Public Comments Guidelines for In-Person Public Comments and Participation
The following processes, means, and timeframes shall be available for public comments during board meetings. During Regular Board Meetings, the public may make public comments for items on the agenda or for items not on the agenda in person in the Board Room or virtually via the Zoom platform. Individuals may not defer their time to another individual speaker to increase their individual total time beyond three minutes. The total amount of time allocated to public comments to the Board will be limited to a maximum of three (3) minutes, with a total of thirty (30) minutes designated for public comment on an item. Time limitations are at the discretion of the President of the Board of Trustees. - Approximately between 6:15 pm and 6:35 pm, Public Comments may be made On Items Not on the Board Agenda, but within the school district’s jurisdiction. Please note that “If the public comments [are] on items not appearing on the posted agenda, the board cannot take action or discuss the public comments other than the Board President briefly acknowledging the comments.” (EGUSD Governance Handbook)
- Approximately between 6:15 pm and 6:35 pm, all Public Comments may be made On All Items that are on the Board Agenda. The Board will close Public Comments on all items at the times designated above, unless the end time for public comments is adjusted for a longer period of time by the Board. Please note that the Board may comment and ask clarifying questions related to public comments made on items on the agenda.
- If a member of the public wishes to address an item on the agenda that is scheduled prior to the public comment section of the meeting, the comments will be heard at the time the item is presented to the Board.
- Requests for public comment via Zoom must be received by 4:30 p.m. the day of the board meeting. Zoom comments will be heard within the same timeframe of the in-person public comments as listed above.

The Governing Board is asked to approve Resolution No. 79, 2021-22, regarding AB 361, authorizing the continued use of remote teleconferencing provisions consistent with the Sacramento County Public Health Department’s recommendations, AB 361 and Government Code section 54953, when necessary, consistent with current COVID-19-related Sacramento County Public Health Department safety protocols and quarantine guidelines. |
On September 16, 2021, the California legislature passed Assembly Bill (“AB”) 361 amending Government Code section 54953. AB 361 permits a Governing Board to use teleconferencing to conduct its meetings in any of the following circumstances: (A) the legislative body holds a meeting during a proclaimed state of emergency, and state or local officials have imposed or recommended measures to promote social distancing; (B) the legislative body holds a meeting during a proclaimed state of emergency for the purpose of determining, by majority vote, whether as a result of the emergency, meeting in person would present imminent risks to the health or safety of attendees; or (C) the legislative body holds a meeting during a proclaimed state of emergency and has determined, by majority vote, pursuant to subparagraph (B), that, as a result of the emergency, meeting in person would present imminent risks to the health or safety of attendees. In order for the Governing Board to use teleconferencing as allowed by AB 361 after October 1, 2021, when necessary consistent with current COVID-19-related Sacramento County Public Health Department safety and quarantine guidelines, the School Board must first adopt findings allowing the Governing Board to conduct teleconferenced meetings for a period of thirty (30) days. |

Staff recommends the continuance of its contractual arrangement with Phil McCullagh for Field Intervention Nurse (FIN) services. By securing the contract with Mr. McCullagh the District will be able to continue to provide personalized services for our employees if a work related injury or illness occurs. Mr. McCullagh has provided FIN services for EGUSD for over 10 years. |

The cost associated with this contract has been the same since 2014-2015 and is expected to remain the same through the 2023-2024 school year. Funding for the contract is generated by applying the worker's compensation rate of 1.75% to montly variable employee salaries. |

Using sources, documents, and statistics, students will develop the analytic and evaluative skills necessary to deal critically with issues in American history through a global context and to prepare them for Year 2. The Board is asked to approve Elk Grove Unified School District’s annual applications for Agricultural Career Technical Education Incentive Grant Funding for the 2022-2023 school year. The Agricultural Career Technical Education Incentive Grant provides Elk Grove, Florin, Pleasant Grove and Sheldon high schools with funds to improve the quality of their agricultural career technical education programs. The goal is to maintain a high-quality, comprehensive agricultural career technical program in California's public school system to ensure a constant source of employable, trained, and skilled individuals. In the 2022-2023 school year, Elk Grove High School will receive $46,428, Florin High School will receive $25,376, Pleasant Grove High School will receive $18,600, and Sheldon High School will receive $21,816. |

