Quick Summary / Abstract:

In response to the COVID-19 pandemic, Governor Newsom issued Executive Order N-29-20, which temporarily suspends provisions of the Brown Act relating to public meetings. As such, Elk Grove Unified School District Board members will be conducting this open session board meeting via Zoom video/teleconferencing.

Zoom Online Meeting Platform

Zoom is an online meeting platform that will be used by the Elk Grove Unified School District Board of Education during the current State social distancing and shelter at home order. Those who wish to view the meeting will need an internet connection and device. Zoom is compatible with Windows and Apple computers, along with iPhones, iPads, Chromebooks and Android devices. The device must have working speakers to hear the meeting.

Rationale:

During the 2019-2020 school year, the Board of Education has been apprised of academic, co-curricular, and extra-curricular activities, as well as special programs and events, through the excellent, informative, and enthusiastic reports delivered by our Student Board Representatives.

As Board representatives, these students have spoken on behalf of their peers and their schools, and have served as valuable liaisons between their classmates and school district administration.

Unfortunately, due to the COVID-19 pandemic, which has temporarily suspended public meetings, Student Board Representatives were unable to finish out the school year with their board reports.  To honor and recognize these students, the Board will be shown a presentation to honor and recognize the 2019-2020 Student Board Representatives.

D.III.1. 2020 LGBTQ Pride Month Resolution

The Board of Education is asked to adopt Resolution No. 77, which proclaims the month of June 2020 as LGBTQ Pride Month, to honor and highlight the identities and contributions of EGUSD LGBTQ students, staff and families.

Rationale:

Elk Grove Unified School District celebrates the accomplishments of LGBTQ people, and works to create a respectful, caring and inclusive culture for all within the school district and community. Pride month will provide an opportunity to combat bullying, harassment and discrimination based on real or perceived sexual orientation, gender identity and gender expression. By recognizing Pride Month, the District supports other policies, practices, and curricula that honor and respect LGBTQ students, staff, and their families.

The Board is asked to approve Resolution No. 78, to allow cash transfers between funds as necessary to meet District financial obligations.

Rationale:

As a result of the COVID-19 pandemic, the State has proposed deferring the our final June, 2020 Local Control Funding Formula apportionment and has extended the when residents can file their property taxes from April to July.  Food & Nutrition meal reimbursement has also be negatively impacted with the closure of schools.

Due to the projected cash shortfall the attached resolution will provide the District flexibility to transfer cash between funds as needed to ensure all funds end the fiscal year June 30, 2020, with positive cash balances. 

We currently anticipate the following funds to have a negative cash balance as of June 30, 2020:  General Fund (Fund 01), Child Development (Fund 12) and Food & Nutrition Services (Fund 13).

D.VI.8. Quarterly Investment Report

Recommended Motion:

The Board is asked to receive a quarterly report of investments.

Rationale:

Under state law, the District’s surplus funds are deposited in the County Treasury (unless the District takes special measures to become fiscally independent) with the exception of legally authorized commercial bank accounts (such as Revolving Fund) and proceeds of debt issuances, which may be placed with a trustee.  All of the funds of the Elk Grove Unified School District are invested with the Treasury of the County of Sacramento.  These funds are in the commingled Treasurer’s Pool with that of other public agencies.  This includes all of the school districts within Sacramento County.

As of March 31, 2020, the District had $275,076,062 from all funds, in addition to Mello-Roos Investment proceeds of $12,429,879 and General Obligation Bond Investment proceeds of $32,183,848 for total proceeds of $44,613,727 in the County Treasurer’s pool.  This is 6.77% of the total pooled assets of $4,244,416,758.

 
Financial Impact:

The surplus funds of the District are conservatively managed by the County Treasury.  We are confident that the funds are now and will continue to be available upon demand to satisfy District needs.

D.VI.9. Ratification of Contracts for Services

The Board is asked to ratify contracts for services that have been signed by authorized district staff in accordance with Board Policy 3312-Contracts.
Rationale:

Under current Board Policy 3312 “contracts under the bid limits can be approved by the Designated Personnel, subject to Board ratification.  Amendments to contracts, including construction contract change orders both under and over bid limits, may be approved by the Designated Personnel, subject to Board ratification.”  Staff recommends that the Board ratify the contracts on the attached sheet, which are under the bid limit of $95,200 and have been approved by authorized district staff.

Copies of the contracts are on file with Finance & School Support should you wish to review them in detail.

D.VI.15. Tiger Natural Gas, Inc. Purchase Agreement Renewal

The Board is asked to approve the Natural Gas Purchase Agreement Renewal between the Elk Grove Unified School District and Tiger Natural Gas, Inc. for the 2020-2021 school year.

