Dr. Berman presented Resolution #11-20/21 opposing youth access to cannabis through marijuana storefronts and commercial cultivation. Dr. Berman provided context and history regarding past instances wherein potential marijuana businesses intended to open near student bus and bike routes and the board previously approved letters to oppose the location. Currently, a dispensary is being planned in Sausalito and the Mill Valley School District board is joining Tamalpais Union High School District in opposition for the safety and well-being of students. There was public comment and board discussion on this item. The Board directed Dr. Berman to write a letter of opposition and share this resolution with this planned dispensary and any similar future plans. Item approved as presented.

D.2. District Update: Dr. Lisa Santora and MVSD Updates and Board Discussion
Minutes:
MVSD Staff discussed COVID-19 surveillance testing for students and next steps for returning to full time learning. Dr. Lisa Santora, Deputy Health Officer, provided data and current Public Health Department Guidance including that the COVID-19 case rate per 100,000 in Marin County continues to steeply decline and there have been only 10 suspected in-school transmissions of COVID-19, while Marin Schools have had 991,408 “student days” this school year as of February 5, 2021. Marin County Public Health has provided guidance that supports the return of full, in-person instruction based on school readiness and adherence to a submitted and reviewed School Site-Specific Protection Plan (SSSPP). It was also reported that current estimates indicate that all district staff will be able to receive the second and final dose of the COVID-19 by late March or early April.

In anticipation of Marin County moving into less restrictive tiers, and pursuant to the legal requirements of SB 98, as well as County Health Department guidance, the District has contacted both CSEA and MVTA unions to discuss a plan to return to full day instruction. There are dates scheduled to negotiate with CSEA and the District has proposed dates to MVTA.

There was extensive public comment and board discussion regarding the update. The Board directed Dr. Berman and staff to move forward with planning for full-day in-person learning at the earliest possible date following the offer of the second vaccination for all staff who are working in person. Dr. Berman stated the earliest possible return would be April 12th and information will be communicated as received.

Lastly, Dr. Berman shared there was an LCAP student input session which provided valuable feedback to the team.

The Mill Valley School District (MVSD) recognizes that the impact of COVID-19 has resulted in closures throughout the state. 

Pacific Discovery / Terra Marin had requested a significant monthly rent reduction.  On May 14, 2020, the MVSD Board agreed to a 50% monthly rent reduction during the COVID-19 public school closures through May 1, 2020.  This rent reduction was extended through June 1, 2020 in alignment with public school closures.  Effective July 1, 2020, Pacific Discovery / Terra Marin resumed full monthly rent.

All terms of the Lease currently in place between the District and Pacific Discovery School, Inc. (dba Terra Marin) will remain in effect and have not otherwise been modified or amended.  The District reserves all of its rights with respect to this matter.

H.6. Bright Horizons Extended Day School Centers Temporary Rent Suspension

The Mill Valley School District recognizes the continued impact of COVID-19 which has resulted in closures of afterschool childcare.  Due to the COVID-19 pandemic, Bright Horizons programs at Edna Maguire, Old Mill, Park, Strawberry Point and Tam Valley have been closed.  Bright Horizons will continue to maintain insurance coverage and fulfill all other obligations of the lease.  Bright Horizons anticipates resuming their programs in Fall 2021.

The loss of rental income for the district for the Bright Horizons Extended Day School Centers is $130,215 for January 2021 through June 2021.

In January 2020, the Mill Valley School District board took action to approve permanent shade structures, including design and geotechnical evaluations of soil samples.  The structures will be designed for Old Mill, Park, Strawberry Point and Tam Valley Elementary Schools and will allow for a covered area for students to eat lunch and allow for outdoor learning.  Additional architect services per the attached proposal is required costing an additional $37,000.

The district is working with HY Architects for the design of four (4) shade structures, obtain DSA approval, provide construction documents and bid specifications. Once the design and approvals are obtained, the District will publicly bid this project. The expense for these shade structures will be funded from Fund 40.

To bring the district in line with the Marin County of Education reporting cycle, the Mill Valley School District is requesting the Board of Trustees to authorize the Superintendent of Schools to sign the Comprehensive Audit and Confirmation form, which is state required and began in the 2019-20 school year. Local school districts must approve safety plans for all schools in the district by March 1 of each year. School safety plans are mandatory and help ensure that schools are as prepared as possible for emergencies and maintain safe and secure learning environments.

MVTA informs the District that kindergarten teachers at Park, Old Mill, and Strawberry Point would like to use the CBA Article 1.8 to change the delivery of instruction of Art and Library sessions from in-class to during students' asynchronous times.

The teachers at Edna Maguire School and Tam Valley School are not requesting a change in instruction delivery, so their schedules will remain the same.

As required by Article 1.8, this change has been approved by the Association Members at Park, Old Mill, and Strawberry Point school.  This waiver process applies to the CBA and all other agreements.  They are ready to implement this change as of February 22, 2021.
