As part of the Board of Education’s legacy of advocacy for equity and the value of diversity within our school district, members of the Board of Education have an opportunity to recognize October 2021 as Filipino American History Month. The Filipino American National Historical Society established Filipino American History Month in 1988 and subsequently, every October, many communities throughout the United States and its territories have celebrated this occasion, not only to commemorate the anniversary of the presence of the first Filipinos on U.S. soil and to observe its heritage, but also to recognize the social, intellectual, and economic contributions of Filipinos and Filipino Americans in this country. The California Department of Education first recognized Filipino American History Month in 2006 and the state legislature passed two bills calling for the integration of Filipino American history into curriculum, Assembly Bill 199 (2011) focused on the contributions of Filipino American veterans in World War II and Assembly Bill 123 (2013) focused on the Filipino American contributions to the farm labor movement, including leaders like Larry Itliong. Filipino Americans play a vital role in the EGUSD community, including more than 3,000 students who identify as Filipino. Throughout the year, the contributions of Filipino Americans are presented in the regular curriculum; however, this special focus for one month serves as a reminder of the combined contributions of this group. |

On July 7, 1997, the Board of Education of the Elk Grove Unified School District approved recommendations of the Civic Values and Ethics Education Action Team. Those recommendations included the observation of Character Education Month. The State Board of Education has designated October 2021 as Character Education Month.
Character education is a learning process that enables students and adults to understand, care about, and act on core ethical values for self and others.
Through passage of a resolution affirming Character Education Month, the Board of Education would support the recommendations of the Civic Values and Ethics Education Action Team. Furthermore, the designation of Character Education Month supports our Elk Grove Unified School District Core Values.

October is National Bullying Prevention Month - a month-long event to prevent childhood bullying and promote kindness, acceptance and inclusion. This is a nationwide campaign, started by PACERS' National Bullying Prevention Center in 2006. The campaign reaches out to communities, schools, and families around the world to educate the need to keep kids safe in school. This campaign is a catalyst for: - Involving a nation to take action at the local level to create safe and supportive schools.
- Sharing information about the issue through news media, social media, video and print publications.
- Promoting dialogue between educators, parents and students on their roles in addressing and preventing bullying.
- Inspiring everyone to unite for kindness, acceptance and inclusion.
- Helping to create a world without bullying.

The Board of Education is requested to approve the recommended Student Board Member who would officially be seated on October 5, 2021. |
On May 18, 2021, EGUSD representatives from the student organization GENup Elk Grove submitted a petition to add a student member to the Board of Education. District staff, in collaboration with the GENup student leaders, developed a timeline to have a student member Board approved on September 21, 2021 and officially seated on October 5, 2021. Key elements of the planning process include: - Multiple planning meetings were conducted including GENup Elk Grove student leadership, District administrators, School District Legal Counsel, and Board Member representatives
- Student Board Member candidates, one elected from each comprehensive high school and one representing the alternative high schools were interviewed by Board members Nancy Chaires Espinoza, Gina Jamerson, and Crystal Martinez Alire
- The recommended candidate is then brought to the full Board for discussion and consideration of approval
The process which included timeline development, site election processes, annual term calendar, roles/responsibilities of the Student Board Member and transition procedures between incoming and outgoing Student Board Members was a collaborative effort between the GENup student leaders and District staff adhering strictly to California Education Code section 35012 and EGUSD Board of Education bylaw 9150. The EGUSD Board of Education has placed a high priority on increasingly engaging students and leveraging student voice in input, feedback and decision-making opportunities. The seating of a Student Board Member is in direct alignment with this priority. |

Bid #703-20/21 was issued on April 02, 2021 to four (4) firms in this market. By the closing date, April 29, 2021, two (2) proposals were received. Contract award to North State Tires was granted by the Board on June 22, 2021. Prior to the contract taking effect, North State Tire has requested authorization to increase their prices by up to 8%. The District has denied this request as it violates two areas of the Bid/contract and has terminated the contract with North State Tire: The District is requesting that award of Bid #703-20/21 be granted to the second low bidder, Good Year Tire in the amount of $93,752.15 The Bid results and recap are in the Purchasing Department for further review. The District recommends the award of a one (1) year contract. This contract will commence on July 1, 2021. Pursuant to Education Code Section §17604, the Board of Education is asked to authorize the Director of Purchasing or designee to execute renewals, terminations (if deemed necessary), and to take other actions as necessary to uphold the contract in the best interest of the District. |

