13.A.1. Review of Emergency Repairs and Consideration of Need for Continued Action at District Middle School Sites in Relation to the Transition of Moving Lynwood High School to Lynwood Middle School Campus (Action Item)
Rationale:

On February 11, 2021, the Board adopted Resolution No. 20-21/24, authorizing the emergency repair and replacement of facilities and procurement of equipment and services to enable timely transition of moving Lynwood High School to Lynwood Middle School campus.

Because of the necessary relocation of students and reconfiguration of operations caused by the unavailability of Lynwood High School, repairs and equipment are needed at the District's middle schools and other District campus sites to provide adequately equipped facilities and available space for classroom instruction and essential educational services. Resolution No. 20-21/24, delegated to the District's Superintendent or designee the authority to execute contracts and take all actions necessary to execute and implement those contracts, such that one or more contractors may be selected to perform the necessary emergency repairs.

If a person with authority delegated under Public Contract Section 22050(b) orders action under Section 22050 without giving notice for bids, that person is required to report to the Board of Education within specified time periods the reasons justifying why the emergency will not permit a delay resulting from a competitive solicitation for bids and why the action is necessary to respond to the emergency. Actions listed in the Public Contract Code include the repair or replacement of a public facility, the procurement of necessary equipment, services, and supplies, or other related and immediate action required in the case of  emergency.

The Board of Education also is required to review the emergency action and determine, by a four-fifths vote and at each regularly scheduled meeting, that there is a need to continue the action taken. When the Board of Education reviews the emergency action, it must terminate the action at the earliest possible date that conditions warrant so that the remainder of the emergency action may be completed by giving notice for bids for contracts.

13.A.2. Request Approval to Enter Into a Service Agreement with SVA Architects to Prepare Plans for the Site Barriers Removal Project at Lynwood High School Bullis (Action Item)
Rationale:

Staff requests approval to enter into a service agreement with SVA Architects to prepare plans to remove site barriers and provide access to individuals with disabilities, per the Americans with Disabilities Act (ADA) requirements, at Lynwood High School Bullis.  

The design team will incorporate the recently constructed quads, parking lot, drop-off zone and bus drop-off zone on Bradfield Ave. SVA Architects is proposing a fee based on time and materials, not to exceed $250,000.00, plus reimbursable expenses. This project will be submitted to the Division of the State Architect (DSA) for approval.

This project will be the first project under Phase II for the Lynwood HS Bullis site. The project will be funded with Measure K funds.

Rationale:
Shortly before the start of the fall 2021 school semester, the Division of the State Architect approved the plans for the Emergency Interim Housing Project at Lynwood High School Bullis. The plans included work that could not be completed in a reasonable amount of time before the start of school. Staff reached out to four contractors for bids on the remaining work. The following prequalified bidders submitted their proposals.

14.A.1. Request Approval to Adopt the 2021 CA Educator Effectiveness Funds (EEF) Block Grant (Consent Item)
Rationale:

The administration requests approval to adopt the 2021 CA Educator Effectiveness Funds (EEF) Block Grant. 

On or before December 30, 2021, the Lynwood Unified School District will develop and adopt a plan delineating how the Educator Effectiveness Funds will be spent including the professional development of teachers, administrators, paraprofessionals, and classified staff. As indicated by the California Department of Education (CDE), the plan must be explained in a public meeting of the governing board of the school District or County Board of Education, or governing body of the charter school, before its adoption in a subsequent public meeting. The public hearing was held at the regular Board of Education meeting on November 18, 2021.

As a condition of apportionment, Lynwood Unified will submit annual data and expenditure reports detailing information to the California Department of Education (CDE), including, but not limited to, specific purchases made and the number of teachers, administrators, paraprofessional educators, or classified staff that received professional development on or before September 30 of each year. In addition, as a condition of apportionment, a final data and expenditure report is also required to be submitted to the CDE on or before September 30, 2026.

Adoption of this Grant comes to no cost of the District.

14.A.2. Request Approval to Purchase the Elsevier Hesi Program License from Elsevier, Inc. for the Lynwood Community Adult School Licensed Vocational Nurse Program for the 2021-2022 School Year (Consent Item)
Rationale:

The administration requests approval to purchase the Elsevier Hesi program from Elsevier, Inc., for Lynwood Community Adult School (LCAS) Licensed Vocational Nurse (LVN) program for the 2021-2022 school year.

The Hesi Elsevier program is utilized as an adjunct to instruction in the LVN program and for remediation in the LVN program. This program will assist in preparing the LVN students for the NCLEX exam. Exit exams are used as a predictor for student outcomes on the NCLEX exam. The Elsevier Hesi program consists of case studies for all systems and adaptive quizzing that will also prepare LVN students for the NCLEX exam.  

Practice NCLEX tests are also included in the program; these will be utilized throughout the curriculum. A two-day live NCLEX review is an essential part of the Hesi program given at the completion of the program (a requirement in the LVN curriculum). Hesi exit exams are also included in the package and are administered at the completion of the LVN program.