The District utilized Zoom during the COVID-19 pandemic. This next year will be a year of transition from Zoom to other services, but Zoom is still required to continue programs in place due to the Pandemic. Zoom is used for Instruction, meetings, Professional Development, Webinars and Broadcasting of Board Meetings. During this year professional development and setup will be completed to transition most of the things from Zoom to other services from Google and Microsoft that are already part of our annual licensing agreements. |

Elk Grove Unified School District (EGUSD) and the Site and District Administration, Classified Managers, Classified Administrative Support Staff, and Supervisory Employees (EGTEAMS), have signed a Meet and Confer Summary for the 2020-2021 and 2021-2022 school year. The AB 1200 review has been approved by the Sacramento County Office of Education (SCOE). The EGUSD Board is asked to approve (ratify) the attached Meet and Confer Summary. In addition, Education Code Section 3540.2 stipulates a fiscal review by the Sacramento County Office of Education (SCOE) of agreements to determine the financial impact of the agreement on the District budget. Therefore, the AB 1200 report, which provides the financial analysis of the Meet and Confer Summary is attached and was submitted to SCOE for their review, and approval. |

Pursuant to Education Code Section 17620, Government Code Section 65995, and Government Code Section 66016 et seq. the District is required to adopt a Fee Justification Study in order to levy the statutory (“Level 1”) school fees on commercial/industrial development recently approved by the State Allocation Board. Pursuant to Education Code Section 17620 and Government Code Sections 65995 et seq., the District is also required to adopt a School Facilities Needs Analysis ("SFNA") in order to justify the levy of alternative school fees ("Level 2 Fees” and “Level 3 Fees") on new residential development. The May 2022 combination Development Fee Justification Study/SFNA, prepared by Odell Planning & Research, Inc., demonstrates that the District can impose $7.04 per square foot in Level 2 Fees and $14.08 per square foot in Level 3 Fees on new residential construction and justifies the District charging the statutory Level 1 commercial school fee of $0.78 per square foot. Prior to adopting the Development Fee Justification Study/SFNA, the Board must conduct a public hearing and respond to any comments it receives. This proposed Level 2 fee of $7.04 per square foot of new residential construction represents a 4.8% increase of $0.32 from the current $6.72 fee. The proposed fee increase is primarily due to increased State construction cost allowances. To put this into perspective, based upon the proposed increased Level 2 fee and the average new home size within our District, the Level 2 assessment for a newly constructed single family home will increase on average $774.08. Level 3 fees are collected only in the event that the State Allocation Board (SAB) is no longer apportioning funds for new construction, and the SAB has notified the Secretary of the Senate and Chief Clerk of the Assembly, in writing, of the determination that such funds are no longer being allocated. The District’s May 2022 Development Fee Justification Study/SFNA is attached. The study was sent to all four local Planning Departments on June 3, 2022 and was made available for public review beginning on, June 17, 2022, as required by law. In addition to the public noticing required by law, staff contacted a representative from the North State Building Industry Association (BIA) to discuss the fee study. It is recommended that, on July 19, 2022, the Board conduct a public hearing and review, consider, and adopt the findings contained in the proposed Resolutions approving the May 2022 Development Fee Justification Study/ School Facilities Needs Analysis and adopting the statutory fee for commercial and industrial development and the increased Level 2 and Level 3 Fees for residential development identified therein. School facilities fee adjustments are not subject to the provisions of the California Environmental Quality Act. |

The Education Code requires that each school district submit a Board approved Adopted Budget to their respective county office of education by July 1 of each year. The 2022-23 Budget for all funds is consistent with the June 14, 2022, public hearing.
Staff is continuing to monitor actions at the state level, evaluate new information as it is known and will provide reports recommending adjustments to the budget accordingly.
