Quick Summary / Abstract:

In response to the COVID-19 pandemic, Governor Newsom issued Executive Order N-29-20, which temporarily suspends provisions of the Brown Act relating to public meetings. As such, Elk Grove Unified School District Board members will be conducting this open session board meeting via Zoom video/teleconferencing.

Zoom Online Meeting Platform

Zoom is an online meeting platform that will be used by the Elk Grove Unified School District Board of Education during the current State social distancing and shelter at home order. Those who wish to view the meeting will need an internet connection and device. Zoom is compatible with Windows and Apple computers, along with iPhones, iPads, Chromebooks and Android devices. The device must have working speakers to hear the meeting.

Please note:  If Zoom is not currently installed on a computer or device, Zoom will ask to download a small app to the computer or device. Please accept the install to continue to the Zoom meeting. Zoom will only need to install the app the first time a computer or device is used with Zoom. Mobile device users can install the Zoom app prior to a meeting by visiting their app store. Recommended Motion:
The Board of Education is asked to adopt Resolution No. 41, 2020-21 designating March 2021 as Arts Education Month.
Rationale:

The month of March has been designated Arts Education Month by the state of California. The role of visual and performing arts in the education of all students in California schools was reaffirmed with the ‘Every Child Succeeds Act’ signed into law in 2015 by President Obama in the reauthorization of the Elementary and Secondary Education Act (ESEA).  Arts and music education are included in the definition of a ‘well-rounded’ child’s education, underscoring states’ obligation to providing arts education in the public schools.

To support this policy, the State Board has again declared March as Arts Education Month, a time to celebrate the arts in our schools.  The arts serve as a powerful tool for engaging students and educators in their schools and learning, and Arts Education Month provides districts and schools with the opportunity to focus on the value of the arts.  It also provides a vehicle by which community support for arts education can be generated.  

In addition to acknowledging and approving this resolution, the Board of Education is asked to receive a short presentation showcasing the amazing work the EGUSD students and staff created during Distance Learning.

Recommended Motion:
The Board of Education is asked to review and adopt Resolution No. 40, 2020-21 designating March 2021 as Women’s History Month.
Rationale:

The month of March has been designated Women’s History Month by the state of California. 

Per SB 48 and AR 6143, throughout the year elementary and secondary teachers use pieces of literature where women assume traditional and non-traditional professional roles.  In their classroom instruction, teachers also use novels written by female authors.  In the areas of mathematics and science, information is shared throughout the year about famous female mathematicians and scientists.  Staff members at school sites are careful to provide information about women in all roles in our society, drawing students’ attention to the noted as well as the under-represented contributions that women have provided historically and in modern times.

By designating one month with a focus on women’s history, the Board of Education has the opportunity to communicate the value of such instruction.

Rationale:

It is the goal of the Elk Grove Unified School District to prepare all of our students for success in college, career, and civic life.

Schools are a critical place for students to develop the civic knowledge, skills, and values needed to effectively participate in our democracy by having classroom instruction in government, history, law, and democracy; discussion of current events; service-learning; extra-curricular or co-curricular activities; student voice in school governance; and simulations of democratic processes. 

Based on the District’s Graduate Profile, students who engage in the community and participate in civic action gain knowledge about school, local and global issues, and are prepared to succeed in college, career, and life; the success of our Nation and State depends on educated, informed, and engaged citizens and residents.

Rationale:

Under current Board Policy 3312 “contracts under the bid limits can be approved by the Designated Personnel, subject to Board ratification.  Amendments to contracts, including construction contract change orders both under and over bid limits, may be approved by the Designated Personnel, subject to Board ratification.”  Staff recommends that the Board ratify the contracts on the attached sheet, which are under the bid limit of $95,200 and have been approved by authorized district staff.

D.VII.9. Quarterly Investment Report

Recommended Motion:
The Board is asked to receive a quarterly report of investments.
Rationale:

Under state law, the District’s surplus funds are deposited in the County Treasury (unless the District takes special measures to become fiscally independent) with the exception of legally authorized commercial bank accounts (such as Revolving Fund) and proceeds of debt issuances, which may be placed with a trustee.  All of the funds of the Elk Grove Unified School District are invested with the Treasury of the County of Sacramento.  These funds are in the commingled Treasurer’s Pool with that of other public agencies.  This includes all of the school districts within Sacramento County.

