G.6. APPROVE AND ENTER INTO SERVICE AGREEMENT WITH ALLIANCE TOWING

As part of the District's efforts to reduce unsafe and inappropriate behavior in the high school parking lots, the parking permit policy has been updated. Part of the progressive discipline steps in the parking policy is violators will be towed, as allowed by the California Vehicle Code 2658. Notification of the policy change has been posted on the high school website and through the school's messaging systems. District staff contacted three local towing companies and Alliance Towing provides the best option for the District. Cost of the towing will be borne by the owner of the towed vehicle.

G.7. APPROVE AND ENTER INTO AGREEMENT WITH DANNIS WOLIVER KELLEY FOR PROFESSIONAL LEGAL SERVICES

The District wishes to enter into an agreement with Dannis Woliver Kelley (DWK) to once again provide the District professional legal services. DWK has over four decades working together with California school and community college districts. Included in the Scope Of Services, DWK (Attorney) is appointed to represent, advise, and counsel the District from July 1, 2019, through and including June 30, 2020, and continuing thereafter as approved. Any services performed during the period between the above commencement date and the date of Board action approving this Agreement are hereby ratified by said Board approval. Attorney agrees to prepare periodic reviews of relevant court decisions, legislation, and other legal issues. Attorney agrees to keep current and in force at all times a policy covering incidents of legal malpractice. The District, as a client, shall be truthful with Attorney, cooperate with Attorney, keep Attorney informed of developments, perform the obligations it has agreed to perform under this Agreement, and pay Attorney bills in a timely manner.
Financial Impact:
Costs will be billed to the department that requests legal services.

G.8. APPROVE WILLIAMS UNIFORM COMPLAINT QUARTERLY REPORT

The Change Orders identified were directed by the owner to correct discrepancies in the original survey and on-site conditions, add sinks to comply with pre-school licensing requirements and to satisfy requirements determined by DSA after the project had received DSA plan approval and awarded the construction contract. Grading elevations needed to be adjusted, which then required adjustments in the height of the electrical work in order to provide electrical to the modular units. Additionally, DSA Inspector required some change in the concrete slab configuration to allow for increased ventilation. There were additional labor and material associated with these changes, and parties have negotiated a reasonable price for the work performed. The General Contractor has lowered their Overhead & Profit (OH&P) from the contract agreement of 15% to 5% as a measure of good faith. ensure insure

I.1. DIVISION OF STATE ARCHITECT (DSA) REQUEST FOR QUALIFICATIONS (RFQ)

Staff will be issuing a Request for Qualifications (RFQ) for Division of State Architect (DSA) certified inspection services. Evaluation criteria will be based on various factors listed within the RFQ. Additionally, staff reserves the ability to interview qualified applicants prior to recommending approval by the Board of Trustees. Once the final selection of recommended applicants is approved by the Board of Trustees, the District will reserve the right to contract for services in a manner that most benefit the District.
I.2. BOARD POLICY 7211 - DEVELOPER FEES (FIRST READING)

The PRJUSD Board of Trustees recently passed Resolution No. 19-19, increasing statutory school fees imposed on new residential and commercial/industrial development projects pursuant to Education Code Section 17620. Since the updated statutory school fees became effective July 15, 2019, staff would like to update the pertinent Developer Fees Board Policy 7211. Attached is the red-lined policy for review and comment. Administrative Regulation (AR)7211 has also been attached for reference. BP 7211 is tentatively scheduled to come back on the next Board of Trustees Agenda for approval.

I.3. EIR PROCEDURES AND ADMINISTRATOR TRAINING

The current district practice for Emergency Incident Report (EIR) completion and distribution is attached. The intent is to keep district administration abreast of any situations which have arisen on a district site which necessitated the appearance of emergency vehicles on the campus. Its use may, as appropriate, be extended to other incidents which need to be reported to the District Office. Current protocol as indicated on page 2 is for the Superintendent to forward to the Board of Trustees any EIR reports necessary to keep the Trustees abreast of any incidents about which parents or community members may be concerned and in turn ask the Board to explain. Distribution of the EIRs may also assure the Board their policies and directives are being followed. Typically, this involves a student disciplinary matter or the appearance of emergency vehicles and/or law enforcement other than an SRO on the campus. Distribution of the EIRs has not included individual student, non-disciplinary incidents such as students being transported by non-marked vehicles for confidential purposes. Training on the EIR protocol was provided to new administrators on August 26, 2019.
