NOTICE is hereby given that an online meeting of the Paso Robles Joint Unified School District (PRJUSD) will be held at 6:00 p.m., April 28, 2020. Closed Session for this meeting, not available to the public, will be held at 5:30 p.m. PRJUSD is taking all necessary steps to prevent and mitigate the effects of COVID-19 on our community. Therefore, in the interest of public health, and in compliance with California Governor Gavin Newsom’s recently issued Executive Orders N-25-20 and N-35-20, the California State Public Health Officer’s Order, including social distancing guidelines and avoiding group gatherings, the “Shelter-in-place” Order issued by San Luis Obispo County, and all applicable provisions of federal and state law, this Board meeting will be held online. All Board members, staff, and others presenting at the meeting will be calling in via the Zoom video conferencing platform from separate locations. Unfortunately, physical attendance by the public cannot be accommodated given the current circumstances and the need to ensure the health and safety of the members, staff, and the public as a whole; however, PRJUSD is making significant efforts to ensure public participation during this Board meeting. Public Comment will be read by the Deputy Superintendent at the meeting. To provide Public Comment, please do so in advance by emailing 450 words or less to: info@pasoschools.org. Please note on the email if the comment is for closed session items, a specific item on the agenda in open session, or a comment for an item NOT on the agenda. Public Comments will be accepted via email until 4:00 p.m., April 28, 2020. No more than 20 minutes total of Public Comment will be accepted for any one item, therefore, the comments read will be in the order received, up to 20 minutes. On March 13, 2020, the Board agreed that emergency conditions exist at schools and offices in the district and granted the authorization to the Superintendent needed to take any and all necessary actions to prepare and respond effectively to the novel coronavirus (COVID-19). On March 24, 2020, the Board adopted Resolution No.20-13, which included extending the closure of Paso Robles Joint Unified Schools indefinitely. On April 17, 2020, The San Luis Obispo County Health Department extended the Shelter-at-Home order through May 16, 2020, and will continue to review the order every 14 days. The closure of Paso Robles Joint Unified Schools has been extended to at least the date of May 16, 2020. If the San Luis Obispo County Health Department, on or about May 1, 2020, announces that they are extending the Shelter-at-Home order beyond May 16, 2020, then the district will immediately announce that schools are closed through the end of the school year, June 4, 2020. If the San Luis Obispo County Health Department, on or about May 1, 2020, announces that the Shelter-at-Home will be lifted on or about May 16, 2020, then the district will take steps to determine if it is feasible to reopen schools on or about May 18, 2020 - June 4, 2020. PRJUSD will continue its distance learning program throughout this entire period of time, ensuring students continue their education.

On April 1, 2020, District staff was notified by the FPPC that the 2018 biennial notice to reflect whether or not the District’s Conflict of Interest Code is current and accurate has not been received. Under the Political Reform Act (the “Act”), multi-county agencies are required to adopt a Conflict of Interest Code, which identifies all agency officials and employees who make or participate in making governmental decisions. A multi-county agency is required to review its Conflict of Interest Code each even-numbered year and, if amendments are necessitated by changed circumstances, submit an amended Conflict of Interest Code to the code reviewing body. Staff has provided the most recent suggested Board Bylaw and Exhibit, per the California School Boards Association (CSBA).

The project's scope of work is part of a grant from the San Luis Obispo County Air Pollution Control District (APCD) (Project Number AB617-1718-03). District staff notified all applicable contractors on the District's CUPCCAA list, and eleven contractors attended the mandatory bid walk on March 30, 2020. On the bid due date, April 7, 2020, four bids were received. District staff found the lowest bidder to be responsive and responsible. A bid recap is attached for review.

By adopting this resolution, Paso Robles Joint Unified School District will have the opportunity to participate in the California School Cash Reserve Program sponsored by California School Boards Association Finance Corporation. Through participation in the Cash Reserve Program, we will be able to issue tax and revenue anticipation notes (TRANS). TRANS are short-term debt instruments issued by a school district to create an additional cash reserve to the general fund. The reserve acts as a cushion to the general fund in the event we experience temporary cash flow problems. We issue a tax-exempt note and the proceeds from the sale are invested in a taxable investment. This may result in a positive spread between the borrowing rate and the investment return on the TRANS proceeds.

J.8. CONSIDERATION AND ACTION REGARDING THE PETITION TO ESTABLISH THE ALMOND ACRES CHARTER ACADEMY CHARTER SCHOOL UNDER THE AUTHORIZATION AND OVERSIGHT OF THE PASO ROBLES JOINT UNIFIED SCHOOL DISTRICT

The Petition for the establishment of Almond Acres Academy Charter School (“Petition”) under the District’s authorization and oversight was submitted to the District on March 2, 2020. Pursuant to Education Code section 47605, subdivision (b), on March 24, 2020, the District’s Board held a public hearing on the provisions of the Petition, at which time the Board considered the level of support for the Petition by teachers employed by the District, other employees of the District, and parents/guardians. Per the current version of Education Code section 47605, the Board shall either grant or deny the Petition within 60 days of receipt, or within 90 days if extended with mutual consent of the petitioners. The petitioners and District mutually agreed that the Board’s decision whether to grant or deny the Petition will be agendized for action at this April 28, 2020, meeting. Education Code section 47605 and applicable regulations set forth the legal requirements for the establishment of charter schools. Per the current version of Education Code section 47605 (operative through June 30, 2020), the Board may not deny the Petition unless it makes written factual findings, specific to the particular Petition, setting forth facts to support one or more of the following findings: 1. The charter school presents an unsound educational program for the students to be enrolled in the charter school. 2. The petitioners are demonstrably unlikely to successfully implement the program set forth in the Petition. 3. The Petition does not contain the number of signatures required by Education Code section 47605 subdivision (a). 4. The Petition does not contain an affirmation of each of the conditions described in Education Code section 47605 subdivision (e). 5. The Petition does not contain reasonably comprehensive descriptions of all 15 elements specified in Education Code section 47605. 6. The Petition does not contain a declaration of whether or not the charter school shall be deemed the exclusive public employer of the employees of the charter school for purposes of the Educational Employment Relations Act. The District’s staff, with assistance from legal counsel, analyzed the Petition and supporting documents submitted with the Petition for legal sufficiency, along with information regarding the petitioners’ current and past history of involvement with the operation of the existing Almond Acres Charter Academy under the authorization of the San Miguel Joint Union School District. Based on that comprehensive analysis, numerous deficiencies in, and concerns related to, the Petition and the proposed charter school’s operations have been identified and it has been determined that more than one of the legal grounds for denial exist. Specifically, the petitioners are demonstrably unlikely to successfully implement the proposed education program, and the Petition does not provide a reasonably comprehensive description of several essential charter elements. The specific factual and legal grounds supporting denial are set forth in the Findings in Support of Denial included in the attached Staff Report. The existing Almond Acres Charter Academy operating under the authorization of the San Miguel Joint Union School District has a current renewal charter term running through June 30, 2022, and will be able to continue its operations under that authorization regardless of whether the Board denies the Petition for the establishment of the new proposed Charter School.
