B.4. (15 min) Approval of Revision of Passport to Literature Lists, Grades 7-12

Rationale:

The District's Passport to Literature Lists, Grades 7 through 12, contain literature approved as (1) core works which all students in any given class may be required to read and study in their language arts classes, (2) extended literature selections from which teachers select works appropriate for particular course studies, and (3) recreational literature selections recommended for independent reading for grades 7-8.

English department chairs meet annually with the English-Language Arts Coordinators to review and revise the core works and extended literature lists based on recommendations from language arts teachers.  This year, the committee made changes to the extended works for Grades 7-8 and Grades 9-12, some of which will require an annotation and notification of parents' rights to request an alternate assignment.  Those works that are annotated and require notification have an asterisk next to the indicated grade-level.

* Please see the attached list of recommended additions.

Sites have the discretion to designate works that must be read by all students at a particular grade level as long as the works are chosen from the course-appropriate list of titles.  Teachers should adjust the novel count upward according to their students' needs and abilities.  Students should be encouraged to do independent reading of self-selected titles.

Modesto City Schools' ongoing effort is to ensure our Board Policies (BP), Administrative Regulations (AR), and Board Bylaws (BB) are up to date. 

Goal Three: Provide a safe, welcoming, and respectful learning environment for every member of the school community while ensuring effective district-wide communication for students, staff, families, and community partners. 

It is found that the following Board Policy (BP) needed to be revised or adopted: BP 5145.6, Parental Notification.

B.6. (15 min) Appointment of Assistant Superintendent, School Leadership and Approval of Employment Effective July 1, 2020 through June 30, 2021

Rationale:

The Assistant Superintendent, School Leadership provides proactive, collaborative leadership for the functions of the School Leadership team. In addition to performing duties of Senior Director, School Leadership for assigned sites, the position plans, organizes, controls, directs and administers the delivery of the MCS Principals’ Leadership Pipeline professional development program.  The position mentors, coaches, directs and assists Senior Directors of School Leadership in the development of specific plans to meet identified District, State and Federal school targets, assists in determining and acquiring support services, as well as develops, plans and implements structures to calibrate on and support the MCS Principal Coaching Model.

5.0 Recruit, hire, train, and retain high quality staff.
5.1 Create a District culture of valuing all employees to facilitate hiring and maximize retention.
5.3 Expand recruiting and hiring processes to provide support, maximize retention, and increase diversity in the certificated, classified, and management workforce.

The Assistant Superintendent, School Leadership has been selected with a beginning date of July 1, 2020 through June 30, 2021.  Attached is a copy of the offer of employment.

 
Financial Impact:

There is no immediate financial impact as any increase will be considered following a review of the State of California’s 2020-21 Budget Act and its impact on District finances.

Recommended Motion:

It is recommended that the Board of Education approve the appointment of Assistant Superintendent, School Leadership and employment effective July 1, 2020 through June 30, 2021.

C. BUSINESS ITEMS (PROPOSED CONSENT AGENDA)
C.1. Approval of March Revisions to the Adopted 2019/20 Budget
Rationale:

The Board adopted the 2019/20 budget on June 24, 2019.  Adjustments to the budget are made regularly based on known changes to revenue or the level/category of expenditures.

4.1 Implement sustainable plan for the budget under the Local Control Funding Formula.

The Education Code requires that the Board approve major changes to the adopted budget.

Budget adjustments which have been processed for the period between March 1, 2020 and March 31, 2020 are presented in the following reports.  Explanations are provided for adjustments over $25,000 for revenue and expenditure groups by fund.  This report reflects adjustments to the budget only, not a complete financial statement.  Copies of the full report are available for review in the Budget Department.

 
Financial Impact:

The adjusted budget retains all State and Board designated reserves.

Recommended Motion:

It is recommended that the Board of Education approve the March revisions to the adopted 2019/20 budget.

C.2. Approval of Authorization to Award Bid No.19-4727, for Corridor and Site Improvements at Mark Twain Junior High to Haggerty Construction, Inc., in the amount of $529,750
Rationale:
On April 15, 2019, the Board of Education approved authorization to seek bids for corridor and site improvements at Mark Twain Junior High. 

