste water treatment system before depositing the waste water into the seepage pits. 

The State Water Board has assigned management of the waste water permit to the Santa Barbara County Department of Environmental Health Services.  The revised permit requires a new level of monitoring and reporting to the County.  The District has entered into an agreement with County Sanitation to provide the monthly monitoring and reporting services to the District during the first year of operation.  County Sanitation is in the best position to provide this service because they are familiar with the system that they installed and provide this service to other entities that manage waste water systems.  The District entered into the Agreement in order to provide initial reports to the County.    The District requests the Governing Board ratify the Agreement.

7.4. Approval of Amendment to Ashley & Vance Engineering, Inc.
Quick Summary / Abstract:

Shannon Jessica, Principal Engineer for Ashley & Vance Engineering, Inc. has provided to Vista Del Mar Union School District ongoing civil engineering services including the planning and engineering design and is the project lead on all services, time and materials during waste management construction.  A contract dated April 15, 2021 of $5000 was approved by the Vista Del Mar Union Board of Trustees.  Based on the project status, an amendment to this contract  was approved December 9, 2021, and a second amendment was approved March 10, 2022.  The District is in the final stages of the project and it is recommended to amend the contract in order to complete the scope of services for the waste management project.

Due to schedule conflicts, the Board President has recommended rescheduling the Regular Governing Board meeting of June 16, 2022.  The District staff have recommended rescheduling the meeting to Tuesday, June 14, 2022.

7.6. Resolution No: 2022-16 Order of Elections
Quick Summary / Abstract:

The statewide general election will be held on Tues., Nov. 8, 2022, to elect district governing board members to fill terms that will expire on Dec. 9 (second Friday in December).  Vista Del Mar Union School District Board of Trustee Kit Boise-Cossart's term expires on December 9, 2022.

The Santa Barbara County Education Office has notified the District of the need to consolidate the Vista Del Mar Union School District's election with other school district governing board member elections being held on the same date in the same area.  Education Code Section 5340 requires that the District request Santa Barbara County consolidate Vista Del Mar Union School District's Governing Board Member's upcoming election with the other area elections.  Adoption of the attached Resolution will permit Vista Del Mar Union to comply with the relevant Education Code provision.
