In response to the COVID-19 pandemic, Governor Newsom issued Executive Order N-29-20, which temporarily suspends provisions of the Brown Act relating to public meetings. As such, Elk Grove Unified School District Board members will be conducting this open session board meeting via Zoom video/teleconferencing.

The Board of Education is requested to adopt Resolution No. 71, that designates May 2020 as Asian Pacific American Heritage Month. |
Asian Pacific American Heritage Week began in 1978 when President Jimmy Carter signed a Joint Resolution designating this as an annual celebration. In May of 1990, the holiday was expanded further when George H. Bush designated May to be Asian Pacific American Heritage Month. May was chosen to commemorate the immigration of the first Japanese to the United States on May 7, 1843, and to mark the anniversary of the completion of the transcontinental railroad on May 10, 1869. The majority of workers who laid the tracks were Chinese immigrants. Throughout the year, the contributions of Americans with Pacific Rim heritage are presented in the regular curriculum; however, this special focus for one month serves as a reminder of the combined contributions of this group. We celebrate such individuals as Dr. David Ho, a leader in the field of HIV/AIDS research, and Maya Lin, an artist who is best known for designing the most visited public artwork of the 20th century, the Vietnam Veterans Memorial in Washington, D.C.

The Board is asked to adopt Resolution No. 72, 2019-20, establishing specifications of the November 3, 2020, governing board member election and approve the Publication of Notice of Election, Notice of District Election, and Certification of Maps and Boundaries. |
The Education and Elections Codes grant authority for the specifications of the governing board member election order to the governing board and require the resolution to be delivered to the Registrar of Voters and Superintendent of Schools no later than July 6, 2020. The recommended resolution establishes the date of the election as November 3, 2020; the purpose of the election being to elect four members; the candidate's statement of qualifications being limited to 200 words; the candidates being responsible for the pre-payment of the cost of preparing and distributing their statements or materials other than the sample ballot and voter's pamphlet; and the consolidation of the election with the Statewide General Election. The nomination period is July 13 through August 7, 2020. |

Under state law, the District’s surplus funds are deposited in the County Treasury (unless the District takes special measures to become fiscally independent) with the exception of legally authorized commercial bank accounts (such as Revolving Fund) and proceeds of debt issuances, which may be placed with a trustee. All of the funds of the Elk Grove Unified School District are invested with the Treasury of the County of Sacramento. These funds are in the commingled Treasurer’s Pool with that of other public agencies. This includes all of the school districts within Sacramento County. As of December 31, 2019, the District had $242,474,767 from all funds, in addition to Mello-Roos Investment proceeds of $8,669,458 and General Obligation Bond Investment proceeds of $41,338,056 for total proceeds of $50,007,514 in the County Treasurer’s pool. This is 6.66% of the total pooled assets of $4,390,056,625. The County of Sacramento, Department of Finance recommends that the Board receive and file the attached Sacramento County Annual Investment Policy of the Pooled Investment Fund - Calendar Year 2020. Your action to receive and file the policy constitutes consideration at a public meeting as required by Government Code Section 53646 (a)(2). The investment policy is also available on the Department of Finance, Investment Division web page at www.finance.saccounty.net/investments. |

The Board of Education is asked to (1) approve an option for a one-year extension to the Lease Agreement with Bartholomew Associates at the Elk Grove Shopping Center to continue the use for the Technology Services, Research and Evaluation, Special Education, and Education Services departments; and (2) authorize Susan Bell, Chief Facilities Officer, Facilities and Planning to finalize and execute the 2020-2021 Lease extension on behalf of the District.

On June 7, 2001, the Board of Education approved the Lease Agreement to lease property from Bartholomew Associates at the Elk Grove Shopping Center to continue the use for the Technology Services, Research and Evaluation, and Special Education Departments. The value of this lease and lease rates provides a significant benefit to the District and the support of Bartholomew Associates continues to be a great community partnership.
At this time Administration wishes to extend the lease for an additional one (1) year pursuant to the extension provisions in the original lease while all other terms of the original agreement remain intact for 2020-2021. Over the last several years Administration has been successful in negotiating a reduced rate below the rate increases identified in the original agreement resulting in significant savings. |

