8.A. Budget Adoption 2020-21
Minutes:
Assistant Superintendent Wendy Zhang and the MUSD Business Services Team, which includes Director Linh Le, Supervisor Duc Vu and Accountant Lilia Cortes, led the 2020-21 Budget Study presentation. They explain that MUSD has a proposed balanced budget for the 2020-21 school term despite the COVID-19 impact and the cuts to education by Governor Newsom. MUSD will shift about $15 million in reserve funds to help balance its 2020-21 budget.

MUSD’s 2020-21 budget estimates $127.7 million in expenditures, and $125.8 million in revenues. A major factor is about $7 million less in Local Control Funding Formula (LCFF) funds from what MUSD received from the state for the current school year. LCFF funds make up 70 percent of the district’s revenues.

The June 9 budget study session includes cost projections for: Staffing; Enrollment/ADA; Retirement (STRS and PERS); Special Education; Student; Nutrition; Child Development Center; Adult Educational nd Multi-Year Projection Scenarios.

Minutes:
CDC Report: Coordinator Gerardo Lopez and his CDC team shared an update on the Child Development Centers, at both Rose and Sunnyhills, which did not skip a beat in educating MUSD’s youngest students as the County Shelter in Place came into effect in mid-March. By maintaining 100 percent engagement from its students, CDC received full reimbursement from the State for services, as well as an additional $75,000 for its continued education throughout the school year. Staff developed packets and schedules for their students; supplied students with crayons, scissors and glue; scheduled packet pickups; created at YouTube Channel, with videos of circle time, exercises, and other age-relevant content; created an app for parents to access lessons on digital devices; and hosted bi-weekly Google Hangouts to engage their students.

Business Services: Assistant Superintendent Zhang shares that Student Nutrition Department had a successful review from the State Department of Education. We received no findings this year.

Human Relations: Assistant Superintendent Brunson shares that HR staff has been supporting COVID-19 Task Force; he attended virtual Mattos open house; and that it was an honor to march on Sunday afternoon to support Black Lives Matter in Milpitas.

Learning & Development: Assistant Superintendent Rodriguez shares that received a letter of commendation from County Office of Education and certificates from Assemblymember Kansen Chu's Office for Parwinder Johal, Raul Pettino, Edgar Aguilar-Cheverria for their collaborative work and advocacy work for bilingual multicultural learners. Also, TK enrollment is looking healthy and to date we have 113 students fully enrolled.

Trustee Ngo: Thanks his board colleagues for their community involvement; has been attending SCC School Board Association weekly meeting; participating in digital equity coalition for elected members; attending Milpitas Rotary meetings; attending MUSD Team Hall; watched Rancho 8th Grade Promotion video; attended County Elected Officials call; and marched for Black Lives Matter in Milpitas.

Trustee Tsai: Attended a lot of same events Ngo talked about; calling into County Elected Officials meeting; reading about Reopening Plans; joined the SCC School Boards Association meeting; watched Sinnott graduation; joined the MUSD Team Hall; and marched for Black Lives Matter in Milpitas.

Clerk Yip-Chuan: Was a panelist for discussion on Impact of COVID-19 in Milpitas; attended Chamber of Commerce meeting and Mattos virtual open house; watched Spangler and Burnett talent shows; attended Burnett and Randall graduations; watched virtual Rancho graduation; attended Sunnyhills breakfast meeting; volunteered with Second Harvest Food Bank drive-through distribution; distributed 250 facemarks to Randall families and others, and is working on another large order; and marched for Black Lives Matter in Milpitas.

Vice President Norwood: Defers due to time.

President Lien: Participated in events stated by Trustee Ngo and Clerk Yip-Cuan; met with County Superintendent and City officials; and attended the Seniors Award Night.