The Elsevier Hesi program allows the LVN student to preview the NCLEX exam and practice test that is used to assess each area of the NCLEX exam. Case studies are used to provide scenarios in the clinical setting to prepare the student for real life clinical situations. The Elsevier Hesi program is beneficial to the Lynwood Community Adult School LVN program in assisting the LVN program to maintain its NCLEX pass rate above the California average of 72%. The Lynwood Community Adult School LVN program has utilized this program for over seven years. Students consistently give positive reviews for this program.

Total cost of $11,980.00 includes the fees associated with a one-year subscription to Elsevier Hesi Program.

Rationale:

The administration requests approval for Lynwood High School Girls’ Basketball Team to participate in the Lady Baron Gold Crown Holiday Tip-Off in Chula Vista, CA on December 27-30, 2021 and the St. Mary's High School 9th Annual Dr. Martin Luther King, Jr. (MLK) Classic in Stockton, CA on January 14-17, 2022.

The Gold Crown Holiday Tip-Off is a high school varsity, junior varsity, and novice/freshman girls basketball tournament featuring some of the top teams in the country. The holiday tournament is one of the largest tournaments in San Diego County, and teams come from different states. The event is slated as one of the premier girls tournaments. Competitions will be covered by all local news outlets, including the San Diego County Hoops Report, Big City Hoops, Ball is Life, Elite Girls Basketball, and more.

The St. Mary's MLK Classic is packed with some of the top girls high school basketball teams, not just in the state, but the country. Previous years rosters included six of the top twenty-five (25) teams in the State, and three of the top twenty (20) teams in the nation.

Rationale:

The administration requests approval to enter into an agreement with the Los Angeles County Office of Education (LACOE) to provide two days of training in sexual health education for high school and middle school Science teachers. 

The Physical Education and Comprehensive Health Unit, Division of Curriculum and Instructional Services of Los Angeles County Office of Education (LACOE) offers professional development to teachers and administrators in an effort to support Local Education Agencies (LEA) in meeting the needs of learners in the area of physical and health education. 

LACOE will also support District administrators with talking points for parents, guardians, and community, regarding the required curriculum and support in the facilitation of the informational parent meeting.  

Total cost of $750.00 per session will be invoiced to the District for each professional learning session completed.

We are requesting an amendment due to a rate increase in the original ASES Grant for the 2021-2022 school year. On September 8, 2021, the California Department of Education (CDE) announced that the daily rate for the 21st Century Community Learning Centers (21st CCLC) program increased from $7.50 per student, per day to $10.18 per student, per day, retroactive to July 1, 2021.

In order to offset the learning loss due to the lack of laboratory facilities at our new campus, access to the Gizmos Software is imperative. Gizmos offers an opportunity for students to participate in realistic virtual laboratory experiments and analyze relevant data to gain knowledge about important topics. Having access to this software will allow the Science Department to provide engaging and rigorous virtual laboratory activities to our students.

The administration requests approval to renew an agreement with Scribbles Software Company to manage online records requests to requesting parties from December 2021 to June 2023. 

Scribbles Software currently provides Lynwood Unified School District the following applications and services: 

  • Scribbles will deliver to Client, ScribOrder, an online records request system for student records, with the $4.00 convenience fee charged to the requester. 

  • The statements will be delivered by the 25th of each month for the previous months collection, minus the convenience fee and appropriate credit card fees. 

  • At the discretion of the client, Scribbles will make monthly payments to the client via ACH or check.

Rationale:

The administration requests approval of Community Advisory Committee (CAC) members for the Mid-Cities Special Education Local Plan Area (SELPA) for the 2021-2023 school years. 

The Mid-Cities Special Education Local Plan Area (SELPA) has a Community Advisory Committee (CAC) composed of parents, educators, and community members from the participating districts of Bellflower, Lynwood, and Paramount. The mission of the committee is to foster cooperative communications between parents and educators, provide parent education opportunities, advise the Mid-Cities SELPA administration regarding program development and content, pursue political action on behalf of students with disabilities, and balance the needs of identified students with the resources of the school districts.

Members of the committee are nominated and appointed by the participating Districts' school Boards, for a two-year term of office. The Special Education Department requests to appoint two parents, Magali Ochoa and Maria Gonzalez, to serve on the Mid-Cities SELPA Community Advisory Committee for a two-year term of office beginning July 1, 2021 and ending on June 30, 2023. These two parents were elected by parents and Lynwood community members on October 29, 2021, during the Lynwood Special Education Advisory Council (LSEAC) meeting.

Tina Orduno Calderon is a culture bearer of the Gabrielino Tongva and Ventureno Chumash. The Tongva (also known as Gabrielino), are the first peoples of what is now known as Lynwood. She enjoys sharing her culture and speaks on growing and thriving as Indigenous Gabrielino Tongva and Ventureno Chumash in Southern California. She serves the local and global community by preserving her Native legacy for the benefit, education, and inheritance of future generations. Through her work, Ms. Calderon honors the contributions of diverse and Indigenous people, and the accuracy of American History. She has presented at elementary schools, libraries, and other community functions.