Rationale:

Historically the District has purchased its natural gas from a third party provider in an effort to reduce the District’s expenditures for natural gas.  This is not an uncommon practice, in lieu of purchasing gas from the local utility, in our case Pacific Gas & Electric (PG&E).  In these arrangements, the public entity purchases gas at a reduced rate from a third party below that of the local utility.  The District then pays for the transportation of that gas through the local utility’s infrastructure.  This has proved to be advantageous for the District and Administration seeks to continue this arrangement.  This arrangement has saved the District thousands in General Fund dollars annually when compared to PG&E rates and over the course of time has saved the District well over $1,100,000.

Staff is proposing that the District utilize a fixed rate should market changes occur Staff will conduct routine market reviews to determine whether or not the District should remain at a variable rate or a fixed rate.

 
Financial Impact:

The purchase of natural gas is included in the 2020-2021 budget.  Savings will vary based on PG&E’s rate compared to Tiger Natural Gas, Inc.



D.VI.16. Pleasant Grove Elementary School Modernization Lease-Leaseback (LLB) Agreement

Recommended Motion:

The Board of Education is asked to (1) Authorize Administration to negotiate with F&H Construction to perform the Pleasant Grove Elementary School Modernization project to determine a Guaranteed Maximum Price (GMP).

Rationale:

On April 1, 2020, and April 8, 2020, the District released a Request for Qualifications and sealed general condition cost proposals to perform pre-construction and/or LLB construction services for the Pleasant Grove Elementary School Modernization project.  On May 1, 2020, the District received seven (7) responsive qualifications.

Contractors submitted Statement of Qualifications and sealed proposals that will form the basis of negotiations for a Guaranteed Maximum Price (GMP) in an LLB agreement.  District staff reviewed and scored the proposals to determine the contractors’ ability to deliver the project on time and to assure the best value to the District would be achieved.  Based upon the results, F&H Construction was determined to be the contractor who would provide the best value to the District for the construction of the Pleasant Grove Elementary School Modernization project.  With the Board’s authorization, administration seeks authorization to negotiate a GMP with F&H Construction and to enter into an LLB agreement to complete the Pleasant Grove Elementary School Modernization project.

Upon completion of the GMP, Administration will present to the Board for review and acceptance of the GMP with F&H Construction.

D.VI.17. Joseph Kerr Middle School Modernization - Phase 1A, Lease-Leaseback Agreement

Recommended Motion:

The Board of Education is asked to (1) Approve a Guaranteed Maximum Price of $21,648,460.00 for the construction of the Joseph Kerr Middle School Modernization (Phase 1A) project, and (2) Authorize the Administration to sign all documents necessary for a Lease-Leaseback Agreement with F&H Construction.

Rationale:

In March 18, 2020, and March 25, 2020, the District issued a Request for Qualifications (RFQ) seeking a general contractor to provide Lease-Leaseback (LLB) construction services for the Joseph Kerr Middle School Modernization (Phase 1A) project. In response to the RFQ, eight (8) responsive qualification statements and sealed proposals that would form the basis of negotiations for a Guaranteed Maximum Price (GMP) were received. 

District staff scored the qualifications and proposals to determine contractors’ ability to deliver the project on time and to assure the best value to the District. Based upon the results, F&H Construction was determined to be the general contractor who would provide the best value to the District for the construction of the Joseph Kerr Middle School Modernization (Phase 1A) project.

On May 19, 2020, the Board authorized Administration to negotiate with F&H Construction to determine a GMP and, subsequent to that authorization, F&H Construction solicited bids from qualified subcontractors seeking quotes from all trades for the construction of the Joseph Kerr Middle School Modernization (Phase 1A) project.

Quotes received from subcontractors were reviewed and evaluated by District and F&H Construction staff for completeness and to assure the best value to the District. Upon tabulation of subcontractor bids, a total GMP for the project of $21,648,460.00 was determined.  Accordingly, District administration seeks authorization to enter into an LLB Agreement with F&H Construction to construct the Joseph Kerr Middle School Modernization (Phase 1A) project for the GMP of $21,648,460.00.

