In response to the COVID-19 pandemic, Governor Newsom issued Executive Order N-29-20, which temporarily suspends provisions of the Brown Act relating to public meetings. As such, Elk Grove Unified School District Board members will be conducting this open session board meeting via Zoom video/teleconferencing.

Zoom Online Meeting Platform

Zoom is an online meeting platform that will be used by the Elk Grove Unified School District Board of Education during the current State social distancing and shelter at home order. Those who wish to view the meeting will need an internet connection and device. Zoom is compatible with Windows and Apple computers, along with iPhones, iPads, Chromebooks and Android devices. The device must have working speakers to hear the meeting.

Please note:  If Zoom is not currently installed on a computer or device, Zoom will ask to download a small app to the computer or device. Please accept the install to continue to the Zoom meeting. Recommended Motion:

The Board of Education is requested to adopt Resolution No. 58, that designates May 2021 as Asian Pacific American Heritage Month.

Rationale:

Asian Pacific American Heritage Week began in 1978 when President Jimmy Carter signed a Joint Resolution designating this as an annual celebration.  In May of 1990, the recognition was expanded further when George H. Bush designated May to be Asian Pacific American Heritage Month.  May was chosen to commemorate the immigration of the first Japanese to the United States on May 7, 1843, and to mark the anniversary of the completion of the transcontinental railroad on May 10, 1869.  The majority of workers who laid the tracks were Chinese immigrants.

Throughout the year, the contributions of Americans with Pacific Rim heritage are presented in the regular curriculum; however, this special focus for one month serves as a reminder of the combined contributions of this group.

The celebration of the Asian Pacific American community is important now more than ever given the rise of anti-Asian sentiment nationwide due to xenophobia and racism related to the global COVID-19 health pandemic.

In support of this resolution, we will be offering a variety of events and activities in which students and families can engage, as well as an Educator Workshop on the History of Anti-Asian Laws that is scheduled for May 4th. In addition, there will be opportunities to explore the resilience of many groups within the AAPI community and celebrate their contributions to the political, economic and social development of the United States.

The Board is requested to approve Resolution 61, 2020-21, recognizing May 4, 2021 as Day of the Teacher in the Elk Grove Unified School District.

Rationale:

Thousands of communities will take time out on Tuesday, May 4, 2021 to honor their local educators and to acknowledge the contributions they make to our lives.  While it certainly takes many people to make a school succeed, National Teacher Day focuses on the teachers who work to make public schools great places for students to succeed in life.

The Elk Grove Unified School District Board of Education is asked to approve the attached resolution.

Public Comment on Items on the Agenda or Not on the Agenda

Anyone interested in providing public comment to the Elk Grove Unified School District Board of Education on any item that is within the Board's subject matter jurisdiction should complete a public comment form. However, the Board may not take action on any item not on this Board meeting agenda except as authorized by Government Code section 54954.2. Anyone may also submit public comments to the Board in support of or in opposition to any item being presented to the Board for consideration.

Requests for public comment must be received by 4:30 p.m. the day of the meeting to allow for sorting and organization of speakers by Board meeting agenda topic.  Please be sure to complete the public comment form indicating the item you wish to address and whether it will be read by a staff member or if you would like to speak live via Zoom during the board meeting.  The total amount of time allocated for public comments to the Board will be limited to a maximum of three (3) minutes, with a total of thirty (30) minutes designated for public comment on an item. Time limitations are at the discretion of the President of the Board of Trustees. 

For live public comment, you must be online and prepared to speak when your name is called upon. Your name will be called during the applicable agenda item, and in the Zoom session, a pop-up will open, asking you to unmute your microphone. Once you click on the unmute button, the Board will be able to hear you. At the end of your time limit, your microphone will be muted. You must be using the latest version of Zoom to make your live public comment. If you are not up-to-date with the Zoom platform client, you may be skipped during public comment periods due to technical difficulties.

The Board of Education is requested to grant Certification of Administrator’s Competence to Evaluate for the district administrator who has successfully completed the District’s training process. 
Rationale:

The District provides training to all newly-hired administrators to certify their competence to evaluate employees.  Following Education Code 44662, Requirement of District Policies for Competency of Personnel Assigned to Evaluate and Board Policy 4115.1, Certification of Administrator’s Competence to Evaluate, the District uses the following process to certify each administrator’s competence to evaluate: 

  1. Individual instruction or attendance at a series of workshops on evaluation processes and procedures;

  2. Demonstration of effective evaluation skills as certified by a trained observer who is a certificated manager.

Rationale:

Education Code 42632 requires that all payments from the funds of a school district shall be made by written order of the governing board of the district.

