SUBJECT: Resolution #20-039 Resolution to Establish Temporary Inter-Fund Transfers 


BACKGROUND INFORMATION

Education Code Section 42603 provides that the governing board of any school district may direct monies held in any fund or account to be temporarily transferred to another fund or account of the district for payment of obligations.  The transfer shall be accounted for as temporary borrowing between funds or accounts and shall not be available for appropriation or be considered income to the borrowing fund or account.  Amounts transferred shall be repaid either in the same fiscal year or in the following fiscal year if the transfer takes place within the final 120 calendar days of a fiscal year.  Borrowing shall occur only when the fund or account receiving the money will earn sufficient income, during the current fiscal year, to repay the amount transferred.  No more than 75 percent (75%) of the maximum money held in any fund or account during a current fiscal year may be transferred.

This Resolution is intended for the FY 2019-20 only and will be exercised only if the need arises.

SUBJECT:  Resolution #20-040 in Support of Distance Learning Options for BUSD Students 

BACKGROUND INFORMATION:

On March 12, 2020, the Berkeley Unified School District (BUSD) announced the closure of all Berkeley public schools effective March 16, with a potential return date of April 6, 2020. On March 16, 2020, a Shelter-in-Place Order was issued by the City of Berkeley and six Bay Area counties, to take effect until at least April 7, 2020.  On March 17, Governor Gavin Newsom stated that it is likely that many California schools will remain closed for the remainder of the 2019-20 school year.

Whereas the initial school closure in BUSD had envisioned a two week hiatus (followed by one week of Spring Break), during which Home Learning Resources could be provided to support student learning, the quickly evolving situation is pointing toward a much longer closure. With this resolution, the Berkeley Unified School District Board of Education directs the Superintendent and staff to work toward expanding the remote learning educational program to support both staff and students for what may be a significantly longer duration of school closure.