The Board of Education is asked to ratify CMAS contract with FieldTurf USA, Inc. for synthetic turf surfacing and W2W Sport for track surfacing at Cosumnes Oaks, Elk Grove, Monterey Trail, Sheldon and Valley (track surface, only) High Schools. |
In 2009 synthetic turf was installed at the Cosumnes Oaks, Elk Grove, Monterey Trail, and Sheldon High School football fields. Additionally, Mondo track surfacing was installed at each of the sites and Valley High School’s track. Since installation, the fields and tracks have received numerous hours of play and as a result, have begun to show wear and now need extensive repair and/or replacement. The Facilities staff consulted with experts from both Field Turf and Mondo to evaluate the conditions to determine the extent and feasibility of the needed repairs. Based upon the recommendations of the materials experts and given the fact that the warranty period for Field Turf and Mondo track surfacing is eight and ten years, respectively, replacement of both the track and turf materials appears to be the best course of action. Verde Design has been selected as the architect to prepare design and construction documents for approval of the new materials installation through the Division of the State Architect. To facilitate the installation, purchase of the turf and track materials via the California Multiple Award Schedules (CMAS) administered by the California Department of General Services is the next step to be taken. CMAS offers a wide variety of commodities and products at very competitive pricing and will ensure fair pricing to the District and avoid unnecessary mark up by the Contractor. The District has previously adopted standards for Synthetic Turf and All Weather Track, which were utilized on the previous Synthetic Turf and All Weather Track projects. These standards remain relevant and continue to be industry standards. After extensive research and evaluation, Administration has determined that synthetic turf manufactured by FieldTurf and track surfacing manufactured by Mondo and distributed by FieldTurf USA, Inc., and W2W Sport., respectively, will best serve the need of the Elk Grove Unified School District. Importantly the synthetic turf infill consists of a natural cork material and as such does not contain crumb rubber from recycled tires or any other of the potentially hazardous materials which the media have highlighted for its use synthetic turf installations outside of the District. We are proud that our selection will ensure the continued safety of our students and community who utilize our artificial turf fields. In order to capitalize on significant price savings Administration is using the CMAS process. CMAS pricing can be extremely beneficial for public entities and is very competitive. CMAS also allows public entities to negotiate prices below the CMAS listed price. In this case, the district has negotiated a significant savings well below the CMAS public pricing. Administration requests the Board of Education to ratify contracts with the following companies to provide all-weather turf and track materials at Cosumnes Oaks, Elk Grove, Monterey Trail, Sheldon, and Valley (track only) High Schools: - FieldTurf USA, Inc, using CMAS Contract No., in the amount of $3,119,694.00 to provide and install synthetic turf; and
- W2W Sport using CMAS Contract No. 4-16-78-0079A, in the amount of $3,675,000.00 to provide and install all-weather track surfacing.
The total price of materials for the Synthetic Turf and Track projects equals $6,794,694.00. |

Pursuant to Education Code Section §39521, the Board of Education is asked to authorize Bobbi Hew, Interim Director of Purchasing & Warehouse to surplus and/or dispose of these items. All computers have been deemed uneconomical to repair by the Technology Services Department. Per Technology Services, all sensitive data and/or licenses have been removed from hard drives prior to being picked up from the department/site. To date, we have had no interest from local non-profits requesting computers that could be refurbished and redistributed to students of need. Since most usable parts are removed prior to disposal, these items are of little use. Records of these items are in the Purchasing & Warehouse Department should you need to review them. This project is the new Fire Academy at Valley High School located at 6300 Ehrhardt Avenue, Sacramento, CA 95823. The project consists of a new two-classroom modular building, an educational structure to house the program's fire engine and emergency response vehicle and the related sitework to support the program. The contract also includes construction of restroom and path of travel improvements required to facilitate accessible connections between the project and other areas of the campus and to meet accessible code requirements. The Administration has engaged the Boldt Company to determine a Guaranteed Maximum Price (GMP) utilizing Lease Leaseback (LLB) to complete the Fire Academy and Path of Travel work for Increment III.