The Administration received and opened seven (7) bids on September 8, 2021, at 11:00 a.m. Air9 submitted the lowest base bid but was deemed non-responsive. United Mechanical, Inc. was the second responsible and responsive bidder (see Attachment A for tabulation of bids). The Administration recommends the award of contract to United Mechanical, Inc. for the total base bid of $415,605.00. |

After listening to any speakers, the Board President should close the public hearing. After closing the public hearing, the Board should be asked to take action to approve (ratify) the Tentative Agreement. |
If the Tentative Agreement between the Elk Grove Unified School District (EGUSD) and the Elk Grove Education Association (EGEA) for the 2020/2021 and 2021/2022 school years is ratified by a vote of the EGEA members and the AB1200 review is approved by the Sacramento County Office of Education (SCOE), the EGUSD Board should be asked to approve (ratify) the attached 2020/2021 and 2021/2022 Tentative Agreement. In addition, Education Code Section 3540.2 stipulates a fiscal review by the Sacramento County Office of Education (SCOE) of negotiated agreements to determine the financial impact of the agreement on the District budget. Therefore, the AB1200 report which provides the financial analysis of the Tentative Agreement is attached and was submitted to SCOE for their review.

The Board of Education is requested to discuss and approve Board Policy 5132 – Dress and Grooming. |
The implications of Board Policy 5132 – Dress and Grooming have historically had a disproportionately negative impact on students of color, particularly female students and students who identify as Black/African American. The District has engaged students, staff, and the Board of Education in a process to update the Board Policy. The resulting action has produced a policy that recognizes the need for basic clothing guidelines while acknowledging the unique needs and interest of students. It also mitigates the negative impact on those disproportionately impacted. The updated policy and enables individual schools the flexibility to customize dress code practices to meet the unique interests of school communities, while remaining consistent with the requirements of the District policy. Calibration activities will be conducted by Elementary and Secondary Education with principals and vice principals to ensure practices adhere to policy. Data will be gathered and reported on annually to ensure practices align to policy and that there is no disproportionate negative impact on any student subgroups. |

The Board of Education is requested adopt the District’s draft American Recovery Plan Act – Elementary and Secondary School Emergency Relief (ESSER III) Plan. |
School districts that receive Elementary and Secondary School Emergency Relief (ESSER) funds under the American Rescue Plan Act, referred to as ESSER III funds, are required to develop a plan for how they will use their ESSER III funds. In the plan, the District must explain how it intends to use ESSER III funds to address students’ academic, social emotional, and mental health needs, as well as opportunity gaps that existed before, and were worsened by, the COVID-19 pandemic. There are three sections to the ESSER III Plan: - Strategies for continuous and safe in-person learning
- Addressing lost instructional time
- Use of any remaining funds
In each section of the plan the District must describe the action, identify the amount of funding specific to each action, note how the actions will be monitored, and the frequency of monitoring. There also is a requirement to note if and where any action aligns to other District plans including the Local Continuity and Attendance Plan (LCP) and the Local Control and Accountability Plan (LCAP).
Stakeholder engagement is a required component of the plan development process. The plan must include descriptions of how the District meaningfully consulted with stakeholders including students, parents/guardians, staff, labor groups, community members, and advocacy groups.
The attached plan is consistent with the feedback received and it is requested the Board of Education adopt the ESSER III plan as submitted. |

The Board is asked to adopt the attached Resolution #22, 2021-22, which recalculates and increases the 2020-21 Gann Limit and establishes the 2021-22 estimated Gann Limit. |
In 1989, the State enacted changes in statutory law (SB 98 and AB 198), Chapter 82 and 83, Statues of 1989, which required a recalculation of the 1978-79 and 1988-89 Gann Limits for all California school districts. In June 1990, the voters approved Proposition 111 which required another one-time adjustment to prior year Gann Limits. Accordingly, the Gann Limit for 1989-90 was recalculated at $71,515,984. Each year we are now required to recalculate the prior year using actual data, and then estimate the Gann Limit for the budget year. |

The Board is asked to receive a budget update for the 2021-22 district budget, and hear a report on the 2020-21 Unaudited Actual Income & Expenditures. The Board is also asked to approve the 2020-21 Unaudited Actual Income & Expenditures state financial reports. |
The unrestricted general fund end balance for June 30, 2021 increased from projection by $20,850,512 which is 2.79%. |