Rationale:

D.VI.19. 2020-21 Annual Master Contract for Nonpublic Agencies and Nonpublic Schools

Recommended Motion:
The Board of Education is requested to approve the 2020-21 Elk Grove Unified School District annual master contracts for Nonpublic Agencies (NPA) and Nonpublic Schools (NPS).
Rationale:

The Board of Education is requested to approve the master contracts of the Nonpublic Agencies and Nonpublic Schools for the 2020-21 school year. Each year, the district meets with representatives from NPS/NPA to negotiate hourly or daily rates. This negotiation begins each March for the ensuing school year. The master contract does not specify a predetermined, fixed amount. Rather, it indicates the hourly or daily rate for each NPS/NPA. Rates are set by the district.

It is important to note the annual NPS/NPA expenditures paid to a given provider may vary considerably from year to year. This is due to needs of students which are legally defined in a student's Individualized Education Plan (IEP). All services rendered to date are required to meet our current students' needs.

The Board will receive information about the process being used to develop the educational plan for the 2020-21 school year. 
Rationale:
The Board is receiving information and asked to provide feedback on the process being used to develop the District’s 2020-2021 educational plan. The process takes into consideration the COVID-related health and safety conditions. A questionnaire will be sent to parents in mid-June to gather essential information needed for plan development. This is a lead up to the DRAFT educational plan that will be presented to the Board for approval on June 30. Once approved the plan will be communicated to students and families.

D.XIII.1. Tentative Agreement Between Elk Grove Unified School District and National Union of Healthcare Workers (NUHW), 2019-2020 thru 2020-2021

Recommended Motion:

The EGUSD Board President should announce and open the public hearing with a request for anyone who wishes to speak to the NUHW Tentative Agreement to please come forward.  After listening to any speakers, the Board President should close the public hearing.  After closing the public hearing, the Board should be asked to take action to approve (ratify) the Tentative Agreement.



Rationale:
The Tentative Agreement has been ratified by a vote of the NUHW members.  The Tentative Agreement extends the current NUHW collective bargaining agreement through June 30, 2021 with 2020-2021 school year reopeners. It also updates the probationary section to comport with current law, includes a leave provision included in other existing labor agreements, and completes negotiations for the 2019-2020 school year. 

The EGUSD Board should be asked to approve (ratify) the attached 2019-2020 through 2020-2021 NUHW Tentative Agreement.  There is no impact from this NUHW Tentative Agreement on the District’s budget. Therefore, the AB 1200 process is inapplicable.

D.XIII.2. Elk Grove Charter School Petition to Renew Charter

Recommended Motion:

The Board of Education is asked to conduct a public hearing on the Elk Grove Charter School’s petition to renew its charter.

Rationale:

The Elk Grove Charter School (EGCS), a dependent charter of the Elk Grove Unified School District (EGUSD), is seeking to renew its petition for a fourth time. EGUSD initially authorized EGCS in 1999, and the petition was renewed in 2005, 2010, and 2015. Each petition is approved for five years.

In accordance with Board Policy and California Education Code, the Board is asked to conduct a public hearing about renewing the EGCS petition.

The following personnel have been involved in the development of this petition:

  • Superintendent – Christopher Hoffman
  • Associate Superintendent, Human Resources – David Reilly 
  • Assistant Superintendent, Secondary Education – Craig Murray
  • Chief Financial Officer – Shannon Hayes
  • EGCS Principal – Marc LaVine
  • EGCS Advisory Council, Teachers, and staff

Principal Marc LaVine will make a recommendation for action to the Board at the June 30 Board Meeting.

 
Financial Impact:
There is no fiscal impact on EGUSD. EGCS operates a budget in Fund 9 that is based on charter school apportionment.

The Board of Education is requested to hold a public hearing for anyone who wishes to comment on Elk Grove Unified School District’s Special Education Local Plan Area (SELPA) plan. 
Rationale:

The Elk Grove Unified School District’s Special Education Local Plan Area (SELPA) is required annually to develop and revise a SELPA plan.  The SELPA plan includes a description of all the special education services provided by the SELPA, the nature of those services, and the physical location of those services.  The SELPA plan also identifies expected expenditures for all items required by the SELPA’s service delivery plan.

This item will be presented to the Board for adoption at the June 30, 2020 meeting.

 Board of Education is requested to review and approve the revised 2020-21 School Year Calendar.


Rationale:

 The attached revised 2020-21 School Year Calendar has been negotiated with the Elk Grove Educators Association (EGEA), as stipulated in the EGUSD/EGEA collective bargaining agreement.  The 2020-21 School Year Calendar is presented to the Board for their consideration and approval.  The revision includes an adjustment to the Elementary year-round calendar, and allows for additional time for the planning of the 2020-21 school year due to the COVID-19 pandemic.

Note:  An update was made to the Revised 2020-21 School Year Calendar attachment.  The modified traditional winter break dates were revised to the previously approved calendar.