The Board is requested to approve the renewal of the fee for service agreements between Elk Grove Unified School District and Maxim Healthcare Services, Inc and 24/7 MedStaff. In addition the Board is requested to approve the award of two new contracts fee for service agreements between Elk Grove Unified School District and Rx HealthCare Services and Ro Health, Inc. These four agencies will be providing additional healthcare staffing for medically fragile students for the 2020-2021 school year. |
Each company has unique strengths and areas of expertise. In order to provide maximum flexibility and to meet the increasing needs of the Elk Grove Unified School District students, awarding the RFP to all four agencies will best meet the needs of the district. All four firms have met the evaluation criteria for RFP# 673-19/20. Currently, the Elk Grove Unified School District has 166 children who are classified as "medically fragile." The law requires that the school districts provide safe and appropriate care throughout the school day. The agency staff from these agreements supplement district employees that provide the same services (Health Assistants and School Nurses), as student enrollment with medical needs increase. These services include, but are not limited to: monitoring children with seizures; monitoring of diabetes including monitoring blood glucose levels and administering insulin; monitoring and providing healthcare services for conditions of pituitary, adrenal and immune system disorders; monitoring blood oxygen levels; administering medications; rectal administration of Diastat for seizures; injections of epinephrine via epi-pen for severe allergic reactions; tracheostomy care; gastrostomy care and tube feeding through the abdomen to deliver nutrition; ostomy monitoring and care, catherterization and more. Contracting with staffing agencies allows for rapid expansion and contraction of staff to meet the fluctuating and unpredictable health care needs of students. They allow EGUSD Health Services to provide mandated and immediate healthcare services (documented by Doctor orders and in consultation with the district school nurses) with pre-screened, qualified staff with the licensing legally required to provide specific care and/or procedures. It also allows the immediate reduction of staff when students leave the district or only need specialized health care services for a short-term, thus limited costs for temporary assignments. |

The agreements have been reviewed and approved as to form and content by Elk Grove Unified School District, Fiscal Services Department and meet all E.G.U.S.D. criteria. The "fee for service" contracts allow greater flexibility of staff and provide services when needed; funding is provided by Special Education and the General Fund based on the percentage of time each agency staff person serves each student based on the student's program - special education or regular education (including those with Section 504 plans). Costs for healthcare staffing range based on student needs, number of students (expansion and contraction) and length of services.

On March 3, 2020, bids were opened in the Office of Purchasing at 2:00 p.m. One (1) vendor responded. The bid results and recap are in the Purchasing Department for further review. The administration recommends the award of the contract for E-RATE NETWORK EQUIPMENT to the following vendor: VENDOR AMOUNT CDW-G $ 444,182.64 This bid will be used to replace aging and failing core network routing equipment at a number of school sites and to upgrade the core routing equipment at the district sites to accommodate increased bandwidth. As this equipment will be eligible for E-rate discounts, the final cost to the district will be reduced from the amount listed above by approximately 80%. |

The Board is also requested to review and approve the 2019-2020 Self-Assessment Summary and 2020-2021 Self-Assessment Plan of Action as part of the entire five-year grant for the Head Start Program.

Annually, salaries are negotiated by each of the Unions in the Elk Grove Unified School District. The original agreement between the Unions and the School District for the 2019-2020 school year did not include a Cost of Living Adjustment (COLA) for salaries which is most likely the same for the 2020-2021 school year. Professional growth is essential for staff to keep up to date with trauma-informed practices and social emotional well-being of participants in the preschool field. The Quality Improvement (QI) Funding will be used to train staff in the area of Conscious Discipline as well as in the area of music to help students with self-regulation, relationship skills, decision-making skills, self-awareness, and social awareness and aid in addressing childhood trauma. Grantees may apply for a COLA increase of 2% of the base funding level. COLA funds will be used to increase fringe benefits. Grantees may apply for a QI Funding of $117, 040. QI funds will be used to support staff to be able to obtain professional learning on trauma-informed practices and in the area of music which may aid in addressing childhood trauma. The 2% COLA and $117, 040 QI Funding will increase Elk Grove’s Head Start Basic Grant by $184,146. The COLA and QI Funding must be approved by the Elk Grove Unified School District’s Board of Education to become effective. In addition, the 2019-2020 Self-Assessment Summary and the 2020-2021 Self-Assessment Plan of Action are required to be approved by the Elk Grove Unified School District’s Board of Education. |

The Board is asked to 1) conduct a public hearing to receive oral and written comments regarding the adjustment to the school facilities fees, 2) close the public hearing, 3) review, consider and adopt the findings contained in Resolution No. 66, 2019-20 and Resolution No. 67, 2019-20 approving the February 2020 Development Fee Justification Study/School Facilities Needs Analysis and the increased Level 1 Fee for commercial development and the increased Level 2 and Level 3 Fees for residential development identified therein.

