A. NOTICE: INFORMATION FOR VIRTUAL BOARD MEETING
Quick Summary / Abstract:

In response to the COVID-19 pandemic, Governor Newsom issued Executive Order N-29-20, which temporarily suspends provisions of the Brown Act relating to public meetings. As such, Elk Grove Unified School District Board members will be conducting this open session board meeting via Zoom video/teleconferencing.

Zoom Online Meeting Platform

Zoom is an online meeting platform that will be used by the Elk Grove Unified School District Board of Education during the current State social distancing and shelter at home order. Those who wish to view the meeting will need an internet connection and device. Zoom is compatible with Windows and Apple computers, along with iPhones, iPads, Chromebooks and Android devices. The device must have working speakers to hear the meeting.

Please note:  If Zoom is not currently installed on a computer or device, Zoom will ask to download a small app to the computer or device. Please accept the install to continue to the Zoom meeting. Zoom will only need to install the app the first time a computer or device is used with Zoom. Mobile device users can install the Zoom app prior to a meeting by visiting their app store. ZOOM Cloud Meetings is the name of the app.

The Board of Education is asked to adopt Resolution No. 20, 2020-21, recognizing November 9-13, 2020 as National School Psychology Awareness Week.
Rationale:

The National Association of School Psychologists (NASP) has designated November 9-13, 2020 as School Psychology Awareness Week. 

During the week of November 9-13, 2020, schools throughout the United States will celebrate National School Psychology Week (NSPW) to highlight the important work school psychologists and other educators do to help all students thrive. This year's theme is "The Power of Possibility." The word "possibility" implies hope, growth, resilience and renewal. Possibility suggests that even something as small as a seed can grow into something magnificent. The word "power" implies that things can and will happen. When we focus on what is possible, we have hope that students will grow, thrive and bloom.

Through social emotional learning supports and services, school psychologists empower children to grow in areas of skill such as social skills, empathy, and compassion for others, as well as individual or interpersonal skills such as problem solving, goal setting, and study skills. School psychologists are particularly skilled at assisting students and staff in seeing possibilities and developing positive change to thrive in school and life. Focusing on these possibilities can help us set goals, identify action steps, communicate needs, and engage in discussions to help create the connections necessary for students to develop critical academic and social emotional skills.

The Board of Education is asked to adopt Resolution No. 20 in support of National School Psychology Awareness Week and this year's theme of "The Power of Possibility."

D.VII.4. Certification of Administrator’s Competence to Evaluate

Recommended Motion:

The Board of Education is requested to grant Certification of Administrator’s Competence to Evaluate for the newly-hired district administrators who have successfully completed the District’s training process.

Rationale:

The District provides training to all newly-hired administrators to certify their competence to evaluate employees.  Following Education Code 35160.5, Requirement of District Policies for Competency of Personnel Assigned to Evaluate and Board Policy 4115.1, Certification of Administrator’s Competence to Evaluate, the District uses the following process to certify each administrator’s competence to evaluate:

  1. Individual instruction or attendance at a series of workshops on evaluation processes and procedures;
  2. Demonstration of effective evaluation skills as certified by a trained observer who is a certificated manager.

D.VII.5. Williams Review Annual Report

Recommended Motion:

The Board is asked to receive a report on the Williams Review Annual Report for 2019-2020 Elk Grove Unified School District from Sacramento County Office of Education dated August 14, 2020.

Rationale:

As a result of the Williams Settlement, Education Code section 1240 requires that county offices of education visit certain schools identified in their county, review information in the areas noted, and report to district the results of the visits and reviews. To conduct these reviews, during Fiscal Year (FY) 2019-2020, Sacramento County Office of Education (SCOE) staff visited 106 schools in 9 school districts within Sacramento County that ranked in deciles 1 to 3 of the 2012 Base Academic Performance Index (API) (Williams schools). The results are being provided in 9 individual school district reports to the Sacramento County Board of Supervisors, the Sacramento County Board of Education, and the governing boards of the respective school districts.

As required by Education Code section 1240(c)(2)(B), SCOE is pleased to provide the annual report for FY 2019-2020 to the Elk Grove Unified School District (District) for submission to the District's governing board at a regularly scheduled November meeting. This report also serves as the statutorily required 2019-2020 quarterly report for the fourth quarter.

D.VII.8. Quarterly Investment Report

Recommended Motion:
The Board is asked to receive a quarterly report of investments.
Rationale:

Under state law, the District’s surplus funds are deposited in the County Treasury (unless the District takes special measures to become fiscally independent) with the exception of legally authorized commercial bank accounts (such as Revolving Fund) and proceeds of debt issuances, which may be placed with a trustee.  All of the funds of the Elk Grove Unified School District are invested with the Treasury of the County of Sacramento.  These funds are in the commingled Treasurer’s Pool with that of other public agencies.  This includes all of the school districts within Sacramento County.