It is also required that district orders (warrants) must be numbered and include the following per Education Code 42634:

  • The particular fund or funds of the district against which it is drawn
  • The amount of payment to be made
  • An itemized bill showing separate items and the price of each item (this information is retained in Fiscal Services)
  • The rate of salary and the period of service of any employee of the district for whom an order is issued for payment of salary or wages (this information is retained in the Payroll office)

Rationale:

Under current Board Policy 3312 “contracts under the bid limits can be approved by the Designated Personnel, subject to Board ratification.  Amendments to contracts, including construction contract change orders both under and over bid limits, may be approved by the Designated Personnel, subject to Board ratification.”  Staff recommends that the Board ratify the contracts on the attached sheet, which are under the bid limit of $95,200 and have been approved by authorized district staff.

.VI.10. Elk Grove High School, Phase 2 – Increment #1 Site Utilities Lease-Leaseback Agreement Amendment

The Board of Education is asked to: (1) Approve a Lease-Leaseback Amendment with Flint Builders, Inc. for the Elk Grove High School Modernization Project – Phase 2 (“Project”); and (2) Approve a Guaranteed Maximum Price (GMP) of $3,936,801.00 for the construction of Site Utilities, Phase 2 of the Modernization Project.

Rationale:

On February 23, 2021, the Board approved the Administration to enter into a Lease-Leaseback (LLB) agreement with Flint Builders, Inc for construction services for the new Culinary Arts Building as the first phase of the Elk Grove High School Modernization Project (“Project”), as well as authorized the Administration to negotiate the GMP(s) for the remaining increments or phases as each approved by the Division of the State Architect (DSA).  Because the Project will be constructed in multiple phases or increments, this Board Agenda Item requests authorization to enter into a LLB Agreement Amendment for the GMP for Phase 2 – Increment #1 Site Utilities, for the Project. 


Flint Builders, Inc. solicited bids from qualified subcontractors on February 16, 2021 and March 25, 2021 seeking quotes from all trades for the construction of the Site Utilities.


Quotes received from subcontractors were reviewed and evaluated by the District and Flint Builders, Inc. staff for completeness and to assure the best value to the District. Upon tabulation of subcontractor bids, a total GMP for the second phase of the Project (Site Utilities) of $3,936,801.00 was determined.  Accordingly, the District Administration seeks authorization to enter into the LLB Agreement Amendment with Flint Builders, Inc. to construct the Phase 2 – Increment #1 Site Utilities, for the Project, and approve the GMP of $3,936,801.00.

.VI.11. Valley High School, Fire Academy & CTE/POT Inc#3 - Change Order No. 1

Rationale:

On April 21, 2020, the Board of Education approved a Guaranteed Maximum Price utilizing Lease Leaseback to The Boldt Company for the Valley High School, Fire Academy project.  Change Order No. 1 consists of one (1) item.  The complete amendment with backup is on file in the Facilities and Planning Department for review.

Attachment 2 provides detailed information on distribution of amendment requests between Contractor and District.  Change Order No. 1 changes the contract amount of $2,660,779.00 by ($52,004.00) to $2,608,775.00.

.VI.12. Valley High School, Fire Academy & CTE/POT Inc#3 - Acceptance and Notice of Completion

The Board of Education is asked to (1) accept the construction of the Valley High School, Fire Academy project, and (2) authorize the filing of the Notice of Completion.

Rationale:

On April 21, 2020, the Board of Education awarded a contract to The Boldt Company for Valley High School, Fire Academy & CTE/POT Inc#3 project. The work has been completed and is recommended for acceptance by the Architect.

 

The Administration will file the Notice of Completion with the County Recorder within the statutory ten-day period.

.VI.13. Approve Option of One-Year Extension to the Lease Agreement with Bartholomew Associates for a Portion of Elk Grove Shopping Center

The Board of Education is asked to (1) approve an option for a one-year extension to the Lease Agreement with Bartholomew Associates at the Elk Grove Shopping Center to continue the use for the Technology Services, Research and Evaluation, Special Education, and Education Services departments; and (2) authorize Susan Bell, Chief Facilities Officer, Facilities and Planning to finalize and execute the 2021-2022 Lease extension on behalf of the District.
Rationale:

On June 7, 2001, the Board of Education approved the Lease Agreement to lease property from Bartholomew Associates at the Elk Grove Shopping Center to continue the use for the Technology Services, Research and Evaluation, and Special Education Departments.

