Board Bylaw 9322 (b): Members of the public may address the Board of Education on matters not on the agenda. Complaints against specific District employees should be resolved through the District’s Personnel Complaint Procedure. The right to address the Board does not exempt the speaker from any potential liability for defamation. The proceedings of the Board are recorded and are a part of the public record.
The Period for Public Presentation is limited to 30 minutes. Time will be allotted equally to individuals based on the number of request cards submitted. The maximum for any one speaker is three minutes.
The law limits the response of Board members and prohibits the Board from taking any formal action.

The Financial Services organization structure requires changes to improve the effectiveness and efficiency of the departments and the District, as well as achieve and maintain the highest level of fiscal accountability. The 2020 instructional model will be updated and revised to meet the needs of our teachers and students to support increasing academic achievement and ensuring all employees have high quality professional development. Various job descriptions, such as Curriculum Coordinator and Instructional Coach, have been revised in order to achieve District strategic goals 1 and 2. The Information & Educational Technology Services organization structure requires changes to improve the effectiveness and efficiency of the department and the District, as well as achieve and maintain the highest level of fiscal accountability. 1.0: Increase academic achievement and ensure equitable access to enable all students to attain college and career readiness. 2.0: Ensure all employees have access to high quality professional development. 4.0: Ensure the District is fiscally and operationally sound. 5.0: Recruit, hire, train, and retain high quality staff. A report on these proposed reorganizations was presented to the Board at the February 11, 2020 board meeting. Approval is now sought from the Board. |

Federal and state laws require the California Department of Education (CDE) to monitor implementation of categorical programs operated by local education agencies (LEAs). LEAs are responsible for creating and maintaining programs that meet minimum fiscal and programmatic requirements. School districts, direct-funded charter schools, and county offices that receive funding for certain programs may be chosen for a review. The purpose of the review is to ensure that they are spending the funding as required by law. At the end of the review, the state provides a report that details any findings of non-compliance and informs the school, district, or county office how to correct the findings. 1.0: Increase academic achievement and ensure equitable access to enable all students to attain college and career readiness. 2.0: Ensure all employees have access to high quality professional development. 4.0: Ensure the District is fiscally and operationally sound. 5.0: Recruit, hire, train, and retain high quality staff. Modesto City Schools Elementary District (K-8) received a Federal Program Monitoring (FPM) review January 22 – 31, 2020. Modesto City Schools High School District received their review February 4-7, 2020. The report will update the Board of Trustees on both Modesto City Schools Elementary District and Modesto High School District Federal Program Monitoring findings.

A study was completed in August of 2019 by School Services of California entitled “Total Compensation Study - Selected Certificated Administrators.” The study focused on site level administrators and outlined great disparities between what our administrators’ total compensation in comparison to eleven other similar Districts. |

On June 3, 2019, the Board of Education approved the renewal of an agreement for independent audit services with Vavrinek, Trine, Day & Co., LLP, now Eide Bailly, LLP, for fiscal year 2019-2020. Goal 4.1: Implement sustainable plan for the budget under the Local Control Funding formula. The District must have in place a contract for independent audit services unless it intends to have those services provided through the contract negotiated by the Stanislaus County Office of Education. Per Government Code Section 53060, a school district may enter into contracts for special services and advice on financial, economic, accounting, engineering, legal, or administrative matters outside of a competitive bidding process. Staff has determined it is in the District's best interest to renew the agreement for independent audit services with Eide Bailly, LLP for fiscal years 2020-2021 and 2021-2022. A copy of the agreement with Eide Bailly, LLP is on file in the Business Services Office - Fiscal. |

The maximum fee for the contract for auditing services with Eide Bailly, LLP, for fiscal years 2020-2021 and 2021-2022 shall not exceed $79,700 annually. The costs are budgeted in the General Fund. |

The District has a need to purchase several heavy-duty vehicle lifts for the Transportation Department. Goal 4.3: Invest in school facilities and infrastructure for safe and clean facilities. The costs to purchase the vehicle lifts will exceed the current bid threshold. Competitive bids must be sought or identified to meet formal bid requirements per Public Contract Code Section 20111(a). Sourcewell, formerly NJPA (National Joint Powers Alliance), is a public agency serving as a national municipal contracting agency and has the authority to develop and offer cooperative procurement services. Contracts awarded through this agency contain cooperative purchase language that allows other agencies to utilize as required by provision 20118 of the Public Contract Code. These contracts are considered cooperative or “piggy-backable” contracts, they meet bidding requirements, allow for multiple public agency use, and allow California public agencies to achieve greater cost savings. Through this national cooperative procurement process, Stertil-KONI was awarded contract #061015-SKI “Heavy Duty Vehicle Lifts.” The Sourcewell/NJPA contract was originally awarded on July 21, 2015 and has been renewed through a letter of agreement to extend the contract through July 21, 2020. Upon review, it is staff’s determination that the District would derive more benefit by utilizing this cooperative bid contract than to seek separate bids for the purchase of the heavy-duty vehicle lifts in the Transportation Department. The Stertil-KONI equipment will be purchased directly from a local authorized distributor, Municipal Maintenance Equipment, located in Sacramento, CA.

The approximate cost for the purchase of this equipment is estimated at $1.1 million and will be paid from the Facility Maintenance Fund.