A mandatory job walk was held on February 5, 2020, for Bid No. 19-4727; twelve (12) individuals signing in with two (2) companies submitting proposals.

The Board of Education needs to award the bid and authorize staff to enter into an agreement before project work may begin.

4.3 Invest in school facilities and infrastructure for safe and clean facilities.

Bid No. 19-4727, for corridor and site improvements at Mark Twain Junior High  
was opened on February 25, 2020, at 10:00 a.m., with the following results:

Financial Impact:

The probable cost of the project is estimated at $677,000. Funding for this project will come from Elementary General Obligation Bond dollars.

Recommended Motion:
It is recommended that the Board of Education approve authorization to award Bid No. 19-4727, for corridor and site improvements at Mark Twain Junior High, to Haggerty Construction, Inc., in the amount of $529,750.
C.3. Approval of Authorization to Seek Bids for Downey High School Agriculture Storage Building
Rationale:
In 2018, the Agriculture Department at Downey High School underwent capital improvements.  An area for a future storage building was designated on the architectural plans.  Funds have been set aside to execute the storage building construction project. 

4.3 Invest in school facilities and infrastructure for safe and clean facilities.

With funding identified, it is recommended that the project be authorized for competitive bid in accordance with Public Contract Code.  All public works projects over $60,000 must be competitively bid.

It is proposed that this project be advertised for bid in the Modesto Bee.
 
Financial Impact:
The probable cost for this project is estimated at $300,000. Funding for this project will come from Career Technical Education (CTE) Incentive grant dollars.
Recommended Motion:
It is recommended that the Board of Education approve authorization to seek bids for 
Downey High School Agriculture storage building.
C.4. Approval to increase the Current Services Agreement with TransPar Group (TPG)
Rationale:

Transpar Group (TPG), will provide support to fully implement the Transfinder automated routing software for the registration and tracking of all students riding Modesto City Schools’ buses.  TPG will use this data to assist MCS with SB 328 compliance.  TPG will also provide mentoring and training to the existing leadership team to implement the student tracking and SB 328 initiatives.

It is necessary to increase the Administrative Support with TransPar for the remainder of the 2019-2020 school year.

Goal Three: Provide a safe, welcoming, and respectful learning environment for every member of the school community while ensuring district-wide communication for students, staff, families, and community members.
 
Financial Impact:

The cost of $56,000 budgeted within General Fund will be increased by $12,000.00 totaling the services agreement amount to $68,000.00.

Recommended Motion:

It is recommended that the Board of Education approve the increase to the Services Agreement with Transpar Group, $12,000. totaling $68,000.00.

C.5. Approval of Memorandum of Understanding (MOU) with the City of Modesto (MPD) and Modesto City Schools
Rationale:

The City's Police Department and Modesto City Schools will work together to provide enhances safety and security in the neighborhoods surrounding the District's various campuses through a program including detection, surveillance, and/or monitoring of developing emergencies that may pose a serious and immediate threat to the safety of District students, parents, staff, teachers or other members of the City's community.

Goal 3.2 Promote outstanding students, families, staff, programs, schools, and community partners.

The purpose of the MOU is to define the roles and the responsibilities of the City and the District with respect to the City's limited use of the District's CCTV System in connection with the program.

the MOU will commence on approval from the Board and terminate on June 30, 2021.

The MOU can be reviewed in the Business Services office.

 
Financial Impact:

This MOU is not cost to the District.

Recommended Motion:

It is recommended that the Board of Education approve the Memorandum of Understanding with the City of Modesto (MPD) and Modesto City Schools.

D. CURRICULUM AND INSTRUCTION ITEMS (PROPOSED CONSENT AGENDA)
D.1. Approval of the Adoption of the Modesto City Schools' Conduct Code for 2020-2021
Rationale:

Goal Three: Provide a safe, welcoming, and respectful learning environment for every member of the school community while ensuring effective district-wide communication for students, staff, families, and community partners.