 

The value of this lease and lease rates provides a significant benefit to the District and the support of Bartholomew Associates continues to be a great community partnership.

 

At this time Administration wishes to extend the lease for an additional one (1) year pursuant to the extension provisions in the original lease while all other terms of the original agreement remain intact for 2021-2022.  Over the last several years Administration has been successful in negotiating a reduced rate below the rate increases identified in the original agreement resulting in significant savings.

.VI.15. Approval to Award RFP #679-20/21 – Merv 13 Air Filters

Rationale:

RFP #679-20/21 was issued on January 15, 2021 to twenty three (23) firms in this market. By the closing date, February 4, 2021, five (5) proposals were received.

 

The RFP results and recap are in the Purchasing Department for further review. The District recommends the award of a one (1) year contract, with the option, upon mutual agreement, to extend any resulting agreement for two (2) additional one (1) year terms. This contract will commence on July 1, 2021.

 

Pursuant to Education Code Section §17604, the Board of Education is asked to authorize the Director of Purchasing or designee to execute renewals, terminations (if deemed necessary), and to take other actions as necessary to uphold the contract in the best interest of the District.

.VI.16. Approval of Head Start Cost of Living Funding Application for 2021-22 School Year

The Board of Education is requested to approve the 1.22% Head Start Cost of Living (COLA) funding application for the 2021-2022 school year.

Rationale:

Employee benefits are calculated based upon each employee’s salary and include retirement benefits. The EGUSD fiscal department projects a 3% increase to Health and Welfare and 2.3% for PERS.

Head Start grantees may apply for a COLA increase of 1.22% of the base funding level. COLA funds will be used to increase fringe benefits.

The 1.22% COLA will increase Elk Grove’s Head Start Basic Grant by $43,181.00.

The COLA must be approved by the Elk Grove Unified School District’s Board of Education to become effective.

 
Financial Impact:
There is no cost to the district, however, this increases the amount of the original contract by $43,181.00.

The following new high school courses and update to an existing high school course have undergone review and approval by the appropriate subject-area steering committee(s), the EGUSD Curriculum Council, and have the support of principals.

NEW COURSE REQUESTS:

American Sign Language II (World Language, Grades 9-12) (one-year equivalent, 10 credits) In this course, students will learn the language by watching (receptive skills) and responding (expressive skills), increasing their abilities acquired from ASL I.  Students will learn to use the language through continuous exposure to both receptive and expressive ASL.  Students will continue to learn to sign about themselves and others, requests, opinions, and storytelling.  The class will be conducted using the target language and will expose students to Deaf Culture and the Deaf Community to be able to communicate appropriately and effectively about the various Level II topics.

IT Support Specialist (CTE Elective, Grades 11-12) (two-year equivalent, 20 credits) This year-long, 20-credit course prepares students for careers in computer technical support.  Students have the opportunity to gain the Google IT Support Professional Certificate along with additional cybersecurity skills through Project Lead the Way Cybersecurity curriculum.  Students will also participate in Essential Skills and Application Skills training to learn how to navigate the workplace and obtain employment.

Biology of the Living Earth, Newcomer English Learner (EL Science, Grades 9-12) (one-year equivalent, 10 credits)

This laboratory course provides English learners in a Newcomer Program a foundation for the biological and earth sciences.  Topics include ecosystem interactions and energy, history of Earth’s atmosphere, evidence for evolution, inheritance of traits, structure and function, and ecosystem stability, and the response to climate change.  This course integrates ELD standards-based instruction to include a focus on academic vocabulary, expository writing, and expository reading of science texts.  (See NGSS Performance Expectations & Disciplinary Core Ideas.)  Instructors use a variety of scaffolded instructional techniques focusing on listening, speaking, reading, and writing to address the specific needs of Newcomer English Learners.  This course emphasizes developing conceptual models through asking questions, analyzing data, designing and carrying out experiments, and designing solutions to real-world situation.