The National School Breakfast Program was established in 1966 to ensure that all children would have an opportunity to start their school day with a healthy breakfast. Recent studies have linked a healthy breakfast to improved academic performance. Modesto City Schools operates an exemplary breakfast program at all school sites. 3.4 Improve customer service for students, families, staff, and community to support welcoming school environments. Proclaiming the week of March 2 through 6, 2020 as National School Breakfast Week in Modesto City Schools expresses the appreciation of the Board members and District staff in recognizing the contribution made by the Nutrition Services staff and food service workers to Modesto City Schools. |

3:3 Increase regular two-way communication with stakeholders regarding student progress and other important issues. The District is entitled to file a claim with the State of California for expenses related to State mandated costs outside of the block grant. Maximum reimbursement can be accomplished by retaining a consultant specializing in this area.
Each year, the District has the opportunity to file claims with the State of California for reimbursement of costs associated with Education Code requirements. Beginning in 1993-94, the District began utilizing the services of a consultant to file these claims with a resulting increase in reimbursement and decrease in staff time preparing the data. Consultant fees are reimbursable by the State under the mandated cost program. A copy of the contract with School Innovations and Advocacy, Inc., is available for review in the Business Services Office. |

Consultant fee will be billed on a flat rate basis not to exceed $29,000 in 2020-21, $29,000 in 2021-22, and $29,000 in 2022-23. The District may terminate the services thirty (30) days prior to expiration of the current agreement year. This fee is fully reimbursable under the mandated cost program. |
It is recommended that the Board of Education approve a services agreement with School Innovations and Advocacy, Inc., to prepare and file the 2020-21, 2022-23 and 2023-24 mandated cost claims. |

Transpar Group (TPG), will provide support to fully implement the Transfinder automated routing software for the registration and tracking of all students riding Modesto City Schools’ buses. TPG will use this data to assist MCS with SB 328 compliance. TPG will also provide mentoring and training to the existing leadership team to implement the student tracking and SB 328 initiatives. |

The total cost of $56,000 will be budgeted within General Fund. |

Purchase orders and VISA payments are tracked each month. Goal Four: Ensure the District is fiscally and operationally sound. Board Policy 3300 requires Board review of all individual purchase orders issued in excess of $1,000 and all purchase orders less than $1,000 by fund total. All purchases are done in accordance with Board Policy, Education Code, Public Contract Code, and/or other applicable regulatory requirements. Board of Education approval will allow the District to meet Board Policy 3300 requirements. A copy of the report is available for review in the Purchasing Department. |

The Business Services Division draws warrants on a weekly basis to pay the bills of the District. Payroll warrants are drawn on the 15th of the month for claims, and on the last working day of the month for monthly employees. Goal Four: Ensure the District is fiscally and operationally sound.
The California Education Code section 42631 requires the Board of Education to approve all expenditures of the District.

The out-of-state high school Key Club trip to Reno, Nevada to attend the Key Club convention was reviewed by the Senior Director(s), School Leadership. District high school students from Beyer, Davis, Enochs, Gregori, Johansen, and Modesto will attend. 1.5 Ensure students have access to enrichment activities at all school sites.
The students will attend workshops, celebrate achievements, and elect new district officers. The trip is scheduled for Friday, March 13 through Sunday, March 15, 2020. Students will miss 1 day of school.

The District is interested in enhancing the leadership capacity and strengthen the retention of high quality staff. Future Management Systems, Inc. (FMS) provides individual assessments and sessions to help leadership gain the necessary competencies and systems to create integrated, interdependent high-performance teams, and assists leaders in working creatively to develop and sustain the necessary systems and resources to meet their strategic and professional goals. 2.0 Ensure all employees have access to high quality professional development. 5.0 Recruit, hire, train, and retain high quality staff. A Services Agreement with FMS to provide these services to MCS Cabinet members was approved by the Board on September 30, 2019. MCS would like to extend these services to Extended Cabinet members (24) and Cabinet support staff (9). |

The cost of the proposal is $16,560 plus expenses, not to exceed $18,560. The contract will commence on February 25, 2020 and conclude on June 30, 2020. The funding source is Title II funds. |

The Refugee School Impact program would like to create a partnership with the Stanislaus PAL for our refugee and asylum seekers. This partnership would create a 7-week soccer clinic for our students. The clinic would teach the students basic soccer skills, promote physical activity, and allow students to practice their English skills. 1.0: Increase academic achievement and ensure equitable access to enable all students to attain college and career readiness.
Board approval is needed due to Stanislaus County PAL having other contract(s) in place with Modesto City Schools, totaling over $10,000. |

The District has participated in a Speech-Language Pathology Assistant Field Experience agreement with San Joaquin Delta Community College District. 5.2: Strengthen partnerships with local teaching, training, and employment programs. The District is interested in renewing this agreement to provide field experience for students enrolled in the Speech-Language Pathology Assistant program at San Joaquin Delta Community College District. The California Interscholastic Federation's "Pursuing Victory with Honor" program is based on 16 Operating Beliefs and Principles. Principle #8 reads as follows: "School Boards, superintendents, school administrators, parents, and school sport leadership must ensure that the first priority of their student-athletes is a serious commitment to getting an education and developing the academic skills and character to succeed." 1.5 Ensure students have access to enrichment activities at all school sites. Athletic Eligibility Verification Forms provide documentation that coaches, athletic directors, and principals have checked the eligibility status of all athletes. Note the last column on the right, which verifies that inter/intradistrict permits are current and meet Board policy criteria. |