19.A. COVID19 Advisory Task Force 2020-21: MUSD EducatEveryWhere Draft Plans & Considerations
Quick Summary / Abstract:

Superintendent Jordan and the MUSD COVID19 Advisory Task Force 2020-21 present considerations, scenarios, and direction for phasing in the new school year.  The Advisory Task Force is compromised of representatives from elementary, middle, and high school, district operations teams.  Leaders of the Classified School Employees Association,Chapter 281,  Milpitas Teachers Association, and Milpitas Management Association have been integral participants in the Task Force.  The Task Force reviewed surveys from parents, students, and team members as well as suggested considerations and ideas for planning.  The scenarios and information presented tonight was developed with that in mind. 

In order to assure that as many voices are included in the planning process as possible, an additional community and parent survey was opened on June 2nd and closes at midnight on June 9th.  Subcommittees are forming and will focus on details of the overall planning through the mid-point of July. 

The County Public Health Department Officers in conjunction with the Santa Clara County Office of Education have announced that a more definitive path to in-person teaching and learning will be publicized by July 1st.

Demographic expert Tom Williams has conducted enrollment studies for MUSD for over 20 years, and his projections have been extremely accurate with a less than 1% margin of error. 

Mr. Williams will present a summary of the data that he has compiled in determining how and in what areas of Milpitas our enrollment is climbing as well as decreasing. 

The report will provide district staff with data for staffing and program planning.

Rationale:

BACKGROUND:

Article 23 (Completion and Duration of Agreement) of the 2017-2020 Collective Bargaining Agreement (CBA) between the District and the Milpitas Teachers Association (MTA) provides that the term of the CBA is up to and including August 31, 2020. Therefore the entire CBA is open for negotiations over a successor contract.  The District is proposing to open negotiations over the following articles: Article 5 Compensation, Article 6 Hours, Article 7 Transfers, Article 8 Class Size, Article 9 Evaluations, Article 13 Leaves, Article 14 Safety, Article 17 Releases from Contract, Article 19 Security and Employee Rights, Article 24 Adult Education Teachers, as in the attached communication from Assistant Superintendent of Human Relations, Jonathon Brunson.

In accordance with Board Policy 4143.1, Public Notice Policy for Collective Bargaining and State Bargaining Law, a public hearing on the MUSD “sunshine proposal” to open collective bargaining with MTA will be held at the June 9, 2020 meeting of the Milpitas Unified School District Board of Education meeting at 7:00 PM.                             

A notice of public hearing on the MUSD “sunshine proposal” to open negotiations with MTA has been posted on bulletin boards at all school sites and the District Office.

20.C. Adopt Resolution 2020.39 Authorizing the Issuance of 2020-21 Tax and Revenue Anticipation Notes and Requesting the Board of Supervisors of the County of Santa Clara to Issue Said Notes

Rationale:

BACKGROUND:

The Milpitas Unified School District (the “District”) currently projects that it will experience a cash flow shortfall during fiscal year 2020-21 created by timing differences between its anticipated expenditures and estimated receipt of revenues.  Resolution No. 2020.39 being presented to the Board of Education authorizes a short-term borrowing by the District to address this cash flow shortfall through the issuance of tax and revenue anticipation notes (“TRANs”).

(a) TRAN Resolution.  The resolution authorizes the issuance of the TRANs by the District in an amount not-to-exceed Thirteen Million Dollars ($13,000,000), specifies certain basic terms, parameters and form of the TRANs, and approves the form of the Note Purchase Contract and Preliminary Official Statement described below.  In particular, Section 1 of the Resolution establishes the maximum aggregate principal amount of the TRANs to be issued ($11,000,000).  Section 7 of the Resolution states the maximum underwriting discount (0.350%) with respect to the TRANs and authorizes the TRANs to be sold at a negotiated sale to the underwriter named in the Purchase Contract (the “Underwriter”).

Pursuant to the resolution, the District is requesting that the Santa Clara County Board of Supervisors issue the TRANs on behalf of the District.  Proceeds of the TRANs will be deposited in the general fund of the District and used to finance projected cash flow deficits. 