The Governing Board believes that all students have the right to be educated in a safe and positive learning environment free from disruptions.  Students shall be expected to exhibit appropriate conduct that does not infringe upon the rights of others or interfere with the school program while on school grounds, going to or coming from school, at school activities, or using district transportation.

The Superintendent or designee shall ensure that each school develops standards of conduct and discipline consistent with Board policies and administrative regulations. Students and parents/guardians shall be notified of district and school rules related to conduct. 

The Board will annually adopt the student code of conduct prior to its timely dissemination to the public. 

 
Recommended Motion:
It is recommended that the Board of Education approve the adoption of the Modesto City Schools’ Conduct Code for 2020-2021.

D.2. Approval of agreement between Modesto City Schools, Love Stanislaus County, Inc., and Stanislaus County Office of Education
Rationale:

The Educational Options department is seeking an agreement to partner with Love Stanislaus County, Inc. and the Stanislaus Office of Education for support in Career Exploration, Business Internships, and Data Management on the K12 Strong Workforce grant award. This agreement includes, but is not limited to internship access, career days, job shadowing, and improving partnerships with school CTE programs and businesses through various methods.

Goal 1.2: Increase students being identified as "prepared" in the college/career indicators.

One of the highest noted areas to improve of within the CTE program is the need for students to get more hands-on training through internships, apprenticeships, job shadowing, etc. This agreement will allow for us to address this area and give our students a greater opportunity to become career ready when exiting high school.

A copy of the services agreement can be requested in the Educational Options department.

 
Financial Impact:

The cost of this agreement will not exceed $361,046 and will be funded through the K12 Strong Workforce Grant.

Recommended Motion:

It is recommended that the Board of Education approve the agreement between Modesto City Schools, Love Stanislaus County, Inc., and the Stanislaus County Office of Education.

D.3. Approval of an Instructional Agreement with Modesto Junior College for the Middle College Pathway at Davis High School
Rationale:

Early College, sometimes called “Middle College,” is a grades 9-12 school-within-a-school that is located on or near a community college campus. The organizational structure reflects the shared student responsibility of the high school, the school district, and the college. High school and college faculty create curriculum alignment that leads to high quality educational and employment opportunities. Students who completed the Intersegmental General Education Transfer Curriculum (IGETC) with a “C” or better receive fully transferable credit to Junior College, CSU, or UC schools.

Credit is delivered by means of dual enrollment. Dual enrollment is when a student receives the five (5) semester credits necessary for high school and community college by taking one class with one instructor.

1.2: Increase students being identified as “prepared” in the college/career indicators

Modesto Junior College (MJC) will continue to provide the District, on the Davis High School campus, with a coordinated program for fall and spring semesters that will deliver college-level instruction for eligible students to take targeted classes for the 2019-20 school year.

MJC will provide the District with access to closed-to-the-public online classes of “Middle College,” for eligible sophomore, junior, and senior students.

Davis High School students will be enrolled in targeted closed-to-the-public MJC online credit and face-to-face classes that are attended onsite, at Davis High School, during the regular high school schedule of classes. There is no cost to the student for the classes or the college units.

Successful completion of these targeted classes will strengthen students’ ability to be prepared for continuing college participation and accelerate students’ ability to reach their academic goals at the Junior College, CSU, or UC systems.

 A copy of the agreement can be found in the Educational Options office.

 
Financial Impact:

Total cost of providing courses by MJC (both fixed and variable) shall not exceed $66,570. The funding source has been identified in the Local Control and Accountability Plan.

Recommended Motion:

It is recommended that the Board of Education approve the instructional agreement with Modesto Junior College for the Middle College Pathway at Davis High School.

D.4. Approval of Modesto City Schools SELPA Services Agreements for 2020-2021: Center for Human Services, Maxim Healthcare Staffing Services, Inc. and USA Staffing Services of CA, LLC.
Rationale:

Modesto City Schools Special Education Local Plan Area (SELPA) contracts with outside service providers when necessary to provide needed supports to students with disabilities.   Services agreements are generated when dictated by the Individualized Education Program or to provide specialized services and training the SELPA cannot provide.  Additionally, services agreements are needed when the District is unable to fill vacancies in both certificated and classified staff.

