Specifically for this nomination Ella is being recognized for Responsibility because she continued to work tirelessly as a student leader behind the scene sometimes with little supervision or direction. Ella is classy, kind, organized, follows teacher and school rules, is careful to ensure the groups she oversees and collaborates with do the same. She is the social media director responsible for pushing out information for the school's National Alliance on Mental Illness club. The level of responsibility Ella has assumed on our campus is possible because she is trusted by her peers, our staff, and our administrative team at Modesto High School. Ella is one amazing young woman. |

Blanca has been with MVA less than a year and has gone above and beyond in her duties to help make the program successful and support our MCS families. She is caring and considerate of our MCS families and willing to step in to help anytime. Blanca has created sections, added teachers, scheduled students, and updated special programs. Without her help, the program would not have been as successful as it has been this past year and the beginning of this 2021-2022 school year. Blanca is truly an MCS Hero. |

Despite concerted efforts, Modesto City Schools has a number of equity gaps in areas such as academic achievement, graduation rates, attendance, and suspension rates. These gaps have led to the need for the District to analyze existing practices and provide training and support in a number of areas at the District, site, community, and student level. This led to the creation of the Equity and Racial Justice Framework.
Goal One: Increase academic achievement and ensure equitable access to enable all students to attain college and career readiness.
This framework included the creation of an Equity and Racial Justice Task Force. The purpose of the task force was to provide recommendations to our Superintendent and Board regarding future work surrounding equity in Modesto City Schools. The Board approved the proposed statement and six recommendations made by the Task Force at the April 19, 2021 Board Meeting.
The Student Support Services Division will provide an update on the recommendations, the District administrators responsible for the recommendations, and the plan for keeping the Board of Education apprised of the District progress.

In order to receive funding for the Pupil Textbook and Instructional Materials Incentive Program (Education Code, Section 60252) and/or funding for instructional materials from any State source in a fiscal year, the District must meet the requirements of the Education Code, Section 60119. Goal One: Increase academic achievement and ensure equitable access to enable all students to attain college and career readiness. Education Code 60119 requires that the Board of Education shall hold a public hearing and shall make a determination, through a Resolution, as to whether each pupil in each school in the District has sufficient textbooks or instructional materials, or both, in each subject area that is consistent with the content and cycles of the curriculum framework adopted by the State Board. The local governing board of Modesto City Schools hereby certifies that as of this date, each pupil in the District at a TK-12 traditional site has been provided with a standards-aligned textbook or basic instructional materials in each of the following areas: - History/Social Science

- Reading/Language Arts

For students in TK-8 traditional education, the instructional materials were purchased from an approved, standards-aligned state adoption list as required by CCR, Title 5, Section 9531. For students in grades 9-12, the instructional materials were adopted by the local governing board following District review of the materials and their alignment with State Content Standards as required by CCR, Title 5, Section 9531. The local governing board of Modesto City Schools has provided TK-12 pupils with a one-to-one device to continue to accommodate learning during the COVID-19 pandemic. Negotiations between Modesto City Schools and the Modesto Teachers Association have concluded and revisions to the Collective Bargaining Agreement for 2020-23 are attached to this report. 1.0: Increase academic achievement and ensure equitable access to enable all students to attain college and career readiness. 2.0: Ensure all employees have access to high quality professional development. 4.0: Ensure the District is fiscally and operationally sound. 5.0: Recruit, hire, train, and retain high quality staff. The Board of Education must approve the revisions to the Collective Bargaining Agreement for 2020-23. The tentative agreement is attached. The Modesto Teachers Association is scheduled to present the tentative agreement to its members at an upcoming meeting. It is necessary for the Board of Education to take formal action to approve the tentative agreement. |

Revisions to the 2020-23 Collective Bargaining Agreement with the Modesto Teachers Association will result in an expense for the following fiscal years of approximately: $0 (20-21), $10,714,261 (21-22) and $10,449,708 (22-23 year). |

