THIS MEETING WILL BE CONDUCTED PURSUANT TO THE TELECONFERENCE PROVISIONS OF AB 361 (GOVERNMENT CODE § 54953(e)). THIS REGULARLY SCHEDULED BOARD MEETING IS NOT OPEN TO THE PUBLIC DUE TO COVID19 RESTRICTIONS.

Board approval is requested for this Memorandum Understanding (MOU) with Fresh Lifelines For Youth  for the 2021-2022 school year.  This agency partnership allows the Gilroy Unified School District  to provide counseling services to students and their families to address emotional and behavior concerns.


Rationale:

The purpose of this MOU is to provide counseling services to students experiencing emotional and behavioral needs.

Board approval is requested of this Memorandum Understanding (MOU) with New Hope For Youth  for the 2021-2022 school year.  This agency partnership allows the Gilroy Unified School District to offer counseling services to support the social-emotional and behavioral welfare of children and families.
Rationale:
The purpose of this MOU is to  provide services to students who are  experiencing  issues  in the areas of  behavior, social-emotional, attendance or with family connections. Services will be provided in both individual and group settings.
 
Financial Impact:
There will be no financial impact to the District.
Recommended Motion:

Approval of Memorandum of Understanding with New Hope  for Youth and the Gilroy Unified School District is recommended.

e. RENEWAL of Service Agreement with Extreme Academy & Learning Center for the 2021-2022 School Year (not to exceed $27,000) (Consent Item)
Quick Summary / Abstract:

Board approval is requested for the service agreement with Extreme Academy & Learning Center  for the 2021-2022 school year. The service agreement is to provide tutoring services.



Rationale:
This service agreement is necessary to provide tutoring through settlement agreements.
 
Comments:
The District has a responsibility to provide a free, appropriate public education (FAPE) to all of its special education students. When all program options are exhausted within the District and County programs, the District must utilize the services of a Non-Public Agency (NPA) to meet the needs of students with special needs. All other program options were carefully considered. This NPA provides specialized tutoring and in-home instruction
Financial Impact:
The total Service Agreement amount is not to exceed $27,000.

7. ACTION/INFORMATION ITEMS (Procedural Item)
a. Return to School and COVID19 Update (Information Item)
Quick Summary / Abstract:

Superintendent Dr. Deborah Flores and staff will provide an update regarding the return of students to school after the winter break (on January 3 and 4).  Updates will be provided about COVID19 and the impact on student and staff attendance, importance of adherence to staying home if sick, COVID19 testing protocols and quarantines, provision of PPE’s, ventilation systems, cleaning procedures, and other relevant topics.  The district is facing many challenges during this latest surge e.g. staffing shortages in every classification.  It is important for everyone to keep pace with the rapidly changing conditions and to remain flexible and adaptable. 

The Santa Clara Office of Education and Santa Clara Public Health Departments have advised districts not to close schools and reminded districts that “California law does not allow schools to offer distance learning. The ability to offer distance/remote/virtual/synchronous learning expired on June 30, 2021”.  

Rationale:

The purpose of this agenda item is to provide an update about the proactive steps that the district is taking to provide safe school environments for students and staff.  As directed by the Santa Clara County Office of Education and the Santa Clara Public Health Department, Gilroy Unified schools will remain open. 

 
b. Approval of Dr. TJ Owens Gilroy Early College Academy (GECA) 2022/2023 School Calendar (Action Item)

Paul Winslow, Assistant Superintendent of Human Resources, will present the proposed GECA Instructional Calendar for 2022-2023
Rationale:
The GECA school calendar coordinates with Gavilan Community College in providing joint instruction to students attending both programs.
 
Recommended Motion:
Approval of the 2022/2023 Dr. TJ Owens Gilroy Early College Academy (GECA) school calendar is recommended.

c. California School Employee Association (CSEA) Chapter 69 Initial Proposal 2021-2024 Successor Negotiations (Action Item)
Quick Summary / Abstract:
Linda Figone, President, California School Employee Association (CSEA), will present the unit's proposal for reopener bargaining for the school years of 2021-2024.
Rationale:

The California School Employees Association and its local Chapter 69 (CSEA) are submitting their initial bargaining proposal for the 2021-2024 reopener negotiations in accordance with Section 3547 of the Government Code.

CSEA respectfully submits the initial bargaining proposals for the school years of 2021-2024:

  • Article 5: Evaluation procedures
  • Article 9: Compensation and Work Year
  • Article 10: Health and Welfare Benefits
  • Article 12: Vacations and Holidays
  • Article 17: Transportation Procedures
  • Article 28: Term of Agreement

CSEA has an interest in removing outdated items from the parties' collective bargaining agreement and reserves the right to open any other article during the parties' upcoming successor negotiations.

A copy of the initial proposal is attached.



 
Financial Impact:
The fiscal impact cannot be determined at this time.
Recommended Motion:
It is recommended that the GUSD Board of Education approve the initial proposal as presented so that the negotiation process can begin.

d. NEW Service Agreement with Community Solutions for the 2021-2022 School Year (not to exceed $72,075) (Action Item)
Quick Summary / Abstract:

Board approval is requested for the service agreement with Community Solutions for the 2021-2022 school year. The service agreement is to provide a part-time social worker to provide crisis response support for the Gilroy Unified School District. Additionally, the social worker will work in collaboration with the District's School Resource Officer(s) (SRO's) and site administration to support sites and provide on-going trainings to both staff and students.

Rationale:

Community Solutions is committed to improving the mental health and emotional well being of students and the community. The addition of the part-time social worker will assist the District in providing an efficient and comprehensive response to crisis situations in collaboration with the District School Resource Officer(s) (SRO's).





 
Financial Impact:
The total service agreement amount is not to exceed $72,075. This will be funded from ESSR funds.
Recommended Motion:
Approval of the service agreement with Community Solutions and the Gilroy Unified School District is recommended.