As of December 31, 2020, the District has $414,819,355 from all funds, in addition Mello-Roos Investment proceeds of $17,015,957 and General Obligation Bond Investment proceeds of $14,194,504 for a total of $446,029,816 in the County Treasurer’s pool.  This is 9.68% of the total county pooled assets of $4,607,081,544.

The County of Sacramento, Department of Finance recommends that the Board receive and file the attached Sacramento County Annual Investment Policy of the Pooled Investment Fund - Calendar Year 2021.  Your action to receive and file the policy constitutes consideration at a public meeting as required by Government Code Section 53646 (a)(2).  The investment policy is also available on the Department of Finance, Investment Division web page at www.finance.saccounty.net/investments.

 
Financial Impact:

The surplus funds of the District are conservatively managed by the County Treasury.  We are confident that the funds are now and will continue to be available upon demand to satisfy District needs.

Rationale:

Pursuant to Education Code Section §39521, the Board of Education is asked to authorize Bobbi Hew, Director of Purchasing & Warehouse to surplus and/or dispose of these items.

All computers have been deemed uneconomical to repair by the Technology Services Department. Per Technology Services, all sensitive data and/or licenses have been removed from hard drives prior to being picked up from the department/site.

To date, we have had no interest from local non-profits requesting computers that could be refurbished and redistributed to students of need. Since most usable parts are removed prior to disposal, these items are of little use.

The Board of Education is asked to (1) review the tabulation of bids, (2) award a contract to the lowest responsible and responsive bidder, (3) authorize the Administration to sign all documents and contracts pertaining to this work, and (4) authorize the Administration to proceed with the next lowest responsible bidder should a fully endorsed contract with the low bidder, accompanied by certification of the necessary bonds, not be obtained.

Rationale:

This project consists of acquisition and installation of shade structures at seven (7) school sites. The work includes accessibility improvements, construction of concrete pads, and other related site work required at the following sites:

The Administration recommends the award of contract to Abide Builders, Inc., for the total bid of $695,699.00.

D.VII.16. Laguna Ridge East Elementary School – Soils Remediation Award of Contract

The Board of Education is asked to (1) review the tabulation of bids, (2) award a contract to the lowest responsible and responsive bidder, (3) authorize the Administration to sign all documents and contracts pertaining to this work, and (4) authorize the Administration to proceed with the next lowest responsible bidder should a fully endorsed contract with the low bidder, accompanied by certification of the necessary bonds, not be obtained.

Rationale:

This project is for the future Laguna Ridge East Elementary School located at the northwest corner of Poppy Ridge Road, and Lousada Drive, Elk Grove, California and includes all activities in compliance with the Removal Action Workplan.  The total estimated in-place volume of soil to be excavated is approximately 1,000 cubic yards.

 

The Administration received and opened four (4) bids on January 29, 2021, at 2:00 p.m. Pacific States Environmental Contractors, Inc., submitted the lowest base bid (see Attachment A for tabulation of bids).  Accordingly, the Administration recommends the award of contract to Pacific States Environmental Contractors, Inc. for the total base bid of $176,900.00

D.VII.17. Elk Grove High School, Culinary Lease-Leaseback Agreement and Future Elk Grove High School Modernization Increments

Recommended Motion:

The Board of Education is asked to: (1) Approve a Lease-Leaseback Agreement with Flint Builders, Inc. for the Elk Grove High School Modernization Project (“Project”); and (2) Approve a Guaranteed Maximum Price (GMP) of $4,971,796.00 for the construction of the Culinary Building, the first increment of the Project, and (3) Authorize the Administration to negotiate future GMP(s) for the remaining increments of the Project.

Rationale:

On September 4, 2020, and September 11, 2020, the District issued a Request for Qualifications (“RFQ”) seeking a general contractor to provide Lease-Leaseback (LLB) construction services for the Elk Grove High School Modernization Project (“Project”).  The Project will be constructed in multiple phases or increments, starting with the construction of a Culinary Building. In response to the RFQ, fourteen (14) responsive qualification statements and sealed proposals were received, forming the basis of negotiations for a Guaranteed Maximum Price (“GMP”). 