As of September 30, 2020, the District has $296,611,998 from all funds, in addition Mello-Roos Investment proceeds of $16,167,042 and General Obligation Bond Investment proceeds of $15,578,725 for a total of $328,357,765 cash in the County Treasurer’s pool.  This is 8.47% of the total county pooled assets of $3,876,235,097.

 
Financial Impact:

The surplus funds of the District are conservatively managed by the County Treasury.  We are confident that the funds are now and will continue to be available upon demand to satisfy District needs.

Approve Warrant Register No. 3 – Warrant Numbers 074715-075548, 410084-410684.  All Funds:  September 1, 2020 through September 30, 2020.

Rationale:

Education Code 42632 requires that all payments from the funds of a school district shall be made by written order of the governing board of the district.

It is also required that district orders (warrants) must be numbered and include the following per Education Code 42634:

  • The particular fund or funds of the district against which it is drawn
  • The amount of payment to be made
  • An itemized bill showing separate items and the price of each item (this information is retained in Fiscal Services)
  • The rate of salary and the period of service of any employee of the district for whom an order is issued for payment of salary or wages (this information is retained in the Payroll office)

D.VII.10. Developer Fee Annual Report

Recommended Motion:

The Board is asked to approve the attached Annual Report of 2019-20 Developer Fee expenditures.

Rationale:

Government Code §66006 requires that an annual report of income and expenditures from developer fees and the beginning and ending fund balances in the Capital Facilities Fund be made available to the public within 180 days after the end of the fiscal year.

Government Code §66006 also requires that the Board review this information at a later date in a public meeting.  For the convenience of the Board and the public, attached is a summary of the District’s unaudited financial records listing developer fee expenditures by site and activity, and provides other required information such as the percentage of project costs funded by the fees.                                                                                  

Any members of the public desiring more detailed information, regarding developer fees, may contact the Facilities and Planning Department.

The District remains in full compliance with all legal requirements regarding developer fees.  All fees collected relate to accommodation of new student enrollment growth, and all fees are spent within five years of receipt.

The Board is asked to ratify contracts for services that have been signed by authorized district staff in accordance with Board Policy 3312-Contracts.
Rationale:

Under current Board Policy 3312 “contracts under the bid limits can be approved by the Designated Personnel, subject to Board ratification.  Amendments to contracts, including construction contract change orders both under and over bid limits, may be approved by the Designated Personnel, subject to Board ratification.”  Staff recommends that the Board ratify the contracts on the attached sheet, which are under the bid limit of $95,200 and have been approved by authorized district staff.

Rationale:

Pursuant to Education Code Section §39521, the Board of Education is asked to authorize Bobbi Hew, Director of Purchasing & Warehouse to surplus and/or dispose of these items.

All computers have been deemed uneconomical to repair by the Technology Services Department. Per Technology Services, all sensitive data and/or licenses have been removed from hard drives prior to being picked up from the department/site.

To date, we have had no interest from local non-profits requesting computers that could be refurbished and redistributed to students of need. Since most usable parts are removed prior to disposal, these items are of little use.

Financial Impact:
No income is anticipated to be received by the district for these items.  However any income that is received will go into the General Fund.
D.VII.16. Approval to Purchase Printshop Equipment

Recommended Motion:
The Board of Education is asked to authorize the Elk Grove Unified School District Purchasing Department to purchase print shop equipment cooperatively through the U.S. Communities, Contract #4400003732.
Rationale:

Due to the COVID pandemic, an influx of signage has been necessary to produce by the District’s Printing Services to educate staff, students, and parents to social distance, wash their hands,  how to wear a face mask, how to identify the symptoms of COVID and more.  Given the size of the District and the types of signage needed, it is necessary for Printing Services to purchase an additional flatbed printer and cutter;  Ricoh EFITM Pro 24f LED flatbed printer and Colex Sharpcut Pro SX1732 flatbed cutter. In addition to speeding up the signage production time, the new equipment will also have the capabilities of fabricating sneeze guards and face shields at a fraction of the cost and time it takes to get them from an outside vendor.


Public Code Section §20118 provides a statutory exception to the competitive bidding requirements set forth in the Public Contract Code by allowing districts to utilize cooperative bids secured by other districts or public entities for the purchase of materials, supplies, equipment and services.


It is in the best interest of the Elk Grove Unified School District to utilize the contract and pricing from the U.S. Communities contract #4400003732 for the purchase of this equipment.

D.VII.17. Approval to Award Bid #692-20/21 Renewable Propane

The Board of Education is asked to authorize the award of Bid #692-20/21 for Renewable Propane.
Rationale:

Bid #692-20/21 was issued on August 21, 2020 to five (5) firms in this market. By the closing date September 24, 2020, two (2) bids were received.