Pursuant to Education Code Section 17620, Government Code Section 65995, and Government Code Section 66016 et seq. the District is required to adopt a Development Fee Justification Study in order to levy the increased statutory (“Level 1”) school fees on commercial/industrial development recently approved by the State Allocation Board. Pursuant to Education Code Section 17620 and Government Code Sections 65995 et seq., the District is also required to adopt a School Facilities Needs Analysis ("SFNA") in order to justify the levy of alternative school fees ("Level 2 Fees” and “Level 3 Fees") on new residential development. The February 2020 combination Development Fee Justification Study/SFNA, prepared by Odell Planning & Research, Inc., demonstrates that the District can impose $6.34 per square foot in Level 2 Fees and $12.69 per square foot in Level 3 Fees on new residential construction and justifies the District charging the statutory Level 1 commercial school fee of $0.66 per square foot. Prior to adopting the Development Fee Justification Study/SFNA, the Board must conduct a public hearing and respond to any comments it receives.
This proposed Level 2 fee of $6.34 per square foot of new residential construction represents a 6.7% increase of $0.40 from the current $5.94 fee. The major contributing factors to the proposed increase are higher site acquisition and site development costs, increased State construction cost allowances, and a reduction in the District’s average home size. Based upon the proposed increased Level 2 fee and the smaller average new home size within our District, the Level 2 assessment for a newly constructed single family home will increase on average $786.
Level 3 fees are collected only in the event that the State Allocation Board (SAB) is no longer apportioning funds for new construction, and the SAB has notified the Secretary of the Senate and Chief Clerk of the Assembly, in writing, of the determination that such funds are no longer being allocated.
The District’s February 2020 Development Fee Justification Study/SFNA is attached. The study was sent to all four local Planning Departments on March 6, 2020, and was made available for public review beginning on, March 20, 2020, as required by law. In addition to the public noticing required by law, staff contacted a representative from the North State Building Industry Association (BIA) to discuss the fee study.
It is recommended that the Board conduct a public hearing and review, consider, and adopt the findings contained in Resolution No. 67, 2019-20 and Resolution No. 68, 2019-20 approving the February 2020 Development Fee Justification Study/ School Facilities Needs Analysis and adopting the increased Level 1 Fee for commercial and industrial development and the increased Level 2 and Level 3 Fees for residential development identified therein.

Administration has been asked by Sacramento Area Sewer District to convey without cost a 20-foot wide Public Utilities Easement for Sewer Purposes along the southern boundary of James Rutter Middle School. A 10-foot wide Sewer Easement at this same location was granted to the Sacramento Area Sewer District many years ago. At this time the Sacramento Area Sewer District is requesting a 20-foot easement encompassing the existing 10-foot easement to provide area for maintenance and future sewer expansion if necessary. The allowable uses in the new easement area will be the same as existing easement (lawn, ground cover, small shrubs) and should cause no new inconvenience to EGUSD and be maintained in the same manner as the current 10-foot easement.
Staff recommends acceptance of the Sacramento Area Sewer District’s request that the easement be conveyed since it will be of public benefit and cause no inconvenience to EGUSD. Exhibit A: Public Utilities Sewer Easement of .51 acre The Board of Education adopted Resolution No. 55, 2019-2020, Resolution of Intention to Convey a Public Utility Easement on March 3, 2020, and notice was duly posted and published for this public hearing as noted below. As required for the granting of such easements, the notice of this public hearing was published in the Sacramento Bee on Thursday, March 5, 2020, and posted in three public locations: James Rutter Middle School, Southgate Community Library, and at the Robert L. Trigg Education Center. The Resolution Granting Permanent and Temporary Easements must be adopted by a 2/3 vote by the Board. |