District staff scored the qualifications and proposals to determine the contractors’ ability to deliver the Project on time and to assure the best value to the District. Based upon the results, Flint Builders, Inc. was determined to be the general contractor who would provide the best value to the District for the construction of the Project.

On November 17, 2020, the Board authorized the Administration to negotiate with Flint Builders, Inc. to determine a GMP on the first increment of the Project, the Culinary Building, and subsequent to that authorization, Flint Builders, Inc. solicited bids from qualified subcontractors seeking quotes from all trades for the construction of the Culinary Building.

Quotes received from subcontractors were reviewed and evaluated by the District and Flint Builders, Inc. staff for completeness and to assure the best value to the District. Upon tabulation of subcontractor bids, a total GMP for the first increment of the Project (the Culinary Building) of $4,971,796.00 was determined.  Accordingly, the District administration seeks authorization to enter into the LLB Agreement with Flint Builders, Inc. to construct the Elk Grove High School, Modernization Project and approve the GMP for the first increment of $4,971,796.00.

Additionally, the District administration seeks authorization to negotiate the GMP(s) for the remaining increments as each are approved by the Division of State Architect (DSA) and present each GMP for approval at future dates.

Rationale:

The purchase of the IPads is to support the academic, speech and language, occupational therapy assessments.

There is a need for two IPads per assessor to allow us to utilize Q-Interactive and the digital library of assessments. We are purchasing approximately 3 sets per site to be shared by the special education teachers and occupational therapists with some additional sets to provide 1 to 1 sets for the Speech Therapists. The IPads will allow for assessments to be given utilizing appropriate social distancing because the assessor sets up the assessment on the IPad for the student and they are able to respond utilizing the Q-Interactive System at a safe distance.

In addition to supporting during the COVID-19 pandemic it will also allow assessors to have access to the stimulus books without having to share materials as well as being able to utilize the assessments at the same time. This will aid us in the future financially because we will need to purchase fewer paper response and scoring booklets as well as fewer Kits.

Culinary Chemistry (Course #04202) (Science, Grades 10-12)

It is requested that the pre-requisite(s) be changed to “Biology of the Living Earth and completion of or concurrent enrollment in Mathematics I” from the current pre-requisites of “General Science, Biology, and Mathematics I with a grade of C or better and concurrent enrollment in Mathematics II or higher-level math course.”

Rationale: All NGSS science courses have a math requirement of Mathematics I.  This course should be aligned with the other NGSS courses.  Also, mostly sophomores take this course due to the current science course sequence, where all freshman take biology.  Additionally, Culinary Biology is a deactivated course; instead, Biochemistry of Foods is offered for a junior/senior course to meet the graduation requirements.

 

Principles of Mechatronics (Course #12339) (CTE Elective, Grade 10)

It is requested that the grade-level be changed from “Grade 10” to “Grades 10-11.”

Rationale: This course is a CTE concentrator course for the Innovative Design & Engineering Academy (IDEA) at Pleasant Grove High School.  Because of the course selection limitations due to PGHS’s traditional school schedule, it is desired for students to have the option to take this class either their 10th or 11th grade year so CTE pathway completers are not lost because they could not take the course their 10th grade year.  This will also allow for greater flexibility for pathway access to our special population students such as English Learners and Special Education students who often need to postpone academy classes for a year due to required support classes.  Finally, this will help with EGUSD’s CBEDS pathway alignment as this course will replace the current 11th grade class.

Rationale:

California Montessori Project – Elk Grove seeks to renew its charter petition. The Governing Board initially received the petition via Board Communication and conducted a public hearing on February 2, 2021, consistent with timelines described in Education Code.

On February 5, 2021, at the conclusion of an organized and thorough review of the petition by EGUSD staff, a Staff Report was posted in accordance with new legislation as outlined in AB 1505.

On February 23, 2021, Elk Grove Unified School District Assistant Superintendent Craig Murray and College and Career Connections Director Jane Ross request a Public Hearing to take action on the request to renew the CMP- Elk Grove charter.   Based on findings, EGUSD staff recommends that the Board approve CMP – Elk Grove’s request to renew its charter through June 30, 2026.