On October 14, 2021, the Board of Education approved Resolution No. 21-22/17, to declare the District's commitment to promote respect for, and understanding of, the region's American Indian and Indigenous communities, their long histories, and their continuing contributions to contemporary society. Ms. Calderon's services will support these efforts through professional development for administrators and staff, to bring cultural awareness of the Indigenous Peoples to the Lynwood community. 

Ms. Calderon will consult with the administration regarding land acknowledgment to ensure the inclusion of culturally appropriate content. She will provide important historical information and guidance regarding aspects to be included in the land acknowledgment. The District intends to conduct a land acknowledgement to acknowledge and celebrate Indigenous Peoples, as well as inspire others to take action to support Indigenous communities.

Cost of services will be $1,500 per day, not to exceed ten (10) days during the 2021-2022 school year.

Rationale:

The administration requests approval to renew agreement with Catapult Learning to provide Title II professional development services to staff and Title III instructional services to eligible English Learner students of non-public schools for the 2021-2022 school year.

Professional development will be provided with a focus on Common Core planning. Participants will learn the principles of backward design and how to align Common Core Standards and assessments to daily lesson planning. Teachers will also receive five days of instructional coaching, including individual and small group coaching, based on teacher needs and formative data.

Title III services will ensure that identified English Learners will attain English proficiency and meet the academic content standards through small group instruction, tutoring, and parent outreach.

The Consolidated Application specifies that the Local Education Agency (LEA) provide instructional services to the students attending private schools under the following programs: Title I/Part A, Title II/Part A, and Title III/Part A.

Rationale:

Administration requests approval for extending a temporary increase in the substitute teacher rate of pay from $155 per day to $180 per day for day-to-day assignments and from $185 to $210 for long-term assignments (21 or more days in same assignment) from January 1, 2022 to June 30, 2022. On May 14th, the Board approved a temporary increase through December 31, 2021. Additionally, administration requests the extension of temporary pay increase for Early Education Teacher substitutes from $110 to $135 per day.

Given the challenges in the labor market experienced nationwide, there is an extreme shortage of certificated substitutes. A temporary increase in the rate of pay will enhance the District's ability to recruit and retain substitutes and make Lynwood Unified School District more attractive to subs who work for multiple Districts in the area to assist in our efforts in returning to in-person instruction and provide additional tutoring support, as needed.

Staff requests approval to renew an agreement with Safer Schools Together (SST) to support the District's Social Media Awareness Plan for the 2021-2022 school year.

Safer Schools Together will train staff and students on social media usage and safety. The training will help LUSD develop and improve protocols for safe and caring schools, and provide social media data reports of any unusual or concerning activities.

These services follow Assembly Bill (AB) 1442 (Chapter 799/Statutes 2015), which allows school districts to gather or maintain information that only pertains directly to school or pupil safety. Any data collected will be available for access by the pupil for which the data was collected and will be destroyed within one year of the pupil turning 18 or leaving the District. Additionally, the service provider is prohibited from selling or sharing the information gathered with any person or entity other than the District. Pursuant to Education Code (EC) 42130 and 42131, school districts are required to certify at least twice a year to demonstrate the districts' ability to meet its financial obligations for the remainder of the current fiscal year and the subsequent two fiscal years.  This is referred to as the Interim Report.  There are three types of certification:

  • Positive - A school district, based on current projections will meet its financial obligations for the current and two subsequent fiscal years.

Rationale:

The administration requests approval to renew the contract with Jim Huge & Associates to provide consultancy services for the Superintendent and the Board of Education from December 1, 2021 through June 30, 2022. 

Jim Huge and Associates will continue to assist the leadership of the District in delivery of services from the central office, to maximize the effectiveness of services to schools and students.

Specific services may include:

1. Continue work with Superintendent and Board to promote ongoing development of the governance team (five Board members and the Superintendent).
2. Work with the Board and Superintendent on the development of Board goals and emphasis goals for the Superintendent, including Board-defined evidence of success. This includes facilitation of Board/Superintendent governance and goal-setting retreats and individual meetings with Board members and Superintendent.
3. Work with Cabinet members and other leaders at the district and school level to assist in any way possible in the continued improvement in the opportunities and outcomes for ALL students.
4. Facilitate work sessions and other meetings on site, and provide telephone and electronic consultation as directed by the Superintendent. We recommend conducting a governance team work session regarding English Learners, examining data and assisting in implementation of recommendations as determined by the Board and Superintendent.
5. Facilitate central office administrators and principals in updating the principal job description to accurately reflect responsibilities and align it with evaluation instrument. 
6. Conduct organizational studies, provide findings and assist in implementation of recommendations.
7. Other consultation as determined by the Superintendent.

Any associates required will be determined jointly by the Superintendent and Jim Huge, and will be compensated directly by the District. If at any time the District determines that services are no longer required, the monthly payment arrangement will end.

The professional fee will not exceed $7,500.00 per month, plus necessary travel expenses. Transportation, hotel, meals, and incidental expenses are not included in the professional fee and will be billed separately. Reimbursable expenses are not to exceed $2,250.00 per month.