A Modesto City Schools’ student attendance day calendar needs to be
established for each school year. Currently, the school year is 180 instructional
days. 3.0 Provide a safe, welcoming, and respectful learning environment for every
member of the school community while ensuring effective district-wide
communication for students, staff, families, and community partners. The District has met with representatives from each of the bargaining units related to the school year calendar. The District and the Modesto Teachers Association have reached agreement for the 2022-23 calendar. The California School Employees Association and its Chapter 007 agreed to the proposed 2022-23 work year calendar and it was ratified by
the unit membership on August 25, 2021. It is necessary that the Board of Education take formal action to adopt the calendars. |

Goal 4.3: Invest in school facilities and infrastructure for safe and clean facilities. California Education Code section 17406 permits the governing board of a school district to lease property to a developer, who constructs tenant improvements to the property and leases back the completed improvements to the district. The lease terminates after payments are completed. In accordance with the section 17406, on June 7, 2021, the Board adopted Resolution No. 20/21-34, supporting the award of the Site Lease and Facilities Lease for the Fairview and Shackelford Cafeteria and Site Improvement Project to Acme Construction Company, Inc. (“Acme”) under the District’s Best Value Methodology. The Facilities Lease provided that Acme would perform preconstruction services to develop a Guaranteed Maximum Price (“GMP”) and Construction Schedule for each increment of the Project. Acme and the District have agreed to bid the trade contracts in two distinct increments, each with an associated bid package (“Bid Package”), as follows: Bid Package #1: New modular cafeteria building and site improvements at Fairview Elementary School. Bid Package #2: New modular cafeteria building and site improvements at Shackelford Elementary School. Following Acme’s preconstruction services, District staff and consultants have negotiated a GMP in the amount of $5,888,000 for Bid Package #1. The Amendment provides that Acme will construct Bid Package #1 of the Project in accordance with the Facilities Lease for the GMP and establishes the Construction Schedule for the Project. The Amendment also modifies the terms, such as Completion Date, Schedule of Values, or any negotiated terms. To account for those changes, the Amendment modifies the Facilities Lease, including Exhibits C, F, and G of the Facilities Lease, and the accompanying Contract Documents to the Facilities Lease. Similar amendments are intended for Bid Package #2 of the Project once preconstruction services for that increment has concluded (expected in October 2021). Copy of the Amendment No. 1 to the Facilities Lease for this project is available for review in the Planning and Facilities Office at 426 Locust Street, Modesto, CA.
Staff proposes the approval of Amendment No. 1 to the Facilities Lease with Acme for the Fairview and Shackelford Cafeteria and Site Improvement Project subject to Division of the State Architect (“DSA”) approval. DSA approval is expected to be received by September 10, 2021. If DSA approval is delayed, District personnel will not sign the Amendment No. 1 to the Facilities Lease until after receipt of DSA approval.

On November 11, 2020, the Board approved Amendment No. 1 to the Facilities Lease establishing a GMP in the amount of $3,400,000 for Bid Packages #1 and #2. The Board of Education must formally approve and accept deductive Change Order No. 1 in the amount of $221,322.52 and the completion of the Lease/Leaseback Agreement with Robert E. Boyer Construction, Inc., Resolution No. 20/21-07 Grace M. Davis High School 900 Wing Addition and Transportation Department Shop and Site Renovations Project, in the amount of $3,178,677.48. The work performed under the lease/leaseback agreement with Robert E. Boyer Construction, Inc., Resolution No. 20/21-07, has been inspected by the project architect and reported to be satisfactorily completed in accordance with the plans and specifications. A Notice of Completion will be filed and final payments will be made as authorized under the terms of the contract. |

This contract, at a total cost of $3,178,677.48, was funded from Career Technical Education Facilities Program Grant, Facility Maintenance, High School Developer Fee, Special Reserve and High School Facility Improvement Funds. The estimated final cost of this project is $7,236,000 including construction costs, soft costs, furniture and equipment. |

Modesto City Schools’ Nutrition Services plays a vital role in the education process by providing nutritious meals each school day to District students. For many students this is their only meal of the day. In this way, the Nutrition Services staff contributes to the students’ learning capacity and overall health. 3.4 Improve customer service for students, families, staff, and community to support welcoming school environments. National School Lunch Week has been recognized by the President of the United States each year as a way to inform the public of the contribution of food service workers to public schools throughout the country.