Physics of the Universe, Newcomer English Learner (EL Science, Grades 10-12) (one-year equivalent, 10 credits)

This laboratory course addresses the relationships of physics in the universe for English learners in a Newcomer Program.  Emphasis is on observing phenomena, gathering and interpreting data, developing models, discovering graphical and mathematical relationships, and engineering and refining solutions to realistic problem scenarios.  This course integrates ELD standards-based instruction to include a focus on academic vocabulary, expository writing, and expository reading of science texts.  (See NGSS Performance Expectations & Disciplinary Core Ideas.)  Instructors use a variety of scaffolded instructional techniques focusing on listening, speaking, reading, and writing to address the specific needs of Newcomer English Learners.  This course includes units on motion and forces, energy conversions, waves and electromagnetic waves, nuclear processes, and stellar processes.

UPDATE/REFRESH TO AN EXISTING COURSE:

AP Computer Science A (Course #07513) (Computer Science, Grades 10-12) (one-year equivalent, 10 credits)

This course is equivalent to the first semester of a college-level course in computer science.  The course introduces problem-solving and programming using Java.  The topics in this course include program class design, implementation techniques, programming constructions, java library classes, and interfaces included in the AP Java subset, testing, debugging, runtime exceptions, program correctness, algorithm analysis, primitive data types, strings, classes, lists, one and two-dimensional arrays, sorting, searching, and operations on data structures.  A minimum of 20 hours for hands-on lab experiences are also part of the course.  This course is accepted by UC/CSU as a 4th year math course.

The following Requests for Revision to an Existing Board-Adopted Course have undergone review and approval by the appropriate subject-area steering committee(s), the EGUSD Curriculum Council, and have the support of principals.

AP Computer Science A (Course #12118) (CTE Elective, Grades 11-12)

It is requested that revisions to this CTE course be made as follows:

  • The graduation credit be changed to mathematics credit from elective credit;
  • The grade levels be changed to grades 10-12 from grades 11-12;
  • The pre-requisite(s) be changed from “Mathematics I with a grade of C or better or instructor approval; Mathematics II with a grade of C or better; and AP Computer Science Principles” to “Mathematics II and either Computer Science Principles or AP Computer Science Principals.”
  • Add “Single Subject Mathematics” and “SuppAuth-Computer Science” to the credentials listed for this course.

Rationale: Currently, AP Computer Science A earns EGUSD elective graduation credit.  Recently, the UCOP approved this course as a “c” (math) course.  Education Code states that computer science courses that are “c”-approved may be used by the LEA to awarded one year of mathematics graduation credit, providing that more than two years of math are required for graduation.  The grade-level change brings the course into alignment with UC “a-g.”  The CTE prerequisite change to “Mathematics II and Computer Science Principles or AP Computer Science Principles” ensures pathway cohesion.  Sites that do not wish to use this course as part of a CTE pathway will use course #07513 which is a non-CTE course.

Computer Aided Design/Drafting (CADD) (Course #12100) (Mathematics, Grades 9-10)

It is requested that the EGUSD graduation credit earned be changed to elective and CTE credit from mathematics credit.

Rationale: This course is not a UCOP “a-g”-approved course.  Per Education Code, students cannot be awarded math credit for this course.  From the CA Math Graduation Requirements page, https://www.cde.ca.gov/ci/gs/hs/hsgrmath.asp, “If the local educational agency (LEA) requires more than two courses in mathematics for graduation from high school, the LEA may award a student up to one mathematics course credit for successfully completing a “category C”-approved computer science course, as stated in EC 51225.35.”

Transition to Quantitative Reasoning (Course #03661) (Mathematics, Grade 12)

It is requested that the grade level be changed to Grades 11-12 from Grade 12.

Rationale: While originally designed for grade 12 students, this course has a Math III pre-requisite; and, in fact, the target audience is students whose Math III grade is a C/C-.  Since grade 10 students may take Math III, there are grade 11 students who meet this proposed change to the pre-requisite.

Quantitative Reasoning with Advanced Math Topics (Course #03147) (Grade 12)

It is requested that the grade level be changed to Grades 11-12 from Grade 12.

Driver Education (Course #07001) (Elective, Grades 10-12)

It is requested that the course description for this course be revised as follows:

This course meets the California Department of Motor Vehicles’ requirement of a Driver Education course.  The knowledge, skills, and attitudes that students learn in this course can help them avoid traffic tickets, lower their chances of being involved in accidents, and establish safe driving habits.  Upon successful completion of Driver Education, students will receive their Certificate of Completion of Driver Education and be able to provide the required information needed to obtain a learner’s permit.