(b)  Form of Note Purchase Contract.  The Resolution approves the form of a Note Purchase Contract (the “Purchase Contract”) by and among the District, the County of Santa Clara and the Underwriter.  Pursuant to the Purchase Contract, the Underwriter will agree to buy the TRANs from the District.  All the conditions of closing the transaction are set forth in this document, including the documentation to be provided at the closing by various parties.  Upon the pricing of the TRANs, the final execution copy of the Purchase Contract will be prepared following this form. 

(c) Preliminary Official Statement.  The Preliminary Official Statement (“POS”) is the offering document describing the TRANs which may be distributed to prospective purchasers of the TRANs.  The POS discloses information with respect to, among other things, (i) the proposed uses of proceeds of the TRANs, (ii) the terms of the TRANs (interest rate, yield, etc.), (iii) the security for repayment of the TRANs (pledged revenues and, otherwise, the District’s general fund, as described below), (iv) District financial and operating data, and (v) absence of litigation and other miscellaneous matters expected to be of interest to prospective purchasers of the TRANs.  Following the pricing of the TRANs, a final Official Statement for the TRANs will be prepared, substantially in the form of the POS.




 
Recommended Motion:

It is recommended that the Board approve Resolution No. 2020.39.

Financial Impact:

Pursuant to the Resolution, the District will pledge a portion of the revenues expected to be received by the District during fiscal year 2020-21 to the repayment of the TRANs in an amount equal to the principal and interest due on the TRANs.  However, the TRANs will be a general obligation of the District payable from its General Fund, and to the extent pledged revenues are not available, the TRANs will be paid from other legally available moneys of the District.

20.E. Approve the proposed revision to existing Board Policy (BP) 6200 - Instruction Adult Education (Assistant Superintendent, Learning and Development)
Rationale:

Background:

Milpitas Adult Education continues to align policy and practices to establish and maintain equitable communities for all learners, it is recommended that the Board receive and review Board Policy #6200--Adult Education. 

The language in this board policy reduces the number of credits required for our adult learners to earn a high school diploma from Adult Education, as well as adjusts the courses required to better address the needs of adult learners. 

Board Policy 6200 needs to be updated to reflect new requirements

Rationale:

On June 14, 2016, the Board approved the Joint Use Agreement with the City of Milpitas regarding the use of recreational and shared parking facilities at Mattos Elementary. The City and the District wishes to update the agreement to include:

  • Adding Butterfly Gardens to the Joint Use Property
  • Adding Inclusive Playground to the Joint Use Property and allow the public to have access at all times
  • Marking 20 parking stalls in the West Parking Lot as restricted parking to allow parents 15 minutes to park and drop off their students.
  • Revising the Operations Committee to meet every three years or as needed instead of annually
  • Removing the District’s attorney from receiving a copy of all notices
  • Updating the City’s contact emails

Rationale:

On June 14, 2016, the Board approved the Joint Use Agreement with the City of Milpitas regarding the use of recreational and shared parking facilities at Mattos Elementary. This agreement allows both the District and the City to use each other’s facilities at specified times. Since the facilities are closer to completion, the District and City wish to enter into an Operation and Maintenance Agreement for the Mattos Elementary/McCandless Park facilities.

 

The Operation and Maintenance Agreement states who will be responsible for maintaining specific facilities, on-going costs (ie: utilities), and any major improvements. In summary, the District and City shall be responsible for:

20.H. Memorandum of Understanding: 2019-20 Reclassification between CSEA Chapter 281 and MUSD (Parties)
Rationale:

BACKGROUND:

Through the contractual reclassification process, the California School Employee Association (CSEA) and MUSD Collective Bargaining Agreement (CBA), the Parties agreed to update the following  job descriptions: Paraprofessional One-on-One; Paraprofessional Physical Education I;  Paraprofessional I;  Paraprofessional I-Bilingual-Non Bi-Literate; Paraprofessional II, -Bilingual: Chinese, Korean, Punjabi, Spanish, Tagalog, Vietnamese; Paraprofessional III - Computer Lab; Behavior Intervention Technician I; Behavior Intervention Technician II;  College and Career Technician; Transition Assistant; and Transition Program Counselor/Job Developer.  The Parties met several times through the CBA Reclassification Committee process. The following classifications will be placed with the following ranges as agreed on between CSEA and MUSD:

?Paraprofessional II (included in Paraprofessional I) range 12 (based on bilingual need per CBA)

Rationale:

BACKGROUND:

This past spring we gathered input from staff and parents as to which school year calendar that MUSD should follow for the coming school year(s).  MUSD staff participated in the Google survey from February through March.  School Site Councils (SSC) were also provided an opportunity to respond to this Calendar Survey. Our Google surveys gave an immediate calculation of the numerical aggregation of the survey input corresponding to the responses.

At our May and June Community Board Advisory Council (CBAC) meetings, the calendars were introduced and discussed.  Members then took them back to their respective sites for discussion and input.  The members then returned with the feedback and recommendations at our special June CBAC meeting. The following calendars are being recommended to the board for approval.

Rationale:

The purchase and adoption of this tool meets the district's LCAP goal 1 (increase academic achievement) and goal 3 (increase the academic achievement of the less advantaged) as well as being CAASPP and CAST aligned.  The effective use of iReady facilitated teachers’ collaboration across grade levels and in grade level teams to plan instruction and personalize learning.

 Curriculum Associates will provide ongoing support via customized professional development for district staff in order to develop capacity at the district level to support our schools

Rationale:

BACKGROUND:

Notre Dame de Namur University wishes a partnership with Milpitas Unified School District to provide Education Specialist and Teaching Interns.

The interns may be hired through the Human Relations Office.  Under the collaborative work with a university supervisor and a district  mentor, the interns will be provided support to achieve competency in the Teaching Performance Expectations.

The agreement would be in effect as follows:

Rationale:

BACKGROUND:

Notre Dame de Namur University wishes a partnership with Milpitas Unified School District to place student teachers.

The student teachers will be assigned to practice teaching through the Human Relations Office.  Under the direct supervision and instruction of the master teachers, the student teachers will be provided teaching experience and training through practice teaching in our schools and classes.

The agreement would be in effect as follows:

Rationale:
On March 24, 2020, the Board approved the Lease-Leaseback Amendment #2 for the total GMP cost of Mattos Elementary Phase II. Section 4.2.7 of the amendment refers to the lease payment schedule. On Amendment #3, the interest amount was recalculated to reflect the correct interest rate that was listed in the amendment. The District has the ability to buyout the lease no earlier than 60 days after project completion, which will save the District almost $60,000 in interest payments.

21.I. Approval of Add Service Request for Base Landscape Architecture at Rancho Middle School (Assistant Superintendent, Business Services)
Rationale:
The Board had previously awarded a contract to Base Landscape Architecture for the design of the track at Rancho Middle School.  After completion of the site survey it was determined that the existing field had more slope than anticipated.  This triggered the need to level the site.  To do so the contractor will need to take soil from the high side of the area and transfer it to the low side.  The result of this is that the area where the field meets the existing asphalt playground will have an approximate two-foot drop.  The two-foot elevation change will require additional design to ensure compliance with the Division of State Architect access compliance rules. Concrete ramps and steps will need to be constructed.  This additional design is outside of Base’s original scope of work.

21.K. Approve Purchase and Installation of New Digital Scoreboard for Milpitas High School Existing Gym
Rationale:

The current scoreboard in the MHS gym is extremely old and no longer serves the intended purpose.  The MHS Athletics Department obtained three quotes for scoreboards that they believed would provide what they needed.  Ultimately they chose Digital Scoreboards LLC’s digital display system as the best-suited system for their program.  The proposal includes the removal of the old scoreboard system as well as the installation of the new system.