As of June 30, 2021, our risk manager retired, and a replacement has not been hired. The District is in need of property and casualty claims administration services which were performed by the prior risk manager. Keenan & Associates can provide administrative, adjustment, investigative and reporting services for the District under a property and casualty claims administration services agreement. A copy of the agreement is available for review in the Business Services, Risk Management Department. Goal Four: Ensure the District is fiscally and operationally sound. |

The property and casualty claims administration services to the District can be provided at a rate range of $82.22-$98.40 per hour depending on the level of service needed, not to exceed a total of $75,000 for fiscal year 2021-22. The Self Insurance Fund will provide the funding of these services. |
It is recommended that the Board of Education approve of the services agreement with Keenan & Associates for property and casualty claims administration services for fiscal year 2021-22. |

Purchase orders and VISA payments are tracked each month. Goal Four: Ensure the District is fiscally and operationally sound.
Board Policy 3300 requires Board review of all individual purchase orders issued in excess of $1,000 and all purchase orders less than $1,000 by fund total. All purchases are done in accordance with Board Policy, Education Code, Public Contract Code, and/or other applicable regulatory requirements.
Board of Education approval will allow the District to meet Board Policy 3300 requirements. A copy of the report is available for review in the Purchasing Department.

Modesto City Schools contracts with outside service providers when necessary to provide needed supports and staffing when the District cannot hire staff to perform the work. COVID 19 has led to increases in student positivity rates that requires us to provide temporary personnel supports to our school sites in order to provide timely testing of students, contact tracing, and accurate communications with our families. Goal Three: Provide a safe, welcoming, and respectful learning environment for every member of the school community while ensuring effective district-wide communication for students, staff, families, and community partners. Modesto City Schools has identified services providers for the 2021-2022 school year to assist with COVID related needs of our students, staff, assist with vacant positions, provide training including, testing, and contact tracing.
Modesto City Schools proposes to contract with the following entities to provide services, staff, and training to our District:

- Therapy Travelers, LLC
- Healthcare IT Leaders, LLC
- Maxim Healthcare Staffing Services, Inc.

Modesto City schools has contracted with legal firms to perform legal services as needed by the District. 4.0: Ensure the District is fiscally and operationally sound. The Modesto City Schools will contract with Gutierrez, Perry & Villarreal to provide legal representation and advice related to District issues for the 2021-2022 school year beginning on September 1, 2021. Gutierrez, Perry & Villarreal will provide legal services in connection with, but not limited to, real and personal property, facilities construction, environmental quality, school impact mitigation, collective bargaining and labor relations, other personnel matters, student matters, trustee's governance matters, general operations matters, and general education, policy, procedural, litigation matters, and special education matters. A copy of the agreement is available in the Special Education office. |

The District would like to renew this agreement for services with Michael Perea through June 30, 2022, to train and test students in CPR. A copy of the services agreement can be viewed in the Educational Options office upon request. |

The focus of the current contract year would consist of coaching, providing resources and consultation on the impact of universal transitional kindergarten, providing knowledge and skill development for supporting on-site early learning classrooms, and program expansion; researching and considerations in planning for an infant/toddler center. The JMH Team, Inc., will contract with Modesto City Schools from September, 2021 through June 30, 2022. 1.1 Ensure Great Instruction First Time 2.1 Increase targeted professional development in the areas of early literacy, mathematics, English Language Development (ELD), effective PLC teams, culturally responsive instruction, and leadership development. 2.2 Ensure that all staff has professional development in the area of building their capacities as professionals. |