Adopted curricular materials: Drive Right, Addison/Wesley

Rationale: The existing course description is not aligned to current DMV requirements or course content.  Additionally, the description does not reflect resources available to provide instruction at all high school sites.

IB Mathematics: Analysis and Approaches HL1 (Course #20080) (Grades 11-12)

It is requested that the basic curriculum for this course be changed to “Calculus: Graphical, Numerical, Algebraic, 5th Edition, AP Edition,” (currently adopted for AP Calculus BC) from its current basic curriculum “Haese Mathematics Analysis and Approaches HL 1, Book 2, First Edition, Copyright 2019, and “Haese: Mathematics Core Topics HL, Book 1, First Edition, Copyright 2019.

Rationale: Since the first-year curriculum of IB Mathematics: Analysis and Approaches HL1 is essentially AP Calculus BC, the book for this first year IB math course should be the same book currently used in the AP Calculus BC course.  The remaining IB material is covered in the second year of this IB math course.

Recommended Motion:
The Board of Education is asked to receive disclosure information and a report regarding the sale of Measure M Bonds that occurred on April 6, 2021.
Rationale:

On November 8, 2016 the electorate approved Measure M, authorizing the issuance and sale of general obligation bonds of the District in an amount not to exceed $476,000,000.

 

Consistent with the parameters prescribed by Resolution No. 54, 2020-21, the District successfully sold the third series of Measure M bonds in the amount of $140.5 million and the sale resulted in a significantly lower cost than budgeted in the previously presented and original bond series and structuring plan.

 

Administration and the District’s financial advisor, Government Financial Strategies (GFS), will review the specific details and results of the April 6, 2021 bond sale.  In addition, pursuant to Education Code 15146 there are statutorily required disclosures to be made at the Board meeting immediately following the sale that will also be included in the presentation (attached).

 
Financial Impact:
Generates bond proceeds of $140,240,000 for needed capital projects and bond issuance costs.

The Board of Education will be asked to conduct a Public Hearing to present the agreement reached through negotiations, dated March 5, 2021.  With affirmative action by NUHW to ratify the agreement, and the AB 1200 review approval by the Sacramento County Office of Education (SCOE), the Board of Education is asked to (1) Open a public hearing and receive comments on the agreement; (2) Close the public hearing after listening to comments.  After closing the public hearing, the Board is asked to take action to approve (ratify) the agreement.

Rationale:

Elk Grove Unified School District (EGUSD) and the National Union of Health Care Workers (NUHW), have signed an agreement, First Addendum to Memorandum of Understanding, dated September 24, 2020, for the 2020-21 school year in response to the COVID-19 pandemic.

The AB 1200 review has been approved by the Sacramento County Office of Education (SCOE).  The EGUSD Board is asked to approve (ratify) the attached agreement.  In addition, Education Code Section 3540.2 stipulates a fiscal review by the Sacramento County Office of Education (SCOE) of negotiated agreements to determine the financial impact of the agreement on the District budget.  Therefore, the AB 1200 report, which provides the financial analysis of the MOU, is attached, and was submitted to SCOE for their review, and approval.

The Board of Education is asked to (1) adopt Resolution No. 60, 2020-2021 of Intention to Convey Electrical Facilities Easements to the Sacramento Municipal Utility District for the Pleasant Grove Elementary School project; and (2) to set a public hearing on May 4, 2021, at 9510 Elk Grove-Florin Road, in the Board Room at 6:00 p.m.

Rationale:

The Sacramento Municipal Utility District has requested that the District convey an Electrical Facilities Easement on the Pleasant Grove Elementary School site at 10160 Pleasant Grove School Road, Elk Grove, California.


The final configuration of the easement will be determined, at SMUD’s expense, upon the completion of the installation of the electrical facilities, recording the easement accurately in relation to the facilities.


The purpose of the easements is to allow the Sacramento Municipal Utility District to access, construct and maintain electrical facilities serving the Pleasant Grove Elementary School campus.

                                                                             

The Resolution of Intention must be adopted by a 2/3 vote by the Board. 


As prescribed, notice of this intention will be published in the Sacramento Bee, and posted at Pleasant Grove Elementary School, the Robert L. Trigg Education Center, and the Elk Grove Post Office (8850 Williamson Drive).