The Bid results and recap are in the Purchasing Department for further review. The District recommends the award of a one (1) year contract with optional two (2), one (1) year terms, not to exceed three (3) years total. This contract will commence on November 18, 2020.

Pursuant to Education Code Section §17604, the Board of Education is asked to authorize the Director of Purchasing or designee to execute renewals, terminations (if deemed necessary), and to take other actions as necessary to uphold the contract in the best interest of the District.

Rationale:

Public Code Section §20118 provides a statutory exception to the competitive bidding requirements set forth in the Public Contract Code by allowing districts to utilize cooperative bids secured by other districts or public entities for the purchase of materials, supplies and equipment.

D.VII.22. Elk Grove High School Modernization - Lease-Leaseback (LLB) Agreement

Recommended Motion:

The Board of Education is asked to (1) Authorize Administration to negotiate with Flint Builders, Inc. to perform the Elk Grove High School Modernization project to determine a Guaranteed Maximum Price (GMP).

Rationale:

On September 4, 2020 and September 11, 2020, the District released a Request for Qualifications and sealed general condition cost proposals to perform pre-construction and/or LLB construction services for the Elk Grove High School Modernization project.  On October 16, 2020, the District received twelve (12) responsive qualifications.

Contractors submitted Statement of Qualifications and sealed proposals that will form the basis of negotiations for a GMP in an LLB agreement.  District staff reviewed and scored the proposals to determine the contractors’ ability to deliver the project on time and to assure the best value to the District would be achieved.  Based upon the results, Flint Builders, Inc. was determined to be the contractor who would provide the best value to the District for the construction of the Elk Grove High School Modernization project.  With the Board’s authorization, administration seeks authorization to negotiate a GMP with Flint Builders, Inc. and to enter into an LLB agreement to complete the Elk Grove High School Modernization project.

Upon completion of the GMP, Administration will present to the Board for review and acceptance of the GMP with Flint Builders, Inc.

Rationale:

In accordance with BP 6142.1, the following supplemental resources for Family Life Education have been reviewed and approved by the Health Steering Committee and the Comprehensive Sexual Health Education Advisory Committee (CSHEAC), are consistent with district policy, and are being submitted to the Board of Education for adoption.

Pursuant to AR 6142.1(e) updated on August 28, 2013, which states that “The Board shall approve the advisory committee's recommendations prior to implementation,” the Board of Education is asked to approve the use of the below resources for Family Life Education in the appropriate grades as indicated.

Sexual & Reproductive Anatomy and Physiology Lessons, Parts I & II (Health, Grades 9-12)

These lessons provide engaging ways for students to identify the human reproductive structures and their functions.  The lessons also include simple, black-line diagrams of the anatomy that are more complete and accurate than what are currently approved for use during CSHE.

Condom Effectiveness Fact Sheets (Health, Grades 9-12)

These fact sheets provide clear diagrams and how-to steps in order to effectively use male condoms, female condoms, and dental dams.  Dental dams are not currently part of our adopted materials; including dental dams in our curriculum provides a method of contraception that acknowledges and addresses the diverse population of students that we serve.

Construction Technology (CTE Elective, Grades 9-12) (one-year equivalent, 10 credits) This course will engage students in an instructional program that integrates academic and technical preparation and focuses on career awareness, career exploration, and skill preparation in the building trades and construction industry.  Technical preparation will include carpentry technology, use of measuring instruments, basic hand and power tools, reading blueprints, basic building systems, construction projects, and safety and first-aid procedures.

Computer Integrated Manufacturing (PLTW), Honors (CTE Elective, Grades 10-11) (one-year equivalent, 10 credits) This course is one of the specialized courses in the PLTW Engineering program.  The course deepens the skills and knowledge of an engineering student within the context of efficiently creating the products all around us.  Students build upon their Computer Aided Design (CAD) experience through the use of Computer Aided Manufacturing (CAM) software.  CAM transforms a digital design into a program that a Computer Numerical Controlled (CNC) mill uses to transform a block of raw material into a product designed by a student.  Students learn and apply concepts related to integrating robotic systems such as Automated Guided Vehicles (AGV) and robotic arms into manufacturing systems.  Throughout the course, students learn about manufacturing processes and systems.  This course culminates with a capstone project where students design, build, program, and present a manufacturing system model capable of creating a product.

The Tentative Agreement has been ratified by a vote of the CSEA members and completes all reopener negotiations sunshined by the Parties for the 2019-2020 school year. There shall be no change to any provision of the Parties’ collective bargaining agreement, except those provided in this Tentative Agreement. 

There is no impact from this CSEA Tentative Agreement on the District’s budget. Therefore, the AB 1200 process is inapplicable.
