In June 2018, a team comprised of Educational Services and school site staff engaged the SMMUSD Board of  Education in a study session titled, "Multilingual Programs & Opportunities." After receiving direction from the board, a Multilingual Study Group was formed to explore the Foreign Language in Elementary School (FLES) and Heritage program models. Tonight's study session will focus on key learnings gained through professional readings, interviews, and site visits to San Francisco Unified School District (SFUSD).

Staff answered board members’ questions regarding the enrollment demographics at Edison Language Academy, how existing programs could be expanded, whether heritage speakers are necessary for a successful model, and how programs could be funded. The board requested data on the number of heritage Japanese speakers who attended the schools that were visited in San Francisco.

Rationale:

The presentation will include an overview of the major components of the Family Engagement Framework and an update around implementation and related activities. In addition, as part of the implementation of the Family Engagement Framework, the SMMUSD has enacted the Language Access Initiative in the 2018-19 school year. The purpose of this update is to provide the Board with the major activities/outcomes related to the implementation of the Family Engagement Framework and the Language Justice Initiative along with next steps for the 2019-20 school year.

.V.D. Adopt Resolution No. 18-55 - Tax and Revenue Anticipation Notes (TRANs) (5 min)
Recommended Motion:

It is recommended that the Board of Education adopt Resolution No. 18-55 - Tax and Revenue Anticipation Notes for the fiscal year 2019-20.  The Resolution sets a not-to-exceed amount of $** million (the actual amount will be determined at the time of issuance.)

Comments:

Tax and Revenue Anticipation Notes (TRANs) are short-term financings used by school districts to manage temporary fiscal year cash flow shortfalls.  In the past, large reserve balances have allowed the District to operate without issuing TRANs.  As the district expects to be deficit spending this year causing our fund balance to decline, a TRANs issue will bridge the cash deficiencies during the 2019-20 fiscal year.

Rationale:

On March 2, 2017, the Board of Education approved the project design of a Performing Arts Center to replace the John Adams Auditorium that was closed in August 2014 due to significant structural damage and seismic issues. Santa Monica College offered to support the construction and share in the use of the new Performing Arts Center. In November of 2016, the voters overwhelmingly approved Measure V.

SMC agreed to contribute $20 million to the construction of the theater that is part of the Adams Performing Arts Center. Voter approved SMMUSD Measure ES will fund the remainder of the cost of constructing the entire Performing Arts Center, including the modernization of the existing Music Building. 

The agreement outlines the fiscal agreement and arrangement for the construction of the project. It includes a payment schedule and other financial/liability concerns. The second part of the agreement addresses the facility use of the center. The use agreement allows SMC to use the theater on at least 36 days per year. The use will be scheduled with John Adams Middle School.

The term of the use will continue as long as Facility remains under the District’s ownership and control and the building is used as an auditorium by the District.

 
Financial Impact:

SMC agrees to contribute $20 million to the construction of the Adams Performing Arts Facility. They will receive up to 36 days of use annually. Permit fees will be waived, but additional personnel costs will be charged.

Comments:

The Fiscal and Use Agreement is related, but separate from the Master Facilities Agreement. 

This item was on the June 6 agenda for action, but following discussion, it was decided to postpone the item for clarification of the ‘Use of Facilities by Parties’ section. The language of the agreement secures the right of the College to use the facility on the four named days (Graduation, VIP Welcome Day, Fall Opening Flex Day, and Spring Institutional Flex Day). Prior to the start of each academic school year for the District and College, the parties shall agree upon a two-year calendar. Mutual agreement will balance both parties needs to designate the 32 blackout days for the College’s use and the blackout days for the District’s use. Blackout days will be reserved for each party’s exclusive use.

Rationale:

SMMUSD and SMC have been close partners since we were part of the same unified school district. This Master Facilities Use Agreement codifies the processes how we share facilities to support the educational and community programs of both districts. This agreement allows us to continue to share athletic/recreational, performing/cultural and educational facilities.

The current shared use includes, but is not limited to: SMC using the softball field at Adams MS, conducting classes in the Samohi Auto Shop, and other regular activities; and SMMUSD using Corsair Field for Samohi home football games and use of other athletic facilities. This agreement excludes the Broad Stage and Barnum Hall. 

The agreement allows each party to use the others facilities when available as shared benefit with no permit or use charged. Additional personnel fees will be the responsibility of the party using the facilities. Both parties will maintain appropriate liability insurances. The agreement intends that there will be a parity in joint use between the two parties. 

The term of the agreement is ten (10) years from commencement.

 
Financial Impact:

The financial impact is overall cost neutral. SMMUSD gains by having the use of SMC facilities for no rental fee, and SMC gains from the use of SMMUSD. Additional personnel costs are the responsibility of the user group.

Comments:

This Master Facilities Agreement is separate, but connected to the Fiscal and Use Agreement between SMMUSD and SMC that is also on this agenda.

This item was on the June 6 for action, along with the Fiscal and Use Agreement. Following discussion, both agreements were postponed to this meeting to provide clarification of a section in the Fiscal and Use Agreement.

.V.G. Closing of Juan Cabrillo Elementary School in Malibu (15 min)
Recommended Motion:

It is recommended that the Board of Education approve the closing of Juan Cabrillo Elementary School in Malibu. 

Rationale:

As part of the Malibu Schools Alignment process, Juan Cabrillo Elementary and Point Dume Marine Science Schools will be combining into one school, beginning 2019-20 (location: 6955 Fernhill Drive, Malibu, CA 90265).  Malibu Elementary has been selected and approved by the Board of Education as the new school name for the combined sites. 

 
Comments:

Following board approval of the closure of Juan Cabrillo, a process will be initiated for Malibu Middle school to have its own CDS Code with a grade span of 6-8.

Recommended Motion:

It is recommended that the Board of Education approve the creation of a unique CDS Code for Malibu Middle School to educate students in grades 6-8.


Rationale:

As part of the Malibu Schools Re-Alignment process, and board approval on March 21, 2019, of Ms. Melisa Andino as the Middle School principal effective July 1, it is necessary to apply for a new CDS code for Malibu Middle School that will be located at 30237 Morning View Drive, Malibu Ca. 90265.

Following board approval, a process will be initiated for Malibu Middle School to have its own CDS Code to educate students in grades 6-8.

It is recommended that the Board of Education approve a change for Malibu High School grade span to reflect 9-12. 

Rationale:

As part of the Malibu Schools Re-Alignment process, and board approval on March 21, 2019 of Ms. Melisa Andino as the Middle School principal effective July 1st, it is necessary to separate the high school and middle school. This requires an amendment to Malibu High School's grade span to reflect 9-12.



 
Comments:

Following board approval, a process will be initiated to provide the new grade span of 9-12 for Malibu High on the CDE online public updates for schools. The high school CDS code will not change.

Rationale:

Through the adoption process, the Dual Language Immersion (DLI) History High School teachers recognized the need to explore additional options that would meet the Spanish language needs required in the DLI program. This textbook, along with the adopted Pearson program (recently adopted for the U.S. History course), will provide the content through the Spanish language.

* Mr. Mechur requested that SMMUSD staff work with SMC staff to get data regarding achievement data for SMMUSD grads who attend SMC. In regards to the letters from Samohi students asking about solar panels at our sites, Mr. Mechur suggested that DO staff work with Samohi staff to inform the students of photovoltaic panels being installed at sites throughout the district.
* Dr. Tahvildaran-Jesswein encouraged his peers to review the equity document that SMC recently adopted to address the achievement gap at the college.