1.4:  Develop a Multi-Tiered System of Support for all students.

1.6:  Increase access to general education for students with disabilities.

Modesto City Schools SELPA has identified services providers for the 2020-2021 school year to assist the SELPA with meeting the unique needs of our students, assist with vacant positions, and provide targeted professional development to our teaching staff. 

Modesto City Schools SELPA proposes to contract with the following entities to provide services, staff, and training to our District:

      • Center for Human Services
      • Maxim Healthcare Staffing Services, Inc.
      • USA Staffing Services of CA, LLC

Copies of these services agreements are available in the Modesto City Schools Special Education Office for review.

 
Financial Impact:

The fiscal impact of the services agreements will not exceed $1,600,000. The funding source has been identified as General Fund Special Education funds.

Recommended Motion:
It is recommended that the Board of Education approve the Modesto City Schools SELPA Services Agreements for the 2020-2021 school year with:  Center for Human Services, Maxim Healthcare Staffing Services, Inc., and USA Staffing Services of CA, LLC.
D.5. Approval of the Agreement to Provide Participant Advisor Services to the County of Stanislaus Community Services Agency for 2020-21
Rationale:

An agreement to provide participant advisor services to clients of the County of Stanislaus Community Services Agency (CSA) effective July 1, 2020 through June 30, 2021, has been approved by the County of Stanislaus. The maximum reimbursement amount is $161,242. The Educational Options office has been serving CSA adult students for over eleven (11) years.

Goal 1.2: Increase students being identified as "prepared" in the college/career indicators. 

Goal 1.5: Ensure students have access to enrichment activities at all school sites.

Goal 5.2 Strengthen partnerships with local teaching, training, and employment programs.

CSA desires to place clients in job-skill training programs offered by Modesto City Schools. CSA needs the assistance of Modesto City Schools' instructional and support staff, as well as a participant advisor from the Educational Options office, to aid clients in meeting their Welfare-to-Work eligibility requirements. 

It is proposed that the Board of Education approve the agreement to provide participant advisor services to the County of Stanislaus Community Services Agency for 2020-21.

 
Financial Impact:

The agreement to provide participant advisor services to the County of Stanislaus CSA is a cost reimbursement agreement.

Recommended Motion:

It is recommended that the Board of Education approve the agreement to provide participant advisor services to the County of Stanislaus Community Services Agency for 2020-21.

E. HUMAN RESOURCES ITEMS (PROPOSED CONSENT AGENDA)
E.1. Approval of Clinical Internship Agreement with California State University, Stanislaus
Rationale:

The District has participated in agreements with colleges and universities to provide supervised clinical experience to college students enrolled in a nursing program.

5.2: Strengthen partnerships with local teaching, training, and employment
programs.

The District is interested in entering into a Clinical Internship Agreement with California State University, Stanislaus to provide supervised clinical experience for students enrolled in their nursing program.

The District would like to enter into a Clinical Internship Agreement with California State University, Stanislaus to provide supervised clinical experience for students enrolled in their nursing program, effective July 1, 2020, through June 30, 2021, and shall be renewed automatically for additional periods of one (1) year up to a total of four (4) additional years.  A copy of the agreement will be available for review in the Human Resources Office.

 
Financial Impact:

There will be no cost to the District.

Recommended Motion:

It is recommended that the Board of Education approve the Clinical Internship Agreement with California State University, Stanislaus.

F.2. Approval of Proclamation Recognizing May 13, 2020, as Day of the Teacher in Modesto City Schools
Rationale:

This proclamation recognizes the second Wednesday in May as Day of the Teacher. “El Dia del Maestro” originated in Mexico and in other Latin American countries over a century ago to recognize teachers for their contributions to children. In 1982, the Association of Mexican-American Educators initiated a statewide campaign to establish the California Day of the Teacher. Also that year, the State Legislature formally designated the second Wednesday in May as the Day of the Teacher.

5.1 Create a District culture of valuing all employees to facilitate hiring and maximize retention.
 
Recommended Motion:
It is recommended that the Board of Education approve of the proclamation declaring May 13, 2020, as Day of the Teacher in Modesto City Schools.