Due to COVID, IETS had purchased and distributed approximately 1,200 mobile hotspots to students and staff that did not have access to reliable internet access. These devices help ensure internet access for all students during this continued COVID situation. With a mobile hotspot, you have the entire connection dedicated to the student, in remote locations or low-income households. Goal Three: Provide a safe, welcoming, and respectful learning environment for every member of the school community while ensuring effective district-wide communication for students, staff, families, and community partners. IETS is seeking the approval of continued services agreement with T-Mobile and MCS for the 2021-22 fiscal year with reconfirmation of the continued use of the California Network and Telecommunications Program Contract c4-CVD-19-001-01. This continued use will provide internet access for the existing 1,200 wireless hot spots that are currently distributed to our students and staff. Additionally, we are asking to increase the contract by 200 wireless hotspot devices and purchase (100) Chromebooks with built in LTE as an alternative WIFI option for students. The total annual cost is not expected to exceed $415,000. We have applied for Emergency E-rate Funding (ERC) to offset these costs by 80%, with approval expected by the end of the year. Modesto City Schools partners with Doctors Medical Center to provide school sports physicals. These are performed by California Rehabilitation providers for students who present to a California Rehabilitation clinic. California Rehabilitation also provides training services and specialty supplies at high school sports practices and games. A services agreement has been established with California Rehabilitation to provide the aforementioned services. A copy of the services agreement can be reviewed in the office of School Leadership. Goal 1.5 Ensure students have access to enrichment activities at all school sites. |

The services of teachers are required in subject areas other than those authorized by his or her credentials because of District need. The District may authorize staff who are holders of a General Elementary or Secondary Credential to teach outside of his or her college academic major or minor. Individuals holding Standard Teaching, Single Subject or Multiple Subject Credentials may be authorized to teach courses in Grades 7-12 other than those authorized by subject areas designated on their credentials. 5.0 Recruit, hire, train, and retain high quality staff. To qualify to teach certain classes, those teachers with the Standard Secondary or Single Subject credentials must have 18 semester hours of course work, or nine semester hours of upper division, or graduate course work in the subject area, or have completed at least 60 semester hours equally distributed among the four areas of diversified major for instruction in a self-contained classroom, as set forth in Education Code Section 44263. For those with the Multiple Subject and Standard Elementary Credentials, it is necessary that they have 12 semester units or 6 upper division or graduate units to teach subjects in departmentalized settings in grades nine and below, as set forth in Education Code Section 44256. The holder of a Single Subject teaching or a Standard Secondary teaching credential may be partially assigned to teach classes in grades 5 to 8, inclusive, in a middle school, provided that he or she has a minimum 12 semester units, or six upper division or graduate units, as set forth in Education Code Section 44258.2. A credential holder whose credential is in a subject other than physical education may be authorized, by action of the Governing Board, to coach one period per day in a competitive sport for
which students receive physical education credit, as set forth in Education Code Section 44258.7. Based on the aforementioned Education Code Sections, a Board Resolution must be approved to allow teachers to teach courses that are both necessary and desirable for the efficient operation of the junior and senior high schools. |

Goal 3.3 – Increase regular two-way communication with stakeholders regarding student progress and other important issues. Goal 4 – Ensure the District is fiscally and operationally sound. The District periodically invests funds with the State’s Local Agency Investment Fund (LAIF), the California Asset Management Program (CAMP) and in specific securities as allowed under the Government Code and Board policy. The Board of Education should periodically review the District’s investments. The Stanislaus County Treasury yield rate (similar to interest rate) at June 30, 2021 has decreased 15 basis points from the previous quarter and decreased 79 basis points from the last year. The cash balance in the Stanislaus County Treasury has increased about $82.49 million over the balance for the previous quarter and increased about $92.50 million over the balance a year ago. The increase in cash balance from the previous quarter and the previous year is related to the receipt of Federal CARES/ESSER assistance funding, State Aid, Elementary General Obligation Bond proceeds for construction projects, additional property taxes related to the new Elementary General Obligation Bonds and redevelopment property taxes. |
